Also Director Fortner stated the comtractor needed to know how to finish the door. The Council agreed that the contractor finish door according to contract and other adjustment s would be made in regards to the above. The Council authorized Attorney Curren to prepare Resolution for consideration by the Council regarding maintenamce of secondary roads in city. M. with the following present: Mayor Audley Dunham, President Donald L. Burk, Councilmen: Cliff Betts, Jr., Russell V. Domer, Edward W. Douglas amd E. H. Hunt with Clerk Lorena Spivey and Director of Public Works L. C. Fortmer, Jr. Preliminary works was done on 1973-74 General Budget and Water and Sewer Budget. The Clerk presented Employee Performance Evaluations on employees in Clerk's office and recommended salary Adjustment for year 1973-74. Discussion was heard on evaluation of legal services and salary for Attorney Ourren. Upon motion the Council adjourned. PRESIDENT CITY ATTEST: ' CITY CLERK September 11, 1973 The City Council o£ the City of Okeechobee, Florida met in regular session at 7:00 P. M. on the above date at the City Hall with the following present: Mayor Audley Dmuham, President Donald L. Burk, Councilmen: Cliff Botts, Jr., Russell V. Domer and E. H. Hunt with Attorney J. Edward Curren,i City Clerk Lorena Spivey, Deputy Clerk Saudra M. Bennett, Director of Public Works L. C. Fortner, Jr, Fire Chief Olen Godwin and Building Official Richard B. Spray. President Burk opened the meeting with prayer. Fred Judge, representative of Chamber of Cowe~erce was present submitting a copy of the Economic Survey made for other Florida county stating/Chamber of Commerce thought it would be a very good way to advertize business and capabilities of Okeechobee and requested a letter from City to Florida Department of Cosmerce Division of Commercial Development, requesting that a similar survey and booklet be made of Okeechobee City and furnished free of charge, for distribution by C~eechobee Chamber of Commerce. Also requested a $600.00 donation to the Chamber of Commerce for Christmas Decorations. Stating the county and cham~er of commerce had designated $600.00 each for this purpose. Councilman Domer moved to authorize the Clerk to write letter requesting the economic survey of City of Okeechobee be made and free from all cost, seconded by Councilman Betts and carried. President Burk advised that the requested donation would be taken into consideration and they would be notified of City, s action. Ralph Diggs, Superintendent of Board of Public Instruction was present regarding required school sewer treatment plant test, stating plants had to be inspected twice a month and only qualified available person to run said test is city sewer plant operator, requesting the Council to consider letting this man run test for schools so that they will be in compliance with regulations. It was pointed out the State requires chemical test, suspended solid test to determine effeciency of test and that the test were not lenghty and probably would require no more than six hours per month on both school plants. After discussion Councilman Domer moved to authorize Sewer Plant Operator to take test for period of one month and keep account of time and expense involved and then Council will talk with School ~ystem after that time, seconded by Councilman Betts and carried. Pursuant to notice of sale of $400,000 City of Okeechobee, Florida Water and Sewer Revenue Bonds published in The Okeechobee News, this being the date and time specified in said advertisement to open and consider all bids submitted for said bonds. The bid of the United States of America, United States Department of Agriculture, Farmers Homo Administration, in the amount, of $400,000.00 bearing interest at the rate of.five per centum (5%) per annum was the only bid received ~ for said bonds and therefore the highest and best bid received. President Donald L. Burk introduced a Resolution entitled: Resolution Awarding $400,000 Water and Sewer Revenue Bonds of the City of Okeechobee, Florida, and Designating the Place of Payment for said Bonds. Said Resolution was then read in full and discussed and Considered. Councilman Hunt then moved the adoption of the Resolution as introduced and read. Councilman Betts seconded the motion, and , on roll call, the following voted "Aye": Donald L. Burk, E. H. Hunt, Russell V. Domer and Clif Betts; and the following voted "Nay": None. RESOLUTION AWARDIN~ $~O,000 WATER AND SE~ REV~ BO~DS OF THE CITY OF OXEECHOBE~, FLORIDA, A~D DESI~ATING THE PLACE OF PArFaiT FOR SAID B~DS. WHEREAS, the City of Okeechobee, Florida, hereinafter sometimes called the "Issuer", has heretofore advertised for bids for the purchase of its $400,000 Water and Sewer Revenue Bonds; and W~, the Issuer's Council met on the date and at the time specified in said advertisement to open and consider all bids submitted for said bonds; and WHEREAS, the bid of the United States of America, ~ited States Depart- ment of Agriculture, Farmers Home Administration, in the amount and bearing interest as hereimafter stated, is the only bid received for said bonds and, therefore, the ~ghest and best bid received; NOW, T~EREFO~, BE IT RESOLVED, by the Council of the City of Okeechobee, Florida, as follows: SECTION 1. Said Water and Sewer Revenue Bonds be and the sa~ are hereby awarded to the United States of America, United States Department of Awriculture, Farmers Home Administration at the bid of $~O,000, bear- ina interest at the rate of five per centum (5%) per annum. Burk PRESID~ OF CITY COUNCIL ATTEST= Lorena ' Attorney Curren reported the Bond Counsel is ill and formal bond closing scheduled for tonight had been rescheduled within the next two weeks. Daniel Dele2all was present reporting the need of a water line extension to his new home in area north of Douglas Park Subdivision, stating that he had been advised by City that it would cost $245.50 for material and labor to make installation and requested the Council' s consideration and reimbursement of part of fee if someone else tapped on line. Hr. Delle~all asked, if he paid for the exte~-~ion who would it belong to? He was advised that the line would be a part of the city system. Councilman Hunt suggested that he ~o ahead and pay the bill and later on if something can be done make an adjustment rhea. President Burk requested the Water Board to survey situation and report to the Council. Councilman Domer reported that he had had a n~_,_mber of complaints regarding situations of this nature and felt the City should inititate some kind of system governing it. Attorney Curren advised that if the City set up system, no adjustments could be made for extensions made in the past. Mayor Dunham reported the Humane Officer was settled in new tra~ler and needed telephone, also a telephone was needed for new Policeman James E. CroslFn. The Council authorized Mayor Dunham to take care of this detail. Director Fortner presented Water, Sewer and Street Department Report for the m~nths of July and August. Memorandum No. 1 - Stock items needed for Water Plant in the amount of $847.20. Councilman Hunt moved to approve Memorandum No. 1 and authorize the purchase of items as listed and in the amount as stated above, seconded by Councilman Betts and carried. Memorandum No. 2 - Air Compressor for City Barn at a cost of $675.00. After discussion Councilman Betts moved to approve Memorandum No. 2 and authorize the purchase of air compressor in the amount of $675.00, seconded by Councilman Domer and carried. Director Fortner reported that he had notified fifteen Churches of the offer ~o re-do city church direc~r~ sign at a cost of $35.00 for each sign and had only had response from nine of the churches in favor of of this offer. Five no response and one had no change of address. President Burk suggested that this matter be taken up in workshop meeting at future date. Mayor Dunham also advised the Council of signs in park across from church directory sign needed to be removed. Matter referred to workshop meeting. The Fire Departmeat report for month of August was presented by Chief Godwin. The need of uniforms for Humane Officer was discussed. The Council agreed that Mayor Dunham and Chief Staats meet with uniform company representative and work up a proposal. Chief Staats adviaed that he had received a letter of resignation from Radio Dispatcher Richard Black effective as of October 1, 1973 and reco~ended that the resignation be accepted. Councilman Domer moved upon recom~mendation of Chief Staats to accept the resignation of Radio Dis- patcher Richard Black effective October 1, 1973, seconded by Councilman Betts and carried. Estimate No. 7 was received from Big Four Construction Company in the amount of $19,§§8.21 ~ater Improvements at Water Plant for work accomplished on Contract/was presented for payment by BrOCkway, Owen and Anderson Engineers, Inc. Councilman Hunt moved to approve Estimate No. 7 in the above amount and authorize payment upon approval from Farmers Home Administration, seconded by Councilman Domer and carried. Request for Payment No. 11 from Brockway, Owen and Anderson Engineers, Inc. in the amount of $338.89 for engineering services on Waterworks Improvement Program was presented for payment. Councilman Hunt moved to approve Payment Request No. 11 in the above amount and authorize payment upon approval from Farmers Home Administration, seconded by Councilman Betts and carried. G. E. Bryant, Jr., Cecil Newman and Robert Matthews were present in regards to obtaining access to property that Newman and Matthews was interested in purchasing from Bryant, and being unable to determine from the map the street right of way at this point being on the city limit boundary line the Council agreed to employ Leon Wills, Surveyor and establish ownership of right of i way. Director Fortner requested to contact Mr. Willis regarding this survey. The City Clerk submitted her resignation due to the recent Attorney General Opinion regarding Retirement of Municipal Elected Officials Section 165.25 Florida State Statutes. Council- man Domer moved with great regret to accept the resignation of City Clerk Lorena Spivey effective September 28, 1973, seconded by Councilman Hunt and carried. Attorney Curren read Resolution prepared as requested by the Council at September 4th meeting regarding maintenance of secondary roads in city. Council held Resolution for consideration. The City Clerk requested two weeks extra pay for vacation she had not had the opportunity to take this year and compemsation for fifty-one hours overtime accumlated during year. Councilman Hunt moved to grant request, seconded by Councilman Domer and carried. Councilman Domer moved to transfer $5,000 from Cigarette Tax Fund to Water and Sewer Revenue Fund and authorize the exchange of $15,000 City of Okeechobee Water and Sewer Depreciation Fund Certificate of Deposit for a $20,000 Certificate of Deposit with the First Federal Savings and Loan Association of Okeechobee in order to take advantage of the higher interest rate, seconded by Councilman Betts and carried. Minutes of the meeting held July 10, 1973 were read and upon motion by Councilman Hunt, seconded by Councilman Domer and carried minutes were approved as read. Edward Ourren, City Clerk Lorena Spivey and Director of Public Works L. C. Fortner, Jr. Preliminary Budget work on 1973-74 General and Water and Sewer Budget. Attorney Curren recow~emded that Council allocate in the 1973-74 General Fund ~udget $1,320.00 for utilities at city buildings and $1,620.00 for utilities at county sw~ng pool, a total of $2,940.00 to be in compliance with 1958 Water and Sewer Ordinance. Attorney Curren also recommended that the UtiLity Tax be transferred from Water and Sewer Budget to the General Fund Budget. Attorney Curren discussed 1973-74 salary and offered a compromise of $9,600.00. President Burk requested the ~ouncil to make individual evaluation of proposal. Councilman Domer moved to approve $900.00 bill from Attorney J. Edward Ourren for August Legal Services, seconded by Councilman Betts and unanimously carried. J.
