0131 (Setting Fees For Trials )ORDINANCE NO. /Si AN ORDINANCE AMENDING SECTION ONE OF ORDINANCE NO. 123 OF THE CITY OF OKEECHOBEE, FLORIDA; BEINGNAN ORDINANCE SETTING THE FEES TO BE ALLOWED OFFICIALS OF THE CITY OF OKEECHOBEE, FLORIDA, FOR TRIALS IN MAYOR'S COURT FOR VIOLATION OF MUNICIPAL ORDINANCES, AND PROVIDING THAT THEY SHALL BE ASSESSED AS COSTS.° BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA: Section One: That section one of Ordinance 123 of the City of Okeechobee, Florida is hereby amended to read as follows: °Section One: That for every trial, of any person or persons, for violation of a municipal ordinance of the City of Okeechobee, Florida, the Mayor of said City shall be entitled to a trial or docket fee in the sum of Two ($2.00) Dollars; that for every conviction or plea of guilty for violation of a municipal ordinance of the City of Okeechobee, Florida, the Clerk of said City shall be entitled to a fee of One 01.00) Dollar and the Police Officer apprehending the defendant in said cause, in case of conviction or plea of guilty, shall be entitled to an arresting fee in the sum of Two ($2.00) Dollars, PROVIDED HOWEVER, that in case of conviction or plea of guilty the Mayor shall suspend or remit the cost, then in such case he shall not be entitled to the fee aforesaid; and in the event the Clerk and /or Police Officer consent to ANN their cost being remitted or suspended they shall not be entitled to such fees, but the Mayor shalllnot suspend or remit the fees to which the Clerk and /or Police Officer are entitled without their consent. All fees shall be assessed by the Mayor of the City of Okeechobee, Florida, as part of the costs, and shall be paid by the person or persons so convicted or pleading guilty; in the event the charges are dismissed against any person or persons having been apprehended the try al or docket fee due to the Mayor shall be paid from the r ._w= .
