AN ORDINANCE TO REGULATE THE PRODUCTION, TRANSPORTATION,
PROCESSING, HANDLING, SAMPLING, EXAMINATION, GRADING,
LABELING AND SALE OF MILK, MILK PRODUCTS AND INDUSTRY TRADE
PRODUCTS; THE INSPECTION OF DAIRY HERDS, DAIRIES, MILK PLANTS
AND INDUSTRY TRADE PRODUCTS PLANTS; THE ISSUING AND REVOCATION
OF PERMITS TO MILK PRODUCERS, HAULERS AND DISTRIBUTORS; THE
FIXING OF PENALTIES;, AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF
OKEECHOBEE, FLORIDA.
SECTION 1. DEFINITION - HEALTH OFFICER The health officer is
the health authority for the City of Okeechobee, Florida, and
shall be duly appointed health officer of Okeechobee County,
Florida, or his authorized representative.
SECTION 2. AUTHORIZATION The production, processing, transport-
ation, handling, sampling, examination, grading, labeling and
sale of all milk and milk products and industry trade products
sold for untimate consumption within the City of Okeechobee,
Florida, or its police jurisdiction; the inspection of dairy
herds, dairies, milk plants, and industry trade products plants;
the issuing and revocation of permits to milk producers, haulers,
milk plants, industry trade products plants, and distributors;
and the fixing of penalties, shall be regulated in accordance
with provisions contained in Chapter 502, Florida Statutes, as
revised in 1967 by the Florida State Legislature and amended in
1971; and the latest edition of the Federal Food and Drug
Administration, United States Public Health Service recommended
Grade "A" Pasteurized Milk Ordinance, copies of which shall be
in the Okeechobee County Health Department.
SECTION 3. ENFORCEMENT The health officer shall determine by
inspection, or other means satisfactory to himself that pro-
visions of the above designated law and ordinance are being
complied with before issuance of a permit. When any producer,
milk distributor, or industry trade products distributor fails
to qualify with above provisions, the health officer is
authorized to suspend his permit and /or institute court action
in accordance with provisions of applicable state law. If,
after a reasonable time, correction of conditions which resulted
in suspension of permit have not been corrected, the health
officer is authorized to revoke his permit to sell products
affected in the City of Okeechobee, Florida, or its police
jurisdiction.
SECTION 4. PENALTIES Any person, firrq or distributor who sells
offers for sale, or has in his possession with intent to sell
any of the above products who does not possess a valid permit
issued by the health officer shall be in violation of this
ordinance and shall be fined not more than two hundred dollars
($200.00), at the discretion of the court. Each day of operatio
without such valid permit shall constitute a separate offense.
SECTION 5. REPEALER All ordinances and parts of ordinances in
conflict with this ordinance are hereby repealed; and this
ordinance shall be in full force and effect immediately upon
its adoption and publication, as provided by law.
SECTION 6. EFFECTIVE DATE This ordinance shall be in full
force and effect upon its passage by the City Council and
approval by the Mayor of the City of Okeechobee.
