0017 (Sidewalk Construction)ORDINANCE .NO. 17 AN ORDINANCE REQUIRING THE CONSTRUCTION OF SIDEWALKS AND CURBS ON THE NORTH SIDE OF SEVENTH STREET BETWEEN OSCEOLA STREET AND IUIE RIGHT OF WAY OF THE FLORIDA EAST COAST RAILWAY COMPANY'S TRACKS, AND ON �E WEST SIDE OF OSCEOLA STREET BETWSEN SOUTH PARK ST7fEET AND SEVENTH STREET, PRESCRIBING THEIR MATERIAL, WIDTH AND THI4Kiiii=. TIME TO BE BUILT AND REMEDIES FOR NON.COMPLIANCE. BE IT ORDAINED BY TEE MAYOR AND CITY COUNCIL OF Faa CITY OF OKEE- CHOBEE, FLORIDA: SECTION 1. The owners of land abutting upon the North side of Seventh Street between Osceola Street and the right of way of the Florida East Coast Railway Company's tracks, and on the West side of Osceola Street between South Park Street and Seventh Street shall and they are hereby required to construct sidewalks and curbs along the line of their said properties abutting upon said streets of the width and thickness hereinafter set forth. Said Sidewalks shall be six feet wide end at least four inches thick, constructed of good Portland cement, the mortar in the lower part of sidewilk to be a one part cement to four *rte sand. Said sidewalks shall be mous constructed so as to drain toward the curb. The said curb shall be six inches wide and the top level with the sidewalk and shall be constructed of good portland cement in proportions of one part cement to four parts mum sand. Said curb shall be reinforced at all corners with iron rods. The inner edge of said curb shall be located eighteen inches from the outside ofmix said sidewalks and curbs shall be 4 constructed at such exact place and grade as may be designated by the City Engineer. SECTION 2. The above designated sidewalks and curbs shall be com- pleted within sixty days after the passage and approval of this ordinance and in default thereof, sidewalks and curbs as herein provided shall be constructed by the City of Okeechobee, and the cost thereof, with all expenses of collection and a reasonable attorney fee, shall be a lien against the real estate abutting on sidewalks and curbs so constructed by the City, which lien shall be enforced in the manner provided by law. SECTION 3. Contracts shall be let by the city Council for the construction of all sidewalks and curbs required by this ordinance where the same have not been constructed by owners mak= Within the time herein limited, and the cost of constructing said sidewalks and curbs shall be a lien as heretofore provided. SECTION 4. SECTION 5. The Whole anount of said bills may be paid in cash without interest if paid within thirty days after mailing by said Clerk; or at the option of payee, said bill may be paid in instalaments as follows: One third in cash within thirty days after title date of mail ins of bill, a nd balance in two equal annual inaments payable one and two years after date of bill, with interest after date at eight per cent per annum, to be evidenced by promisory notes payable to the City of Okeechobee, to be dell vered to the Ci(t7 Clerk at time of payment of cash installment. If the whole arriunt of bill, is not paid as herein provided, it shall be the duty of t6e City Clerk to certify to the Mayor, together with a copy of the bill and a description of the real estate against w hich it is a lien and thereupon the Mayor shall proceed to have said lien enforced for the collection of said indebtedness in the manner provided by law. SECTION 6. It shall be the duty of the 'ity Clerk to file WI th the Clerk of the Circuit Court, of Saint Lucie County, Florida, notIces of the liens claimed by the City under the provisions of this ordinance. SECTION 7. The Mayor is hereby authorized to bid at the sale of a, n7 real estate for the enforcement of such lien or liens in the qrnount of the jndgment Or decree and costs, and if said property is sold to the Citys. the 1ayor is authorized to sell and make cveyance thereof to any purchaser Who will pay the mount which s aid real netatep has abet the City, and the proceeds of such s ale or sales or of all collections l!nder this ordinance shall be turned over to -the City ,TreaStty to be applied to the proper fund. SECTION 8. All ordinances, or parts of ordinances, in conflict herewith are hereby rep ealed. SECTION 9. Thie ordinance shall go into effect immediately upon its passage and approval by the Mayor.
