0182 (Amend ord.163 Alcohol )ORDINANCE NO. /8& BEING AN ORDINANCE AMENDING SECTIONS FOUR AND FIVE OF ORDINANCE NO. 163 OF THE CITY OF OKEECHOBEE, FLORIDA, BEING AN ORDINANCE IMPOSING LICENSES AND OTHER TAXES ON THE MANUFACTURE, DISTRIBUTION_, AND SALE TAINING MORE THAN ONE PER CENTUM OF ALCOHOL, PROVIDING FOR THE PAYMENT AND COLLECTION THEREOF AND PRESCRIBING PENALTIES FOR THE VIOLATION OF SAID ORDINANCE" BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA: SECTION 1. That Section 4 of Ordinance #163 of the City of Okeechobee, Florida, be amended to read as follows: " SECTION 4. Licenses herein referred to shall be classified as follows: A. VENDORS. Each vendor shall pay an annual City License Tax as follows: (1) Vendors who may sell only beverages containing alcohol of more than 1 per cent by weight and not more than 14 per cent by weight, end wines regardless of alcoholic content $15.00 (2) Vendors operating places of business where beverages are sold only in sealed containers for comsumption off the premises where sold . ... $150.00 (3) Vendors operating places of business where consumption on the premises is permitted - $200.00 (4) Persons associated together as a chartered or incorporated club, including social clubs incorporated by Orders of Circuit Judges, after charters have been found to be for objects authorized by law and approved by the said Judges as organized for lawful business and not for the purpose of evading license taxes on dealers in Beverages defined herein, which such organizations are bona fide clubs, and at the time of application for license hereunder shall have been in continuous active existence and operation for a period of not less than two years in the City of Okee- chobee, shall, before serving or distributing to their members or non - resident guests the beverages defined herein, whether such service or distrubution be made upon contribution to the club of money or by check or other device, pay an annual license tax of $125.00 " SECTION 2. That section 5 of Ordinance #163 of the City of Okee- chobee, Florida, be amended to read as follows: "SECTION 5— Each manufacturer authorized to do business under the Provisions of House Bill #496, Laws of Florida, Acts of 1935 shall pay an annual City License Tax as follows: A. If engaged in the manufacture of wines and nothing else, a City license tax of - - - -- $50,00 B. If engaged in the manufacture of wines and cordials and of nothing else, a license tax of TTT x'100.00 C. If engaged in the business of brewing malt liquors and nothing else, a license tax of $750.00 D. If engaged in the business of distilling spiritous liquors and nothing else, a City Tax of T.T .- -$750,00 E. If engaged in the business of rectifying and /or blending spiritous liquors and nothing else, a City Tax of $1250.00 in Persons licensed hereunder /the business of distilling spiritous liquors may also engage in the business of rectifying and blending spiritous liquors without the payment of en additional license tax. F. Each Distributor who shall sell beverages containing alcohol of more then 1 per cent by weight end not more then 14 per cent by weight and wines regardless of alcoholic content, shall pay for each and every such establishment or branch he may operate or conduct, a City license Tax of - - -- $200.00 G. All other Distributors shall pay a license tax of $350,00 SECTION 3. All Ordinances and parts of Ordinances in conflict herewith be, and the same are hereby repealed. SECTION 4. This Ordinance shall take effect immediately upon its passage by the City Council and approval by the Mayor or upon taking effect without such approval. Read a first time and by unanimous consent passed to a second reading. Read a. second time and by unanimous consent passed to a third and final reading.
