The Council requested Director Fortner to tabulate bids and report to the Council with
hi~ recommendation. Afterw~hich Director Fortner returned and reported that both companies bids
met the specifications reou.~sted. After discussion CounciLman Hunt moved to~accept the bid from
W. E. Johnson Equipment Company of Hialeah, Florida in the amount of $~,900.00, seconded by Councilman
Betts and carried.
I~Layor Durkham reported that he had investigated the request from the Council concerning a
letter received from The Humane Society of Highlands County, regarding reports of cruelty to animals.
~ayor Dunham stated that apparently the information received was based on out-dated information.
Mayor Dunham also reported on a request from Ken's Fun Kart for a ~ity occupational license
located at S.E. Park Street. Maryor Dunham stated that they had in the past donated 10% of their
income to some charity in other cities where they had operated and would like to continue the same
proceedure in Okeechobee by donating 10% to The Policemen Retirement Fund. Attorney Curren advised
the Council that it would be legally improper to issue a license under this agreement. After discussion
The Council agreed to postpone action on issuing a license until Chief Staats and Mayor Dunham investi-
gated further.
Pur~uant to notice published in The Okeechobee News regarding a public hearing to consider
rezoning Lot 10 and ~ of Lot ll, Block 109, Original Town of Okeechobee from Residential (R-1) to
Commercial. ?resident Burk asked if there were any objections to the requested rezoning. No objections
was heard or filed. After discussion Council~mn Domer moved to rezone the above described property
from Residential (R-1) to Commercial, presenting the following ordinance and moved its adoption and

Bui]~mding Official Spray presented the Building Department quarterly report. Mr. Spray
discussed the need of house numbers which would benefit all the Departments. After discussion
The Council authorized Mr. Spray to contact Mr. Robert Glenn, Postmaster, concerning the matter.
Director Fortner presented the thter, Sewer and Street Report for the month of December,

Director Fortner discussed with the Council on hauIing extra top soil for the embankment

to authorize Director Fortner to haul extra soil, seconded by Councilman Betts and carried.
Director Fortner reported that Doug Holden, Sewer Plant Operator, had quit and' recommended
that Elmer Smith be transferred to the Sewer Department as Trainee at the same salary under his
.supervision. Councilman Hunt moved to authorize-~-. Director Fortner to transfer Smith to Sewer
iDepartment to operate temporarily under Director Fortner's certificate, seconded by Councilman
(Domer and carried.
The need for a new system on collecting water bills and billing in the Water Department
was discussed. Council agreed to call a workshop meeting to'study the present system in the future.
Director Fortner requested clarification of responsibility for maintenance of paved
i~Secondary roads within the City limits He stated that SouthWest 2nd Ave. and Fighth Street
Were in need of repair now but that the CoUnt~ Road Superintendent was under the impression it
was the Citys responsibility. The Council requested Attorney Curren to discuss the problem with
the County Attorney.
Director Fortner reported on the progress of the new water plant.
Attorney Curren reported that the Bond. Council requested clarification on the status of the
title of City Clerk. Councilman Domer moved to confirm that at the October 2, 197~ meeting, Sandra
Bennett was appointed by The City Council as City Clerk to fill the vacancy created by the resignation
of Lorena Spivey, seconded by Councilman Betts and carried.
The possibility of appointing the office of City Clerk and a salary adjustment for the
Clerk was discussed. The Council agreed to call a workshop meeting in the near future on this matter.
January 22, 1974 at l:OO P.M. was confirmed for the date of the Farmers Home Administration
Bond Closing.
Aletter was read from Jack M. Poorbaugh, Representative, informing the City that the
Legislative Delegation will be having hearings pertinent to leoodslation to be considered in the
1974 April Session of the ~egislature at 9:30 A.M., February 14th, in the Okeechobee County Council

hereinafter called the "Department" and the Cit~ of 0keechobee , FLO~LIDA, hereinafter' cslled the
WITNESSETH:
%~EAS, the construction and maintenance of a traffic signal, or signals, is necessary
for the saf~ and efficient highway transportation at the location or locations as described in
Exhibit "A" attached hereto; and
~{~EAS, the Public Body, by resolution attached hereto and made a part hereof, has
determined that it is in the public interest for the Public Body to assume the responsibility for
maintenance and electrical power costs incurred in the operation of said signal installation:
N~_.~, ~HW~ORE, THIS INDenTURE WI'I~ESSETH: That in consideration of the premises and
the mutual convenants contained herein to be undertaken by the respective parties hereto, the
parties and each of them, mutually agree and covenant as follows:
1. That the traffic signal or si~omals as described in Exhibit "A" attached hereto
and made a part hereof, will be so designed that the functional design of the installation and
its components will be mutually acceptable to the parties hereto, and will be installed under
Department supervision, with the actual method of construction and financing determined by the
Department's policies, budget, and agreement or agreements which it may have with this or another
o~overnmenta~, unit relating=to the financing and construction thereof.
2. That the Public Body shall, upon completion of the installation and acceptance by
the parties hereto, assume the sole responsibility for the maintenance and continuous operation
of said si~ml instmllation and the payment for all costs for electricity and electrical charges
incurred in connection with the operation thereof.
3. The Public Body shall maintain the signal installation in accordance with Department
policies and to a level of maintenance that will provide minimum hazard to movement of traffic.
In this regsrd the Public Body shall record maintenance activities relative to said traffic signal
installation to a "Department of Transportation Traffic Signal I'~intenance Log" or an approved
e~uivalent ]og.
h. That the equipment shall remain the property of the Department, and it is hereby
uDderstood ~ud sgreed by the parties hereto that the Public Body may remove any,componeDt of the
installed ec~uipment for repair but the Public Body shall not, under any condition, permanently
remove the r'~ain frame of the control unit without the e~..~press written perr~ssion of the Department.
3. It is expressly understood and agreed by the parties hereto that the ~ciring of the
cabinets and the timing of the signals will be such that the traffic will be properly handled at
the time of the completion of the installation of the signals. Necessary modifications in tir.~ng
or minor circuity may be made by the Public Body to accommodate the changing needs of traffic but
the Department reserves the right to examine the equipment at any tim~ and after due consultation
~.,~th the par~ies hereto, specify timing and phasin~ that, will provide a safe and expeditious
traffic ~ o'

6. The Public Body shall not modify the equipment to provide additional phases or
intervals without written permission from the Department.
7. The Public Body hereby agrees to indemnify, defend, save and hold hard,less the
Department for all claims, demands, liabilities and suits of any nature whatsoever arising out
of, because of, or due to the breach of this ~ ~ e +
a~,eem~.n., by the Public Body, its agents or employees,
or due to anl~' act or occurrence or o]mmission cr commission of the Public Body, its agents or
o;.~p!oyees. It is specifically understood and ao~reed 'that this idemnification agreement does not
cover or inderanify the Oepartment, or its agents or employees, for its o~-~l negligence or brcsch
of contract.
$. It is mutually agreed that the Department's Director of Road Operations shall
decide all euestions, difficulties and dAsputes of any nature whatsoever that may arise under, or
by reason of this a~-eement, the prosecution and fulfillment of the services hereunder and the
character, cuality, amount and value thereof; and his decision upon all claims, questions.and
disputes sha].l be final and conclusive upon the parties hereto.
9. It is understood and agTeed by the parties hereto that this agreement shall re:main
in force during the life of the originally installed, equipment and any replacement equipment
installed by the mutual consent, of the parties hereto, provided however that additional or replace-
ment e~uipment purchased and installed wholly at the expense of the Public Body in accordance with
this provision shall remain the property of th~ PublicBody~.
