0394 (Fire Control)ORDINANCE NO. 394 AN ORDINANCE SETTING FORTH RULES AND REGULATIONS TO IMPROVE PUBLIC SAFETY BY PROMOTING THE CONTROL OF FIRE HAZARDS, REGULATING THE INSTALLATION, USE AND MAINTENANCE OF EQUIPMENT; REGULATING THE USE OF ST- RUCTURES, PREMISES AND OPEN AREAS IN THE CITY OF OKEECHOBEE, FLORIDA, PROVIDING FOR THE ABATEMENT OF FIRE HAZARDS: ESTABLISHING THE RESPONSIBILITIES AND PROCEDURES FOR ENFORCEMENT: SETTING FORTH STANDARDS FOR COMPLIANCE; PROVIDING PENALTIES FOR THE VIOLATION THEREOF; AND REPEALING ALL ORDINANCES OR PARTS OF OR- DINANCES IN CONFLICT THEREWITH. WHEREAS, it is necessary, desirable and in the best interest of the City of Okeechobee, Florida, and its inhabitants that an Ordinance adopting the Standard Fire Prevention Code be adopted by the City Council of the City of Okeechobee, and, WHEREAS, this Ordinance is adopted pursuant to the provisions of Section 166.031 Florida Statutes, and other applicable provisions of law. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA: SECTION 1. ADOPTION OF STANDARD FIRE PREVENTION CODE. There is hereby adopted by the City of Okeechobee, Florida, for the purpose of prescribing regulations to improve public safety by promoting the control of fire hazards regulating the installation, use and main- tenance of equipment, regulating the use of structures, premises and open areas in the City, in the interest of the public health, safety, convenience and welfare, that certain code known as The Standard Fire Prevention Code, 1976 Edition, save and except such portions as are hereinafter deleted, modified or amended, of which code not less than three (3) copies have been and now are filed in the office of the City Clerk of the City of Okeechobee, and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this Ordinance shall take effect, the provisions there- of shall be controlling within the Municipal limits of the City of Okeechobee. SECTION 2. FIRE OFFICIAL. The Fire Chief of the City of Okee- chobee is hereby designated as the Fire Official. The Fire Official shall enforce the provisions of this Ordinance and all State Laws under his jurisdiction, pertaining to the prevention, suppression or extin- guishing of fires. The Fire Official has the powers of a police office in performing his duties under this Ordinance. SECTION 3. APPEALS. Any person whose application for any permit has been refused, or who feels aggravated by any decision or action of the Fire Official, may appeal to the Board of Adjustments and Appeals. SECTION 4. VALIDITY. Should any section, paragraph, sentence, or word of this Ordinance or of the Code hereby adopted be declared for any reason to be invalid, it is the intent of the City Council that it would have passed all other portions of this Ordinance independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 5. AUTHORITY. This Ordinance is adopted pursuant to the provisions of Section 166.031 Florida Statutes, and other ap- plicable provisions of law. SECTION 6. EFFECTIVE DATE. This Ordinance shall take effect upon its passage by the City Council and approval by the Mayor. PASSED AND ADOPTED THIS 7th day of December, 1976.
