AN ORDINANCE REQUIRING THE CONSTRUCTION OF SIDEWALKS AND CURBS ON `IHE
SOUTH SIDE OF SOUTH PARK STREET BETWEEN THE ONNOITATCKEE RIVER AND THE
RIGHT OF WAY OF THE FLORIDA EAST COAST RAILWAY COMPANY'S TRACKS, PRE-.
SCRIBING THEIR MATERIAL, WIDTH AND TIICKNESS, TIME TD BE BUILT AND
REMEDIES FOR NON ■COMPLIANCE.
BE IT ORDAINED BY TIE MAYOR AND CITY COUNCIL OF THE CITY OF OKEECHOBEE
FLORIDA:
SECTION 1. The owners of land abutting upon the South side of South
Park Street between the Onnohatchs• River and the right of way of the
Florida East Coast Railway Company's tracks shall and they are hereby
required to construct sidewalks and curbs along the line of their said
properties abutting upon said street of the width and thickness herein-
after set forth. Said sidewalks shall b • six feet wide and least four
inches thick, constructed of good Portland cement`, the mctar in the
top dressing to be one half inch tick to be in proportion of one part
sand to ono part cement, and the mortar in the lower part of said side-
walk to be of one part cement to four parts sand. Said sidewalks shall
be constructed so as to amain t owards the our The said curb shall by
six inches wide and the top level with sidwwalk and shall be constructed
of good portland anent in proportions of one part cement to four parts
sand. Said curb shall b e reinforced a t all corners with iron rods.
The inner edge of a aid curb shall b e located eighteen inches from
the outside of said sidewalk and curb shall be constructed at such
exact plies and grade as may be designated b* the City Engineer.
SECTI ON 2. The above designated sidewalks and curbs shall be completed
within sixty days after the passage and approval of this ordinance,
and in default thereof, sidewalks and curbs as herein provided shall
be constructed by the City of Okeechobee and the cost thereof, with
all expenses of celleotion and a reasonable attorney fee, shall be a
lien against the real estate abutting on sidewalks and curbs so constructed
bythe City, which lien shall be enforced in the manner provided by law.
SECTION S. Contracts shall be let by the City Council at for the construc-
tion of all sidewalks and curbs required by this ordinance ah ere the
same have not been constructed by owners within the time herein limited,
and the coat of constructing said sidewalks and curbs shall be a UMW
as heretoDore provided.
SECTION 4. Bills for said sidewalks and curbs shall be made out by
the City Clerk and sent by United States mail toe soh owner of r sal
estate on which same is a lien, to the last known address of such
owner, and if the address is unknown, such bill shall be mailed to
him 'with Okeechobee, Florida, as the address.
SECTION 5. The t ole amount of said bill may be paid in cash without
intereet if paid within thirty days after mailing by said Clerk; or
at the option of payee, said bill may be paid in * installments as
follows: One third in cash within thirty days after the date of
mailing of bill, and balance in two equal annual installments payable
one and two years after dilate of bill, with interest after date at
eight per cent per annum, to be evidenced by promisory nofe payable to
the City of Okeechobee, to be delivered to the City Clerk at time of
payment of cash installment, If the *olio amount of bill is not paid
as herein provided, or if default is made in payment of any installments,
as above provided, it shall be the duty of the City Clerk to certify such
fact to the Mayor together with a copy of the bill and a description of
the real estate against which it is a lien, and thereupon the Mayor
shall proceed to have said lien enforced for the collection of said
indebtnesa in the manner provided by law.
SECTION 6. It shall be the duty of the City Clerk to file with the
Clerk of the Circuit Court of St. Lucie County, Florida, notices of till
liens claimed by the City under the provisions of this ordinance.
SECTION 7. The Mayor is hereby authorized to bid at the s ale of any
real estate for the enforcement of such lien or liens the amount of the
judgement or decree a nd c oats, and if said property is sD ld to the City,
the Mayor is authorised to s ell and make conveyance thereof to any
purchaser who will pay the amount whichsaid real estate has coat the
City, and the proceeds of such sale or sales or of all collections
under this ordinance shall be turned over to the City Treasurer to be
applied to the proper fund.
SECTION 8. All ordinances, or parts or ordinances, in conflict here-
with are hereby r epealed.
SECTION 9. This ordinance shall go into effect immediately upon its
passage and approval by the Mayor.
