AN ORDINANCE TO PROTECT THE PUBLIC HEALTH AND SAFETY BY
REQUIRING THE VACCINATION OF DOGS AGAINST RABIES; PROVIDING
FOR THE ISSUANCE OF A CERTIFICATE OF VACCINATION AND THE WEARING
OF A TAG BY ALL VACCINATED DOGS; PROVIDING FOR THE IMPOUNDING
OF UNVACCINATED DOGS AND THEIR DISPOSITION; TO PROVIDE FOR THE
CONFINEMENT OF DOGS WHICH HAVE BITTEN HUMAN BEINGS AND WHICH
HAVE BEEN EXPOSED TO RABID ANIMALS; PROVIDING FOR PENALTY FOR
VIOLATION OF THE PROVISIONS OF THE LAW, AND FOR OTHER PURPOSES,
AND PROVIDING FOR THE ENFORCEMENT OF THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OKEECHOBEI,
FLORIDA:
Section One: Terms Defined. Whenever used, unless a contrary
intention is clearly evident, the following terns shall be inter-
preted as herein defined: (a) the term "dog" shall mean and in-
clude all members of the canine family, three months or more of
age and also pet foxes, wolves, etc: (b) the term "owner" shall
mean and include any person having a right of property in the dog,
or who keeps or harbors a dog, or who has it in care, or acts as
its custodian or who permits a dog to remain on or about any
premises occupied or controlled by him; (c) the term "Vaccination
against Rabies" shall mean the injection of a canine anti - rabies
vaccine approved by the State Veterinarian and administered in
an amount and manner approved by the State Board of Health.
Section Two: Vaccination of Duo +s_ Requited: Prior tol - t�''
first of each year, every owner of a dog shall cause such doi to
be vaccinated against rabies by a licensed veterinarian or other
properly qualified persons; vaccination fee to be in the sum of
4, i5-0 . Evidence of vaccination shall consist of a certif-
icate signed by the person administering the vaccine and contain-
ing pertinent data for identification of the dog. One copy of
the certificate shall be given to the owner, one filed with the
City Clerk and one retained by the person administering the vaccine.
Section Three: Doge to Wear TA AA. Coincident with the
issuance of the cart ificare oof inoc ation as prescribed in the
preceding section, the person administering the vaccine shall issue
a metal serially numbered tag to be attached to the collar or
harness of the dog and which m ust be worn at all times. The
certificate and tag whose shape shall be changed each year shall
be furnished by the City to those designated as qualified to admin-
t rabj.e vaccine to dogs under this Ordinance at a cost of cow
) each, No other certificates or tag shall be valid
under the provisions of this Ordinance. All certificates and tags
voided or unused must be accounted for to the City Impounding
Officer. A fee not to exceed .6 "c) r 4- shall be charged
for the issuance of duplicate tag when the original has been lost.
Funds accruing to the City from the sale of certificates and tags
shall be used to enforce the purposes and intent of this Ordinance.
Section Four: Penalties. On and after '- first of
each year the owner 1776Toraag found running a la ge and not
wearing evidence of vaccination and for which no approved certif-
icate of vaccination can be produced shall be subject to a penalty
of not more than twenty five dollars ($25.00) in addition to the
fee prescribed for vaccinations.
Section Five: Impounding of Unlicensed Doggs. (a) It
shall be the day of-the munici ality to provide a suitable
enclosure for the impounding of all dogs found running at
large in violation of the provisions of this Ordinance. When
dogs are impounded by law enforcement agencies the animal
shall be held for at least seven days during which the owner,
if known, shall be notified if possible.
Section Six: Disposal of Doge Prescribed. (all dogs
which have been impounded for failure to be vaccinated under
the provisions of this Ordinance, due notice of which shall
have been given to the owner, if known, shall be disposed of
or humanely dispatched when not redeemed within seven days,
Impounded dogs can be redeemed by a humane society or my other
reputable person providing the owner fails to redeem the
animal. Any humane society sties l have the privilege of dim.
patching unredeemed dogs if it so elects. Impounded dogs can
be redeemed by the pqr sent of the vaccination fee, . board,
in the sum of # 1 .=--- per day during the period of which
impounded, and a penalty of two dollars and fifty cents ( #2.50).
Section Seven: Confinement of Bitten or Suspected Rabid
Dogs Prescribed. The owner of any dog"'g, -Iie ier vaccinated not,
which has been bitten by another animal or which exhibits
symptoms suggestive of rabies and the veterinarian attending such
dog shall immediately notify the State Public Health Officer
or his representative. Said dog shall be confined under suitable
observation for a period of sixty days or until officially re-
leased by the State Board of Health.
Section Eight: Confinement of Dogs Which Have Bitten Other
Animals or Human !sings, Authorial,
Veterinarians, physicians, dog owners,, or any other person
having knowledge that any animals or persons have been bitten
by a dog suspected of having rabies shall report same immediately
to the State Health Officer or his duly authorized representative.
The said dog or other animal shall be confined in suitable and
adequate quarters for a period of fourteen (14) days to maintain
quarantine, or until the State Board of Health authorises release.
Any expense incurred in handling the dog during this period shell
be borne by the owner.
Section Nine: Nothing in this Ordinance shall tbe held to
limit in any manner the power of any municipality to prohibit
dogs from running at large, whether or not they have been
vaccinated as herein provided; nor shall anything in this Ordin-
ance be construed to, in any manner, limit the power of any
municipality to institute additional control measures and
regulations in stch municipality.
Section Ten: Nothing in this Ordinance shall be held to
limit the authority, duties and responsibilities of the President
of the State Board of Health, the State Health Officer, and
their duly authorised agents as defined in Section 381417,
Florida Statutes, 1941, or other statutes relating to the
control of communicable disease.
Section Eleven: This Ordinance is hereby declared to
be an emergency ordinance necessary for immediate protection
of the health and welfare of the citizens of Okeechobee City
and/or County.
