0047 (Street Paving)ORDINANCE NO. 7 AN ORDINANCE FOR THE PURPOSE OF PAVING, CURBING, GRADING, COMPLETE IN ALL ITS DETAILS, CERTAIN AVENUES, STREETS, OR PARTS THEREOF, IN THE CITY OF OKEECHOBEE, FLORIDA, AND PROVIDING FOR THE ISSUANCE OF BONDS FOR THE PAYMENT OF THE CITY'S PORTION THEREOF, AND THE CALLING OF A SPECIAL ELECTION FOR THE APPROVAL OR REJECTION OF THE ISSUANCE OF SAID BONDS BY THE ELECTORS OF THE -CITY OKEECHOBEE, FLORIDA. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF OK.E:CHOi3, FLORIDA, Sec. 1. The Mayor and City Council of the City of Okeechobee, Florida, subject to the provisions of law and this ordinance are hereby authorized to issue bonds of said city under the seal of the said . corporation in the amounts and for the, purpose of paving, curbing, grading, and completing in all its details certain avenues, streets, or parts thereof, and providing for the issuance of bonds for the payment of the city's portion thereof; the balance of the two - thirds of said improvement apon any avenue, street or streets, or 'parts thereof, when complete, to be ohargea against the abutting property on�c.,side of said avenues streets, or parts thereof; the city to pay the entire cost at the inter- section of all avenues or streets. Said bonds. to be signed byr the Mayor countersigned by the President of the City Council and attested by the Clerk of said City with the seal thereof affixed, with interest coupons attached, signed in like manner with the facsimile signatures thereof lithographed on said interest coupons. The amount of said bonds shall be $80,000.00 for the city's portion of said construction, upon such avenues, streets, or parts thereof, as may hereafter be desi mated by the City Sec. 2. The Mayor shall as soon as practicable after the passage,, and approval of this ordinance, issue his proclamation, calling a special election for the City of Okeechobee, Florida, to be held not less than thirty days from the date of said proclamation, for the purpose of sub - mitting to the electors of said City the approval or rejection of the -2- issuance of the bonds rovided for in Sec. 1 of this Ordinance. The Mayor in his- proclamation callyv for the election herein provided shall name three electors of the of Okeechobee who shall act as inspectors of said election and a clerk thereof. Should any of the inspectors or clerk so appointed fail or refuse to qualify the Mayor is authorized at any time prior to the opening of the polls to nam additional inspectors or clerk. The insPpeector conducting election aforesaid shall immediately after the polls have closed count the votes for and against the proposed bond isaue and immediately certify the result of the same to the City Council. Sec. 5. At the election to be held as provided in this Ordinance only resident electors other s 0aualj.fi d der the laws of Florida, being those who own real estate n sa T unand who hive paid their taxes last due thereon, and actually voting; at said election, shall We entitled to vote. Sec. 6. The bonds issued under the provisions of this Ordinance shall be in denominations of 4500.00 each, bearing interest payable semi- annually at the rate of six per cent. per annum, both principal and interest payable at the Bank of Okeechobee, Okeechobee, Florida, or at the American 2iga. New York Oity, New York, at the op on of .-'t se-!"i i` Said bonds are to be dated April 1st, A.D. 1920; interest payable on the first day of October and April of each and every year after date of i suarice until maturity of said bonds. Principal of said bonds shall 0 payable as follows: 8,000.00 on the first day of April, A.D. 1940 and 8,000.00 on the first day of April of each and every year thereafter up to and including the first day of April, A.D. 1949. Said bonds to be 'numbered consecutively from 1 to 160 inclusive. Sec. 7. Should the issuance of said bonds be authorized by the r�- quired vote then saia bonds shall be issued without delay and the City Council shall before such issuance provide by ordinance.., for the redemption -3- of said bonds at maturity and f r the payments of the interest upon the same by a tax levy of a sufficidsnt mileage as may be neces6ary for such purpose. Sec. 8. If the result of said election provided for in this Ordi- nance be against the issuance of the bonds then this Ordinance shall ue null and void. Sec. 9. This Ordinance shall take effect immediately upon its pas6age and approval.
