AN ORDINANCE AMENDING ORDINANCE NO. 376, WHICH GRANTED
TO FLORIDA POWER & LIGHT COMPANY, ITS SUCCESSORS AND
ASSIGNS, AN ELECTRIC FRANCHISES, AND IMPOSING PROVISIONS
AND CONDITIONS RELATING THERETO, BY AMENDING SECTION 6
THEREOF TO PROVIDE TAX REVENUES FROM INDUSTRIAL CUSTOMERS
WITHIN THE CORPORATE LIMITS OF THE CITY OF OKEECHOBEE.
WHEREAS, Section 6 of Ordinance Number 376 provides:
"Section 6. That no later than sixty days after the
first anniversary date of this grant and no later
than sixty days after each succeeding anniversary
date of this grant, the Grantee, its successors and
assigns, shall have paid to the Grantor and its
successors an amount which added to the amount of all
taxes as assessed, levied, or imposed (without regard
to any discount for early payment or any interest or
penalty for late payment), licenses, and other im-
positions levied or imposed by the Grantor upon the
Grantee's electric property, business, or operations,
and those of Grantee's electric subsidiaries for the
preceding tax year, will equal 6% of Grantee's revenues
from the sale of electrical energy to residential and
commercial customers within the coporate limits of
the Grantor for the twelve fiscal months preceding the
applicable anniversary date."

WHEREAS, the City of Okeechobee, Florida is desirous of amending
said Section 6 of Ordinance No. 376 to include revenues from Industrial
customers within the corporate limits of Grantor in the measure of the
annual payment to be made by Grantee to Grantor.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
OKEECHOBEE, FLORIDA:
Section 1. That Section 6 of Ordinance No. 376 is amended to
provide as follows:
"Section 6. That no later than sixty days after the first

Section 2. That this Ordinance shall take effect upon acceptance
by Grantee within ninety (90) days after it is passed and adopted at
the third and final reading.

SECTION 3. This Ordinance was proposed, considered, and adopted
under the provisions of Section 166.041 (3) (b) Florida Statutes,
and was enacted by no less than a two -third vote of the entire City
Council.
PASSED AND ADOPTED THE 11th DAY OF MAY , 1976, at a
Regular Meeting of the City Council.

by title only will be placed on third and final reading at the
Regular Meeting of the City Council of the City of Okeechobee,
Florida, to be held on May 11, 1976, at 7:00 P. M., at the City
Hall, or as soon thereafter as such Ordinance may be read and
considered for passage.
