Burk, Councilmen: E. H. Hunt, Edward W. Douglas, Russell V. Domer, Clifford C. Betts,Jr. with AttorneyJEdward Curren, Acting City Clerk, Sandra Bennett, Director of Public Works, L. C. Fortner, Jr. and Building Official, Richard B. Spray. President Burk opened the meeting with prayer. Pursuant to notice published in The Okeechobee News regarding a public hearing to consider rezoning - Lots 3 and 4, Block 105, Original Town of Okeechobee from Residential (R-2) to Residential (R-3), President Burk asked if there were any objections from the public to the requested rezoning. No objection was heard or filed. Councilman Douglas moved to rezone the above described property, from Residential (R-2) to Residential (R-3), presenting the following Ordinance and moved its adoption and upon being seconded by Councilman Domer was put to a vote and adopted~ ORDINANCE NO. 271 - (92) ORDINANCE AMENDING ORDINANCE NO. 271, BEING AN ORDINANCE ESTABLISHING ZONING REGULATIONS FOR THE CITY OF OKEECHOBEE, FLORIDA, AND PROVIDING FOR THE ADMINISTRATION, ENFORCEMENT AND AMENDMENT THEREOF PURSUANT TO THE PROVISIONS OF CHAPTER 176, FLORIDA STATUTES, 1953. WHEREAS, application has been made by Muzaffar Husain, M. D. requesting this council to rezone from RESIDENTIAL (R-2) to RESIDENTIAL (R-3) Lots 3 and 4, Block 105, Original Town of Okeechobee, and WHEREAS, notice of intention to amend City Zoning Ordinance No. 271, regarding said application was duly published according to law, and WHEREAS, on the 6th day of November, 1973, a public hearing was held in the City Council room pursuant to said notice, and WHEREAS, it is deemed to the best interest of the City of Okeechobee to grant said application; now therefore BE IT OBTAINED BY THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA: SECTION 1. That Lots 3 and 4, Block 105, Original Town of Okeechobee, be and are hereby rezoned from Residential (R-2) to Residential (R-3) effective November 6, 1973. SECTION 2. That the application requesting rezoning and proof of publication to amend Zoning Ordinance No. 271 published in connection with the above application be attached to this Ordinance and become a part hereof. Attorney Curren stated that their system has no application here. The Florida Department of Transportation Maintenance agreement resolutions was presented for consideration. Upon the 1st reading it was moved by Councilman Domer to adopt said resolutions seconded by Council- man Betts and carried. The Fire Report for the month of October was presented. Mayor Dunham reported the Humaine Officer was having some difficult~ies enforcing regulations in the County. Attorney Curren stated that the County doesn't have an ordinance governing dog empoundment, Council designated Mayor Dunham and Councilman Hunt to meet with the Commissioners and inform them that the City is suspending agreement with County until County adopts ordinance. Mayor Dunham reported signs in park had been removed. Council authorized Director Fortner to remove any unauthorized signs placed in the park. Mayor Dunham reported that one of the Patrolemen's watch band had been broken during an arrest. Mayor Dunham recommended that the City pay for a new bank at $20.75. The Council agreed with recomendation. The City Church Directory Sign was discussed. The Council asked Director Fortner if any of the Churches had responded to have their sign re- done. Director Fortner stated that 9 had replied. The Council authorized Director Fortner to contact the Churches and see if they would be in favor to pay $20.00 to have their sign up-dated and report at the next workshop meeting. Director Fortner presented the Water, Sewer and Street Department Report for the month of October. A report was given by Director Fortner concerning the Citys Street Sweeper. Director Fortner felt that the sweeper has become a liability to the City due to the high cost of repair work. After checking with firms in the South Florida Area, he found he could get $2,000.00 trade in on the present sweeper for a new machine. The Council authorized Director Fortner to gather related data and report at the next workshop meeting. Director Fortner presented the Council with employee performance evaluation forms on Janice Johnson, Secretary and Mitchell Selvey, Motor Equipment Operator f/1 in the Street Department, recommending an salary increase. due to quality of work performed. After discussion, Council advised Director Fortner that all employees must be employed for a period of six months before he will be eligible for a salary increase. Director Fortner reported receipt of job application for Motor Operator Equipment 1 trainee from Maurice Wesley Lambe, who had previously been employed by the City and recommended that the Council employ Lamb at $6,000.00 starting salary. Councilman Douglas moved to employ Maurice Wesley Lamb as Motor Equipment Operator 1 Trainee at $6 000 per year basic salary seconded by Councilman Domer and carried. The median strip on South West 4th Street was discussed. Director Fortner asked for Councils recommendations for a solution as it was creating a traffic hazzard. Councilman Douglas to investigate. Memorandum No. 1 - Fire Extinguishers for City Buildings~ 7 - 10 lb. Fire Extinguishers for City Hall @ $26.00, total cost $182.00; 5 - 10 lb. Fire Extinguishers for Water Plant @$26.00, total cost $130.00; 2 - 10 lb. Fire Extinguishers for Sewer Plant @ $26.00 total cost $52.00 and 1 - 10 lb. Fire Extinguishers for City Barn @ $26.00 total cost $26.00 a total of $390.00. Councilman Betts moved to approve Memorandum No. 1 and authorize the purchase of needed items-as listed, seconded by Councilman Domer and carried. Memorandum No. 2 - Stock items needed at water plant in the amount of $3,327.44. Councilman Hunt moved to approve Memorandum No. 2 and authorized the purchase of items as listed seconded by Councilman Betts and carried. Memorandum No. 3 - 1 - 55 gal. drum sign stripper at $233.75. Council- man Hunt moved to approve Memorandum No. 3 and authorized the purchase of 55 gal. drum stripper, seconded by Councilman Douglas and carried. Memorandum No. 4 - Approximate cost to run lab test for Okeechobee County School Board: 6 man hours each month @ $3.34 - $20.04; 6 miles on truck each month @.20¢ - $1.20, total cost each month $21.24 for September and October 1973. Director Fortner stated that the Pollution Control Board will require more test in the near future which may require two more hours per month for each plant. Council authorized Director Fortner to proceed with test each month and bill the County School Board with cost until such time the cost change. Memorandum No. 5 - Culverts for stock at City Barn at $321.20. Councilman Douglas moved to approve Memorandum No. 5 and authorizod tho purchase of Culverts, seconded by Councilman Betts and carried. Memorandum No. 6 - 1 Electric Welder at $174.95. Councilman Domer recommended that action be withheld until other machines could be investigated. Council authorized Director Fortner to investigate prices on threading machine. Mayor Dunham reported on the condition of a prisioner confined in Director Fortner reported on the need of an outside stairway on the new i;73 Chemical building. Council to investigate. Council authorized Director Fortner to prepare bids on a new self- propelled electric lift truck with the provision to demonstate equipment ' Director Fortner presented estimates on lowering ceiling in the Building Official and Director of Public Works office. Action postponed until workshop. Council discussed issu~ing a memorandum to the Department Heads clarifying Citys policy and procedures on hiring and firing and changes in structures or re-modeling. A re-zoning application was received from Louis R. DeMicco requesting Lots 1, 2, 3, 4, 5 and 6, Block 29, McMullin Woodland Park and Lot 1, Block 44, Vickers Woodland Park be re-zoned from Residential (R-l) to Residential (R-3). Councilman Douglas reported on a request from Mr. b to have 17th Street opened as he plans to sell 9 lots. Council requested Councilman Douglas to advise Mr. Cobb to have his lots surveyed. Councilman Domer moved to purchase uniforms for the Dogs'.Warden, seconded by Councilman Betts and carried ' President Burk reported on discussion he had with Commissioner Durrance regarding City and County Cable Vision. President Burk stated that the County was agreeable to negotiate with City on future companies interested in supplying City and County with cablevision. Attorney Curren to examine franchise City has with Ultra Comm. Councilman Domer reported on request from Chief Godwin and Edmond Reutebuch for an increase in amount served per meals for prisioners. The Council recessed to meet at 6:30 P.M. on November 13, 1973.
