AN ORDINANCE CLOSING, DISCONTINUING AND VACATING
THAT PART OF OKEECHOBEE AVENUE LYING BETWEEN THE
SOUTH BOUNDARY OF SOUTH PARK STREET AND THE NORTH
BOUNDARY OF SEVENTH STREET AND LYING WEST OF BLOCK
164, ALL ACCORDING TO THE PLAT OF OKEECHOBEE AS
RECORDED IN PLAT BOOK 2, PAGE 17, PUBLIC RECORDS
OF ST. LUCIE COUNTY, FLORIDA.
Whereas, an application has been received requesting this
City Council to close, discontinue and vacate that part of
Okeechobee Avenue lying between the South boundary of South
Park Street and the North boundary of Seventh Street and lying
West of Block 164, all according to the Plat of Okeechobee as
recorded in Plat Book 2, page 17, public records of St. Lucie
County, Florida, and
Whereas, Notice of public hearing to consider closing,
discontinuing and vacating the above described Street, was
published in the Okeechobee News, and
Whereas, said public hearing was held according to said
Notice, and
Whereas, this Council has received affidavits of H. H.
Raulerson, J. M. Roams Sr., Z. K. Williams, and T. W. Conely, Jr.
being former Mayor, Councilman, and City Attorney respectively
between the years 1941 and 1945, stating that the above described
Street was closed by the City Council between the years 1941
and 1945, and
Whereas, there appears to be no record of said action,
and
Whereas, it is deemed to the best interest of the City of
Okeechobee to grant said application,
NOW, THEREFORE, Be It Ordained by the City Council of the
City of Okeechobee, Florida:
Section 1. That that part of Okeechobee Avenue lying
between the South boundary of South Park Street and the North
boundary of Seventh Street and lying West of Block 164, all
according to the Plat of Okeechobee as recorded in Plat Book 2,
page 17, public records of St. Lucie County, Florida, be and
it is hereby closed, discontinued and vacated provided
however that said land be used as a canning factory or in
connection with a canning factory located adjacent to said
street, and further provided that W. Allen Markham and Roscoe
L. Markham enter into an agreement with the City of Okeechobee
that in the event said land ceases to be used as a canning
factory or in connection with a canning factory located adjacent
to said street, then and in that event the said W. Allen
Markham and Roscoe L. Markham will convey all of said street
to the City of Okeechobee without cost or further consideration
from the City.
