0395 (Cable TV Franchise)ORDINANCE NO. 395 AN ORDINANCE AMENDING ORDINANCE NO. 357, OF THE CODE OF ORDINANCES, CITY OF OKEECHOBEE, FLORIDA, BEING EN- TITLED OKEAIRCO, INC., CABLE TELEVISION OF OKEECHOBEE FRANCHISE ORDINANCE, BY MODIFYING SECTION 12, DEALING WITH RATES TO CUSTOMERS. BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA: SECTION 1: AUTHORITY. This Ordinance is adopted pursuant to the provisions of Section 166.031 Florida Statutes, and other applicable provisions of law. SECTION 2: FINDING. Notice of public hearing to con- sider a requested rate increase by amending Section 12 of Ordinance No. 357 was published in the Okeechobee News, and said public hear- ing was held according to said notice, and it was deemed to be in the best interest of the City to amend Section 12 of Ordinance No. 357. SECTION 3: AMENDMENT. That Section 12 of Ordinance No. 357 be amended to provide as follows: SECTION 12: RATES TO CUSTOMERS. The Company shall have the right to charge and collect compensation from all persons and corporations who subscribe to Company's services, based upon the following schedule: (a) No installation fee before or during installation of the system. (b) $15.00 installation fee through the first year of oper- ation. (c) $25.00 installation fee may be charged for all installa- tions or hook -ups after the first year of operation. (d) Single family units - $85.25 per year for a one service outlet to be paid in advance. The customer may elect to pay the yearly fee at $7.75 per month, hence paying a total yearly fee of $93.00. The difference of $7.75 per year represents additional costs of bookkeeping and billing. In the event a single family unit or its equivalent desires more than one outlet, there shall be an additional annual charge of $27.00 per outlet per annum. (e) Apartments and other multi - family units rented to trans- ients or seasonal visitors shall, after the first standard service of $85.25 per year or $7.75 per month, be charged at the rate of $42.00 per year or $3.50 each month for each additional outlet of service. SECTION 4: EFFECTIVE DATE. This Ordinance shall be effective immediately upon its' final passage in accordance with the proceedure set forth in Section 166.041 Florida Statutes. It is common knowledge that substantial increases in the cost of living are affecting our lives on a daily basis. OkeAirCo, Inc. is feeling the impact of this increase as we proceed with the construction of the system. The operation of the system will be further adversely affected as will our ability to make a profit on the prospective revenues from the existing rate structure. We have had a number of conversations and compared notes with other cable TV operators in Florida and other parts of the County. These talks have confirmed our con- clusion that we must seek relief from these substantial pressures resulting from the cost increases during the four year period since the subscriber fees were set in the franchise. We are diligently pursuing the construction of the system and look forward to serving our first subscribers very early next year, if not sooner. We request that the installation fee, as noted in Section 12 -b, be changed from $9.95 to $15.00 and in Section 12 -c be changed from $20.00 to $25.00. Essentially the monthly rate for homes should be changed from $6.50 per month to $7.75 per month with the second outlet changed from $24.00 per outlet per year to $27.00 per outlet per year. The precise rates being requested are spelled out in the attached proposed revision to Section 12 in the franchise. All other paragraphs of Section 12 will remain the same. To assist you in your evaluation, we attach a list of specific areas where our costs have escalated substantially. In addition, we are listing a representa- tive group of cities in Florida showing the current subscriber rates. For your information, the same letter is being sent to the County of Okee- chobee to the attention of Mr. L. E. Herbert, Chairman of the Okeechobee County Commission. COST INCREASES The Department of Labor - Bureau of Statistics - shows a rise in the cost of living for moderate income families to be 30.3% in the last four years. Data we have compiled on our cost increases conform closely to this increase Salaries and Wages Material Costs Many products we utilize are made from petroleum based raw materials including cable and electronic components. Interest Costs Long term loans for real estate and capital equipment now carry a higher rate than at the time the system construction was planned.
