0374 (House Trailers)ORDINANCE NUMBER 374 AN ORDINANCE AMENDING ORDINANCE NO. 294 (CHAPTER 19) OF THE CODE OF ORDINANCES OF THE CITY OF OKEECHOBEE, FLORIDA, WHICH PROHIBITS HOUSE TRAILERS WITHIN THE CITY EXCEPT AS SET FORTH THEREIN, TO ADD A NEW SECTION 5 (SECTION 19 -4 of CHAPTER 19) TO ENABLE THE CITY COUNCIL UPON PROPER APPLICATION TO PERMIT GOVERNMENTAL UNITS TO LOCATE HOUSE TRAILERS (OR OTHER MOBILE HOUSING UNITS) ON GOVERNMENTAL PROPERTY FOR TEMPORARY GOVERNMENTAL PURPOSES, BY RESOLUTION SETTING FORTH THE TIME LIMIT, USE PERMITTED AND OTHER CONDITIONS. BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA: SECTION 1. That Ordinance Number 294 and Chapter 19 of the Code of Ordinances of the City of Okeechobee, Florida, which prohibits House Trailers within the City except as set forth therein, is hereby amended by adding a new section thereto, to be numbered Section 5 of Ordinance Number 294, and Section 19 -4 of Chapter 19 of the Code of Ordinances, which said new section shall read as follows: Sec. 19-4. Same -- Governmental Use. Upon application to the City Council by a unit of Federal, State or Local government, or any agency or entity thereof, citing that a temporary emergency or critical situation exists, or that a temporary need exists based upon economic or practical considerations, necessitating the use of one or more house trailers (or other mobile housing units by whatever name) as portable offices, portable classrooms, temporary emergency facilities, temporary emergency housing in case of natural disaster, or other temporary governmental applications, the City Council may permit such use by Resolution. Such temporary uses shall be limited to governmental real property sites, except in the case of temporary emergency housing in case of natural disaster. SuchResolution shall set forth the length of time such temporary use shall be permitted, and other conditions and limitations as may be warranted under the circumstances. SECTION 2. This Ordinance shall take effect immediately upon its passage by the City Council and its approval by the Mayor. SECTION 3. This Ordinance was proposed, considered, and adopted under the provisions of Section 166.041 (3) (b) Florida Statutes, and was enacted by no less than a two -third vote of the entire City Council.
