0010 (Establishing Mayor's Court)ORD INANCE NO. AN ORDINANCE PRESCRIBING THE JURISDICITION AND PROCEDURE OF THE MAYOR'S COURT, AND PROVIDING FOR THE WORKING OF PERSONS CONVICTED IN THE MAYOR'S COURT, AND FOR CT HER PURPOSES. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF 'T?E CITY OF OKEECHOBEE FLORIDA: SEC. 1, The Mayor shall be the Judge of the Mayor's court, ands aid court shall have jurisdiction for the trial of all violations of City Ordinances. The ¢chief of Police shall be the executive officer of said court. Z..za, 2. Upon affidavit made before the Mayor or Clerk ahaz+gin - person, firm or corporation with the violation of any City Ordinance, the Mayor or City Clerk shall issue a warranting the Chief of Police or any Policeman to arrest the accused and bring him before the Mayor's court of for trial. The affidavit and warrant shall set forth briefly the nature of the charge. The person accused shall have compulsory process for obtaining witnesses; shall hate a speedy trial before the Mayor; shall be confronted with the witnesses against him; and shall have the privilege of defending himself either personally or by counsel; the Mayor may summons witnesses both on behalf of the City and for the accused, The Mayor shall swear all witnesses and hear their testimony; and shall find the defendant guilty or not guilty upon such testimony. If the defendant is found not guilty he shall forthwith be discharged. If the defendant is found guilty the Mayor shall impose the sentence provided by ordinance. It shall be the duty of the Chief of Police to enforce all sentences pronounced by the Mayor. All cases in the Mayor's Court shall be tried without a jury. SEC, 3, The Mayor may punish for contempt any person who refuses or neglects to appear before the Mayor's court when summoned as a witness, or may punish for contempt any person guilty of disorderly conduct or behavior during a sitting of the Mayor's Court. Such punishment shall not exceed ra fine of X50.00 or imprisonment for not exceeding twenty days. SEC. 4. After any person isconvicted in the Mayor's court the Mayor shall have the power at any time to suspend the further execution of said sentence or may pardon and release and discharge said defendant. SEC, 5. That all able- bodied prisoners who shall be confined in the City ,jail under sentence may be required to perform, under the direction of the Chief of Police, a reasonable labor upon the streets, parks, alleys and sidewalks or other property belonging to said City; and it shall be the duty of the Chief of Police to provide suitable guards for such prisoners. SEC. 6, The City Council may by motion or resolution d1rct upon what work such prisoners shall be employed and shall fix the compOggensation of the guards and prtbvids for the feeding of such prisoners, 37:C. 7, The Chief of police shall have authority to prbvide the neces- sary means for the preventing of the escape of any and all prisoners so employed under this ordinance, by placing a shackle or legidron on the legs of such prisoners; Provided, that nothing shall be used upon such prisoners to prevent their escape which will endanger their lives or that will cause any physical injury to such prisoners, but such means shall be used only as will prevent .soap. SEC. 8. This Ordinance shall go into effect upon its passage by the Council and approval by the Mayor. APPROVED JULY 22, 1915 0 /
