AN ORDINANCE ESTABLISHING STANDARDS OF CONSTRUCTION
FOR PRIVATE DRIVEWAYS UPON OR ACROSS PUBLIC PROPERTY;
PROVIDING FOR PERMITS AND FEES THEREFORE; ESTABLISHING
JURISDICTION UNDER THE DIRECTOR OF PUBLIC WORKS;
ESTABLISHING MINIMUM REQUIREMENTS; AND PROVIDING FOR
FUTURE MAINTENANCE BY THE PERSONS CONSTRUCTING OR
USING THE SAME AS ADJUNCT OR APPURTENANT TO LANDS OR
PROPERTIES IMMEDIATELY ADJACENT THERETO.
BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE
CITY OF OKEECHOBEE, FLORIDA:
Section 1. No person, firm or corporation shall hereafter
construct, build, establish or maintain any driveway over, across
or upon any portion of the public sidewalk or public parkway,
including public drainage ditches, without first having obtained
a written permit to do so from the Director of Public Works.
No such permit shall be issued for construction or establishment
of any such driveway except in accordance with the provisions
herein contained.
Application for permit must be made in writing upon forms
furnished by the city. Said application shall contain the name
and address of the person, firm, or corporation making the
application, the name of the contractor or person who is to
construct said driveway and the proposed location and dimensions
of such driveway.
Section 2. Fees. Before any work is started, the contracto
shall pay to the city, permit and inspection fees as follows:
(a) For all new driveway construction the fee shall be five
dollars.
(b) For all resurface work of an existing driveway, the
fee shall be two dollars.
(c) For all ordinary maintenance of an existing driveway,
the fee shall be one dollar.
Section 3. All such work shall be done under the juris-
diction of the director of public works and in accordance with
this ordinance and with other ordinances of the city; and shall
be inspected upon completion by the constituted member of the
Department of public works.
Section 4. All plans and specifications must conform to
the following minimum requirements before permit for construction
or reconstruction shall be permitted:
(a) All Driveways shall be constructed in a manner and of
such materials and of such thickness as determined by the
Director of Public Works.
(b) No part of any driveway shall interfer with or obstruct
the free flow of water in gutters and drainage ditches.
(c) Where driveways cross open ditches in the parkways,
culverts shall be installed. Said culverts shall be of such
size and shall be contructed of such material as determined by
the Director of Public Works, depending on the conditions existing
In no instance shall the size of opening be less than that obtain-
ed by a twelve -inch diameter pipe. The length of culvert shall be
determined by the following method: For ditch depth of two feet
or less the culvert shall extend not less than four feet beyond
both edges of the driveway where it crosses the ditch. For each
additional foot depth of ditch add two feet to the above figure,
except that no culvert shall be less than twenty feet long and
except that where headwalls are constructed at the ends of the
culvert the length shall be as determined by the Director of
Public Works.
Section 5. All driveways constructed or reconstructed
over, across or upon any public street or public parkway in the
city shall be kept and maintained at all times in accordance
with the provisions hereof by the persons so constructing, recon-
structing or using the same as an adjunct or appurtenance to lands
or properties immediately adjacent thereto.
Section 6. No Certificate of Occupancy shall be issued
until this ordinance has been fully complied with.
Section 7. Any person who shall violate any of the
provisions of this ordinance or fail to comply with any of its
requirements, or who shall build or alter any driveway or
culvert contrary to the intent herein expressed and approved,
shall, upon conviction thereof, be fined not more than five
hundred dollars, and each day such violation continues shall
constitute a separate offense. The owner of any building or
premises or part or area adjacent thereof where any violation
of this chapter shall occur, and any architect, builder, con-
tractor, agent, person or corporation employed in connection with
such violation who shall be found guilty of participating therein
shall be guilty of a separate offense, and suffer the penalties
herein provided.
