of this authority was contained in the Home Rule Law, which becomes effective
October 1, 1973.
The Attorney General has recently ruled that an elected official's re-
tirement under this pro,ram may be Jeopardized if other retirement procrams
are available. A~v elected city official who has completed twenty years of
service and was planning retire_._me~nt under Section 185.25, Florida Statutes,
may be affected by this ruling which has indicated that retirement must occur
prior to October 1, 1973.
Affected officials should immedialtel~ contact the League office for copies
of this opinion. Clerk Spivey advised that she had contacted the League for this opinion.
Preliminary work on 1973-74 General Budget was accom~lished.
Councilman Domer discussed needed items for ~olice department. Recommending the
following items and appr~riation in budget~ $2,500.00 police car, $650.00 car radio, $995.00 Radar
equipment (Council recommended purchase of equipment instead of rental) and $~00.00 Walkie.Talkie.
The following base salary schedule was recon~ended for the police department by Councll~ Domer.
Chief Staats was requested to evaluate each employee. 3 - Patrolman ~2 · $7~300, 1 - Sergeant $7,600,
1 - Lieutenant · $8,100, 1 - Chief ~ $9,800 plus incentive pay for each qu-~4fied policeman, Jailer
$4,368, Radio Dispatchers: 2 - ~1 ~lspatchers ~,300, 2 - ~2 Dispatchers · $6,600. $6,000 starting
salary and $25.00 a month increase at end of six months probation period or $6,300 starting salary

The Oouncil authorized a letter to W. C. Sherman, Tax Assessor, requesting valuation assess-
ments for 1973 tax roll.
Attorney Curren reported on information received from Attorney General's office regarding
~retirement of 01erk Spivey, stating the Clerk must resign prior to October 1, 1973 to be eligible to
draw the retirement as set out in Florida State Statutes 165.25.
Attorney 0urren read Ordinance relating to Occu~atio~ License imposed by Chapter 12 of
~the Code of Ordinances of the City of Okeechobee, Florida, as a__-~nded by Ordinance No. 363 of the City;
Repealing Section 7 of Ordinance No. 363 to abolish the expiration date: Providing an effective date.

SECTI~ 1. That Section 7 of Ordinance No. 363 of the Code of Ordinances of the
City of Okeechobee, Florida, enacted on September 29, 1972, is hereby repealed upon
authority of Cha~ter 73-14~, Laws of Florida, 1973.
SECTION 2. This Ordinance shall be effective i~ediately upon its passage by
the City Council.

Director Fortner discussed salary for Palmer C. Lamb who was injured on Job. Attorney
Ourren advised the city was not allowed to compensate for diference between workmen' s compensation
and present city salary. The Council agreed to abide by Attorney Curren' s opinion.
The Clerk asvised a notice had been published in the Okeechobee News designating meeting
dates for the month of September as follows:
NOTICE
The City Council of the City of Okeechobee, Florida will meet in Budget Session at
6:30 P. M. on the following dates: September 4 and September 18, 1973
and will consider the budget for fiscal year beginning October 1, and ending September
30, 1974.
The regular meeting of the City Council is on September llth at 7:00 P. M. and at 6:30
P. M. September 25, 1973 an adjourned meeting will be held.

Director Fortner reported that Sav-on UtiLity Company that had received the bid on July 10,
1973 for check valves and hydrants, hydrant valves being of a larger size than specifications
called for but due to the shorter deliver time the Council accepted bid providing the price was the
same, had advised that an error had been made in price of larger hydrant valve and a cost of $20.00
each would have to be added to bid price. After discussion Councilman Hunt moved to reject conditional
bid from Sav-on UtiLity Compar~ due to the above stated reason and accept original low bid being from
Riverview Utility Supply, Riverview, Florida in the amount of $4,738.58, seconded by Councilman
Betts and unanimously carried.
Director Fortner discussed back-hoe operator and sign maker position being open due to the
resignation of Douglas Reed and recommended to advance Melvin Lamb to that position. The Council
was in accord with recon~endation. Also reported the meter-reader had resigned and recommended
advancing Henry Haven to said position and salary. Recommendation satisfactory to Council.
Attorney Curren discussed mounting duties requiring more time to do city business and
requested the Council to issue guidelines as to what legal services they expected him to do. The
Council requested Attorney Curren to prepare a legal evaluation of what he will do and required salary.
Mayor Dunham reported that a local organization was looking for a location to move the
"Old School House" to, renovate and develop into a historical muesum.
Preliminary work was done on 1973-74 General Budget.
Up-grading the salary structure, setting up classes and grades was discussed. Director

Fortner presented recommended salary adjustments for Water and/Departments.
The Council authorized the appropriation of one-half of present Clerk's salary in 1973-74
budget for retirem2nt purposes.

The City Council of the City of Okeechobee, Florida met in recessed session also pursuant
to notice published in the Okeechobee News, at 6:30 P. M. on the above date at the City Hall with the
following present: President Donald L. Burk, Councilmen: Clif Betts, Russell V. Domer, Edward W.
Douglas and E. H. Nmnt with Attorney J. Edward Curren, Clerk Lorena ~ivey, Director of Public Works
L. C. Fortner, Jr. and Fire Chief Olen God, in.
A letter dated August 31, 1973 was read from David B. Smith, Assistant Vice President of
Sverdrup & Parcel and Associates, Inc., consulting engineers of Okeechobee Beach Water Association,
stating that he had talked to Mr. Mc Cormick of the Farmers Nome Administration and Mr. Pearoe, Pres~..
ident of the Okeechobee Beach Water Association advising that Mc Cormick had urged that the Association
request a workshop session with the City Council at an early date in order to explore the present and
future status of a firm water supply for the Okeechobee Beach Water Association. Therefore, the
Association had asked him to make a formal request for a workshop session of the Association,
representatives of the Farmers Nome Administration and City with Engineers from both parties. President
~urk ordered the letter filed, waiting a request for workshop session from the Council or Farmers
Home Administration.
Clerk Spivey reported that Athleon Alderman, Okeechobee County Tax Collector had advised of
a computer mistake in over payment of 1972 city tax in the total amount of $2,088.85. General Fund
$1,472.50 - Debt Service $616.35. Councilman Hunt moved that the Clerk be authorized to make the
repayment in the amounts as stated above, seconded by Councilman Betts and unanimously carried.
Certification of millage and taxable value of property for the year 1973 was received from
Tax Assessor, W. C. Sherman.
Fire Chief Godwin presented a list of needed ~re Department equipment. After discussion
and consideration, Councilman Betts moved to approve the list of i~ems as presented in the amount of
$2,267.70 and authorize the purchase of same, seconded by Councilman Domer and unanimously carried.
