0006 (Misconduct in Office)XX ORDINANCE NO. 6. AN ORDINANCE PROVIDING FOR THE SUSPENSION AND REMOVAL OF CERTAIN CITY OFFICERS FOR MISCONDUCT IN OFFICE AND NEGLECT OF DUTY, AND FOR THF, FILLING OF VACANCIES CAUSE) BY SUCH REMOVAL. BE IT ORDAINED BY ENE MAYOR AND CITY COUNCIL OF THE CITY OF OKE - CHOBEE, FLORIDA: SECTION 1. The Mayor shall have the power to suspend any officer of the City, except Councilmen, for misconduct to office or for neglect of duty and to appoint a substitute during suspension, and shall report his action in writing, with the reasons therefor, to the next regular meeting of the City Council for its approval or disapproval. SECTION 2. The officer so suspended shall he furnished with a copy of the charges against him, and notified by the Mayor to appear at the regular meeting of the Council next after his suspension. If he shall so appear, he shall be gi1Tan the opportunity by himself or through his counsel to answer the charges against him. SECTION 3. The Council shall consider the matter, whether the suspended officer be paimaidft present or not, if it appears that he was duly notified, or the Council :nay, in their discretion, adjourn the matter from time to tide. SECTION 4. If the Council approves the action of the Mayor in suspending such officer, it way, by vote of a majority of all the members of the council, permanently remove such officer and declare his office vacant. SECTION 5, The Mayor shall apoint some qualified person to fill such vacancy, to hold office until the next regular election, except that the City Council shall appoint some qualified person to fill any vacancy in the office of the Chief of Police or in the City Council. CTION 6. This ordinance shall go into effect, upon its passage and approval by the Mayor. Approved July 22, 1915.
