1974-P2 (Declaring Special Refrendum Election)i PROCLAMATION NOTICE OF SPECIAL REFERENDUM ELECTION CITY OF OKEECHOBEE, FLORIDA OCTOBER 8, 1974 WHEREAS, under and by virtue of the provisions of the Charter of the City of Okeechobee, Florida, it is the duty of the Mayor to proclaim and call Special Elections at the time and in the manner provided by said Charter and General Law; and WHEREAS, the City Council of the City of Okeechobee, Florida, duly passed Ordinance Number 372 proposing amendment to the Charter of. the City of Okeechobee, Florida, to provide .for an appointive City Clerk, and directed that the said Ordinance Number 372 be submitted to the electors of the City of Okeechobee, Florida, at a Special Referendum Election to be held on October 8, 1974; NOW, THEREFORE, I, AUDLEY DUNHAM, Mayor of the City of Okeechobee, Florida, do hereby give notice that a Special Referendum Election by the duly qualified electors of the City of Okeechobee, Florida, will be held at the City Hall Fire Station in said city, on Tuesday, October 8, 1974, during the regular hours of voting, to -wit: from 7:00 o'clock A.M. until 7:00 o'clock P.M., for the ratification or rejection of Ordinance Number 372 proposing amendment of the Charter of the City of Okeechobee, Florida; viz: ORDINANCE NUMBER 372 AN ORDINANCE AMENDING SECTION 32 OF THE CHARTER LAWS OF THE CITY OF OKEECHOBEE, FLORIDA, TO PROVIDE THAT THE CITY CLERK SHALL BE APPOINTED BY THE CITY COUrCII� A_1\TD__'StTT'TMG FORTH THE DUTIES OF SUCH APPOINTED CITY CLERK: TO FURTHER PROVIDE THAT THE AMENDMENT OF THE CHARTER AS SET FORTH HEREIN BE SUBMITTED TO THE ELECTORS OF THE CITY OF OKEECHOBEE AT A SPECIAL ELECTION CALLED FOR SUCH PURPOSE. BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA: SECTION 1. AUTHORITY. This Ordinance is adopted pursuant to the provisions of Section 166.031 Florida Statutes, and other applicable provisions of law. SECTION 2. FINDING. It is necessary, desirable and in the best interests of the City of Okeechobee, Florida, and its inhabitants that the Charter of the City of Okeechobee be amended to abolish the elective office of City Clerk and provide that the City Clerk be appointed by the City Council. SECTION 3. PROCEDURE. The City Council of the City of Okeechobee, by adoption of this Ordinance, submits to the electors of said municipality the proposed amendment to its Charter; and such proposed amendment shall be submitted to a vote of the electors at a special election called for such purpose prior to November, 1974. SECTION 4. AMENDMENT. That Section 32 of the Charter Laws of the City of Okeechobee, Florida, which provides for an elective City Clerk and sets forth the duties of such clerk, is thereby amended in its entirety to read as follows: SECTION 32. CITY CLERK; DEPUTIES; DUTIES. (1) CITY CLERK. There shall be a City Clerk, who shall be appointed by the City Council. The City Clerk shall furnish such bond as required by law or ordinance. (2) DEPUTY CLERK. A Deputy Clerk, or Deputy Clerks, may from time to time be appointed, and when appointed shall have the same powers and authority as the City Clerk, Such Deputy Clerks shall work under the direction and supervision) of the City Clerk. (3) DUTIES. The City Clerk shall perform the following duties: (a) Attend all meetings of the City Council and keep minutes of its proceedings, the correctness of which proceedings shall be certified to by his signiture and by the sytgnature of the presiding officer of the City Council of such meeting; and the official minutes of the City Council, when duly signed by the Clerk and the presiding officer of such meeting shall be prima facie evidence of the facts and happenings stated therein. He shall furnish certified copies of the minutes as required. (b) Administer any oath required by law or the ordinances of the city. (c) Be the official custodian of the seal of the city and of all records and papers of an official character pertaining to the affairs of the municipality; and whenever an official seal is required on any official document of the City of Okeechobee, same shall be affixed by the City Clerk or Deputy Clerk. (d) Sign all ordinances and resolutions and record in full in books kept for said purposes all ordinances and resolutions; and furnish certified copies as required. (e) Perform any other duties required of the City Clerk by Charter or Ordinance, and any duties delegated to the Clerk or applicable and proper to be performed by a City Clerk. SECTION 5. EFFECTIVE DATE. This Ordinance shall take effect immediately upon its Final Passage in accordance with the 1procedures set forth in Section 166.041, Florida Statutes. SECTION 6. SPECIAL ELECTION.
