0043 (Use of Stove Pipe Flue)0RiIANCE NO AN ORDINANCE TO PROHIBIT THE USE OF AN ORDINARY COMMON STOVE PIPE FLUE WITiiIN SIXTY FEET OF ANY OTHER BUILDING OR DWELLING, AND TO DEFINE THE MATERIAL WHICH MAY BE USED WITHIN THE LIMITS OF THE CITY OF OKEECH OBEE, FLORIDA; ALSO TO PROVIDE THE MANNER OF INSPECTION THEREOF, AND PROVIDE A PENALTY FOR VIOLATION TREREOP. BE IT ORDAINED BY Tf E CITY COUNCIL OF CIE CITY OF OK.EECHOBEE, FLORIDA: Section 1. That it shall be unlawful for any person to use in any house or dwelling, within sixty feet of any other house or dwelling, and using therein a stove; what is commonly known as a common stove pipe flue, above the ceiling upwards, loess but every flue used, shall be constructed of stone pipe, brick, or other fireproof ahimOney from the ceiling upwards. Section 2. That it shall be the duty of the City Marshal to inspect frequently all flues within the City, and if he should find any flue erected in violation of this Ordinance, it shall be his duty to notify the owner or occupant of the said premises to remedy the same within twenty -four hours; and lUtion failure to do so, such owner or occupant shall upon conviction be fined, imotWoormi as herein after provided. Section 3. If from the evidence the court shall find that the Clue is dangerous to the conmunity,he shall order the same to be altered, or rebuilt at the cost of the owner. Section 4. Any person or persons violating any of the pro- visions of this ordinance shall upon conviction be fined not more than *50 or be imprisoned in the city jail not more than twenty days, or both, in the discretion of the court.
