The City Council of the City of Okeechobee, Florida, met in regular session at the City
Hall on the~ above da%~.at 7:00~iP.M. with t'he following present: Mayor Audley Dunham, President Donald
L. Burk, Councilmen: E.H. Hunt, Edward W. Douglas, Russell V. Domer, Clifford C. Betts, Jr., City
Clerk Sandra Bennett, Director of Public Works, L. C. Fortner, Jr., Attorney J. Edward Curren and
Fire Chief Olen Godwin.
President Burk opened the meeting with prayer by Councilman Douglas.

Pursuant to notice published in the Okeechobee News regarding a public hearing to consider
rezoning from Agriculture to Commercial Lot 13, Block 31, Original Town of Okeechobee, President Burk
masked if there were any objections to the requested rezoning. Mr. and Mrs. Edgar Raulerson were
present requesting clarification of the intended use of the property. It was reported that Mr.
Cobb planned to sell the property. After discussion Councilman Douglas moved to rezone the above
described property as requested and to amend Ordinance #271, seconded by Councilman Domer and
was unanimously adopted.

ORDINANCE AMENDING ORDINANCE NO. 271, BEING AN ORDINANCE ESTABLISHING
ZONING REGULATIONS FOR THE CITY OF OKEECHOBEE, FLORIDA, AND PROVIDING
FOR THE ADMINISTRATION, ENFORCEMENT AND AMENDMENT THEREOF PURSUANT TO
THE PROVISIONS OF CHAPTER 1 76, FLORIDA STATURES, 1953.
WHEREAS, application has been made by David d. Cobb, Sr., requesting this
Council to rezone from Agriculture to Commercial Lot 13, Block 31, Original Town
of Okeechobee, and
WHEREAS, notice of intention to amend City Zoning Ordinance No. 271, regarding
said application was duly published according to law, and
WHEREAS, on the 9th day of April, 1972, a public hearing was held in the City
Council room pursuant to said notice, and
~EqEREAS, it is deemed to the best interest of the City of Okeechobee to grant
said application; now therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA:
SECTION 1. That Lot 13, Block 31, Original Town of Okeechobee be and is hereby
rezoned from A~riculture to Commercial, effective April 9, 197h.
SECTION 2. That the application requesting rezoning and proof of publication to
amend Zoning Ordinance No. 271 published in connection with the above application be
attached to this Ordinance and become a part hereof.
SECTION 3. That the City Clerk make the appropriate change on the City Zoning
Map in accordance with this Ordinance.

The Council requested Director Fortner to tabulate bids and report to the Council with his
recommendation. Afterwhich Director Fortner returned and reported that Apperson Chemicals, Inc.
had presented a bid for all chemicals listed and the performance in the past of delivery had been
~adequate. Upon recommendation by Director Fortner, Councilman Hunt moved to accept bid from
i Apperson Chemicals, Inc. for the purchase of chemicals as listed above, seconded by Councilman
Douglas and unanimously carried.
Mr. Alton G. Cox, Subregional Representative of the State of Florida Department of
!~'Polluction Control was present in regards to increasing complaints concerning open trash buring in
i the Okeechobee area. Mr. Cox reported that there had been numerous complaints during the past two yearsli
but were now more frequent. Mr. Cox presented the Council with rules of the Department of Pullution
~Control Chapter 17-5 Open Burning and Frost Protection Fires and informed the Council o~ the
~porceedure of handling complaints. Farmers planning on burning off land should notify the Florida
!Division of Forestry for a permit.
Mr. Tom Close and Mr. Kenneth Bass, representatives of Charles Royal, Contractor, were
~present at the request of the Council in regards to Mr. Charles Royal requesting permission to
ipave within the Right of Way of Riverview Drive adjacent to and paralleling the North Shore Plaza
~ Shopping Center. The Council informed Mr. Bass and Mr. Close that the right of way i£dpaved would
cover utility pipes and lines, that it was the original intent to permit only one exit on the parking
lot and entrance for traffic. After much discussion the Council requested that the parking area be
re-painted to ~aliow Only~t~he one exit and entrance, also to pain "No Parking" in restriced areas.
Mayor Dunham reported on the hazardous parking along South Park Street. The Council
informed the Mayor that the County has full responsibility for the Secondary road system and that
the City would have to discuss the problem with the County Commissioners.
The monthly report for the Building Department was presented. It was reported by President
iBurk that Mr. Spray, Building Official, was reportedly doing fine and should be back to~ork in a
'week. The Council discussed writting a letter of appreciation to the County Commissioners and
to the County Building Official, Mr. Clayton White. President Burk to write the letters
Director Fortner presented the Water, Sewer and Street report for the month of March, 1972.
Memorandum No. 1 - Items needed for stock at water plant, in the amount of $1,693.32.
Councilman Hunt moved to authorize Director Fortner to purchase items as Listed, seconded by
Councilman Domer and carried.
Attorney Curren requested a workshop meeting to discuss making the Citys retirement
manditory, a referendum on making the office of City Clerk appointive. The Council agreed to
call a workshop in the near future.
Fire Chief Olen Godwin presented the fire report for the month of March. Chief Godwin
requested the authority to purchase S%eel~in the amount of $125.00 to complete the %anker truck.
Chief Godwin stated that the Voluntter Firemen would Furnish the labor at no expense to the City.
. Councilman Betts moved to authorize Chief Godwin to purchase steel, seconded by Councilman Domer
and carried. Chief God~in reported the the Citys new fire truck was expected in June and requested
.a radio to be installed in the new truck.
Police Chief Dewitt H. Staats presented the Council with a letter of resignation from
Carl D. Johnson, radio di~wpatcher, effective April 19th. Councilman Domer moved to accept the
resignation , seconded by Councilman Betts and carried. Chief Staats submitted a job application on
Rudy Douglas Dyer for Radio dispatcher to replace Johnson. After reviewing the application,
Councilman Domer moved to employ Dyer , Jseconded by Councilman Betts and carried.
City Clerk Sandra Bennett submitted a report on the Session 2 of the F~C-FSU Governmental
Accounting Pro,ram in Ft. Lauderdale she attended in April,:
Councilman Hunt reported that Mr. R. E. Hamrick requested a workshop meeting with the
Council in regards to opening a street. The Council set April 16th at 6:00 P.M. to meet with Mr.
' Hamrick.
Councilman Doulgas reported that he had investigated the request by Mrs. Patricia Grant
at the March 1 2th meeting for streeb lights at Deans Court and recommended that three poles
and four lights be provided for the area. The Street Department Committee to investigate.
Councilman Domer reported complaints from Kelly Trailer Park on trash pile up near the
area. Fire Chief Godwin, Police Staats and Councilman Domer instructed to investigate.
Police Chief Staats requested permission to purchase two walkie talkie radio,~units for
~the Police Department at a approximate cost of Sh00.00. Also Chief Staats informed the Council
if he could draw up specifications on a new 197~ police car. Chief Godwin inquired if the Fire
.Department could have the old Ford Car. The Council withheld action until matter could be
investigated.
City Clerk Bennett reported a request for a city occupational license from W. R. Leitner
in a residential area for a part time garage work. After discussion, Councilman Betts moved to
~dissapprove request, seconded by Councilman Domer and carried.
Councilman Betts moved to pay for Johnny Bennett room while City Clerk was attending
Seminar in Ft. Lauderdale, seconded by Councilman Domer and carried.
Minutes of meetings held January 8th, 10th, 22nd, February 5th, 7th and l~th were read
~and approved as read upon motion of Councilman Douglas, seconded by Councilman Domer and carried.
Mr. Henry Hooker was present presenting the Council with a progress report on his obtaining
easements from property owners in the block South of Hooker property for sewer line easements. After
discussion Councilman Domer moved to instruct Attorney Curren to confirm didication of alley way to

City, authorized a sur~ey made on the description of the alley way and to take an elevation of said
alley way contingent on dedication of alley way, seconded by Councilman Betts and carried.

The City Council of the City of Okeechobee, Florida, met in recessed session at the City
Hall on the above date at 6:00 P.M. with the following present: President Donald L. Burk,
Councilmen E. H. Hunt, Edward W. Douglas, Russell V. Domer, Cliff C. Betts, Jr, Director of Public
Works, L. C. Fortner, Jr. and City Clerk Sandra Bennett.
Mr. R. E. Hamrick and Mr. Bill Rooks were present requesting the City to open S. E. 3rd
Street between S. E. 5th Street and S. E. hth Street. Mr. Rooks and Mr. Hamrick stated that they
"would clear the streets if the City would haul off the trees on said street. After discussion Council.
man Domer moved to open S. E. 3rd Street, subject to confirmation that one block of 3rd Street was
dedicated street, seconded by Councilman Betts and carried. The Council instructed Attorney Curren
to check out right-of-way.
Mr. Hamrick reported that he was in the process of having Taylor Creek dredged.
Councilman Domer discussed purchasing One ~w police car, walkie talkies and radio unit to
ilbe installed in the new car. After discussion Councilman Domer moved to authorize Police Chief Staats
to draw up specificationson new car andto purchase one G. F~ mobile MT 75 FFU h channel radio and two
G. E. Portable radios at ~681.00 each, seconded by Councilman Betts and carried.
Councilman Betts moved to authorize Fire Chief Godwin to purchase I G.E. mobile radio for
new fire truck,at $7h0.00, seconded by Councilman Douglas and carried.
President Burk presented the Council with copies of letters send to the County Commissioners
and Building Official Clayton White expressing their gratitude and thanks for their support and
cooperation in maintaining the Citys building inspection proEram during the illness of Mr. Spray.
President Burk stated that Mr. Spray:would be off for another month, and that he had made arrangemenSs
~with Mr. Donald A. Wells to maintain the building department until Mr. Spray is able to resume full
~:activities. President Burk requested the Council to consider putting Mr. Spray on an Administrator
i'L~av~ whil~ absen~ and recommenHed that the City compensate Mr. White for his services. Councilman
iiDomer moved to authorize President Burk to work out details with Mr. Wells on salary, place Mr. Spray
on Administrative leave and to pay Mr. White for services rendered, seconded by Councilman Betts and
carried.
A re-zoning application was received from Leslie and Lou 'alla Perry requesting that Lots
2 anti 3, Block 220, Original Town of Okeechobee be re-zoned from Residential (R-l) to Commercial. The
;:iapplicati°n read that he planned to sell the property for sales and service of Electronic Equipment.
