0371 (City Pension Plan)ORDINANCE NUMBER 371 AN ORDINANCE AMENDING ORDINANCE NUMBER 352 WHICH ESTABLISHED A PENSION AND RETIREMENT SYSTEM FOR EMPLOYEES OF THE CITY OF OKEECHOBEE, FLORIDA; BY ADDING SUBSECTIONS TO SECTION 2 THEREOF TO PROVIDE FOR AN ADDITIONAL ELECTION PERIOD FOR ELIGIBLE EMPLOYEES; REQUIRING PARTICIPATION BY ALL EMPLOYEES BECOMING ELIGIBLE ON JANUARY 1, 1975 AND THEREAFTER: AND MAKING PARTICI- PATION IN THE PENSION AND RETIREMENT SY- STEM A CONDITION OF EMPLOYMENT. BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA: SECTION 1. That Ordinance Number 352 of the Code of Ordinances, City of Okeechobee, Florida, which established a Pension and Retirement System for employees of the City, is hereby amended by adding three subsections to Section 2 thereof, to be numbered 2(a), 2(b) and 2(c), which said subsections read as follows: 2(a) - Any eligible employees who did not elect to become included in the City of Okeechobee Pension Plan on January 1, 1972, or any anniversary date thereafter, are granted one additional opportunity to join the retirement system so long as they elect to do so prior to June 30, 1974. Any eligible employee failing to do so shall be forever barred from participation in such plan. 2(b) - All employees who shall become eligible to be included in the retirement system on January 1, 1975, and all subsequent anniversary dates, shall become participants in the plan without election to do so, and will commence contribution into the Pension and Retirement System. It is the intention hereby that from and after the date of this Ordinance all municipal employees, except those previously excluded by non - election, shall be participants in the Pension and Retirement System. 2(c) - Participation in the Pension and Retirement System is hereby declared to be a condition of employment for all municipal employees. SECTION 2. All ordinances or parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. SECTION 3. This ordinance shall take effect immediately upon its passage by the City Council and its approval by the Mayor. SECTION 4. This Ordinance was proposed, considered, and adopted under the provisions of Section 166.041(3)(b) Florida Statutes, and was enacted by no less than a two -third vote of the City Council.
