AN ORDINANCE AMENDING ORDINANCE NO. 339, BEING
AN ORDINANCE DEFINING AND REGULATING THE BUSINESS
OF BUILDING CONSTRUCTION AND CONTRACTING IN THE
CITY OF OKEECHOBEE, FLORIDA; AS AMENDED BY
ORDINANCE NO. 342, WHICH REDEFINES "CONTRACTOR ";
BY AMENDING SECTION 8 OF ORDINANCE NO. 339 AS
AMENDED, TO PROVIDE FOR ANNUAL RENEWAL OF
CERTIFICATES OF COMPETENCY, ANNUAL RENEWAL FEES
THEREFOR, AND PROVIDING FOR INACTIVE CERTIFICATES.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE
CITY OF OKEECHOBEE, FLORIDA:
That Section 8 of Ordinance No. 339 as amended of
the Code of Ordinances, City of Okeechobee, Florida, is hereby
amended to read as follows:
SECTION 8. Certificate of Competency; issuance;
duration; denial; reapplication; appeal.
(1) If, upon the examination and investigation, the Board,
in the exercise of its reasonable discretion, shall ascertain
and determine that the applicant is a fit, proper and qualified
person to engage in the bt$siness of contracting or subcontracting,
as the case may be, within the city, the Board shall cause its
certificate of competency to be issued to the applicant, other-
wise, the applicant shall be denied and refused. Such certi-
ficate of competency shall specify the type or types of
contracting work which the registrant is qualified to perform
in the city, and shall show upon the face thereof that they,
and the licenses issued pursuant thereto, are subject to
revocation or suspension.
(2) Each certificate of competency shall be renewable
annually unless revoked or under suspension. Each contractor
shall renew his certificate during December of each year
beginning December 1972, and shall be renewed prior to January
1st. Any certificate not renewed shall be considered expired.
When a certificate has been revoked or has expired
or lapsed for any reason, the Board may require a complete
reexamination before a certificate of competency is renewed
or re- installed.
Annual Renewal Fees for all contractors, electrical
contractors, plumbing contractors and specialty contractors:
Active: $25.00 Inactive: $5.00
Any certificate of competency may be issued as an
inactive certificate when the applicant currently certified
desires to retain his certified status, but does not intend
to engage in the condstruetion industry, in any catagory, in
the City of Okeechobee during any succeeeding entire annual
period, and so states in writing. Any inactive certificate
may be re- activated during any year by payment of the full
difference for an annual renewal for that year, without
proration. When a certificate has been in inactive status
for over three years, it shall be reactivated only upon
approval by theBoard, which may require re- application and
re- examination.
(3) If any application shall be denied and refused, the
applicant may renew his or its application at the expiration
of six months from the date it was denied or refused provided,
however, the Board for good cause shown may shorten such
period. Should any applicant be denied a license the applicant
may, within fifteen days from notice of such denial, appeal
the denial to the City Council who shall consider the appeal
and either affirm the action of the Board or order the
issuance of a license.
