The Council entered into Budget discussion on Director of Public Works Salary, Overtime, Councilmen Salary and Christmas Bonus. ADJOURNMENT There being no further business, the meeting adjourned. Dome~ President City Council City of 0keechobee ATTEST: S~via-~[~is tia[ Acting City Clerk City of Okeechobee SECOND REGULAR MEETING TUESDAY~ AUGUST 22~ 1978 The City Council of the City of 0keechobee, Florida, convened in Regular Session in the Council Chambers at the City Hall, 0keechobee, Florida, at 7:00 P.M., Tuesday, August 22, 1978. President Russell V. Domer presiding. Councilmen Lavon Bass, Edward W. Douglas, Jim Knight and Lytle Raulerson were present. Others present were: Audley Dunham, Mayor; David Conlon, City Attorney; L. C. Fortner, Jr., Director of Public Works; Larry Mobley, Chief of Police; E. H. Reutebuch, Assistant Fire Chief; Sylvia Christian, Acting City Clerk and Lola Parker, Deputy Clerk. The Invocation was offered by Councilman Jim Knight. SUPERVISOR OF ELECTIONS Ms. Rowena Parkerson appeared before the Council for discussion on the City adopting the F~orida Election Code, to conduct the City's Elections. The City would follow all of the.~Florida Election Laws. A petition weuld be submitted signed by 25 qualified electors in the mun- icipality and may upon official approval by the governing authority under the charter adopt the State Election Laws for conductJam~ municipal elections. 2316 The Council authorized Attorney Conlon to research the matter and report back for a decision. POLICE DEPARTMENT 1. EMPLOY)4~NT APPLICATION - POLICE Chief Mobley submitted an employment application on Lee Duncan with starting salary at $9,200 per year. Councilman Bass moved to employ Lee Duncan in the Police Department starting salary at $9,200, seconded by Councilman Raulerson and vote carried. FIRE DEPARTMENT 1. ERROR IN SALARY INCREASE - FIRE Assistant Chief Reutebuch informed the Council that Watt Gragg should be getting $94 dollars more in his salary increase. Acting Clerk Christian to correct. 2. COMPLETION OF SCHOOL - FIRE Assistant Chief Reutebuch informed the Council that Firemen Robert Meats and Kenneth Brown will complete school on August 30, 1978, and will be eligible for a $500 dollar salary increase per year. Councilman Raulerson moved to grant $500 dollar salary increase per year for Meats and Brown when school is completed and passed, sec- onded by Councilman Bass and vote carried. PRODUCE STAND Mr. William Krattiger appeared before the Council with discussion on the produce stands on the side of Highway 70. He stated the City had required him to put up a permanent building. He does not feel that the produce stands should be allowed to park on the side of the Highway. Attorney Conlon stated that he was not aware the City had required him to set up a permanent building. Following a lengthy discussion Attorney Conlon stated that if a State Law is being borken then the City could do something. WATER~ SEWER AND STREET DEPARTMENTS 1. PERMITS FOR ROYALS 0KEECHOBEE PLAZA AND U-SAVE SHOPPING CENTER Director Fortner submitted permits for signatures From Department of Transportation and Department of Enviromental Regulations for Lift Station and Force Main to serve Royals 0keechobee Plaza and U-Save Shopping Center. Councilman Bass moved to authorize Director Fortner to sign Department of Env~romental Regulations Permit, seconded by Councilman Douglas and vote carried. 1 2317 Councilman Douglas moved to authorize Mayor Dunham ~o sign Depart- ment of Transportation Permit~ seconded by Councilman Bass and vote carried. 2. ADVERTISE FOR BIDS ON L~FT STATION AND FORCE MA~N TO SERVE COMMERC~AL AREA Director Fortner stated that the Engineer needs authorization to adv~rtis~ for bids on Lift Station 8nd Force Main to serve Commercial Area on South ~1. Councilman Douglas moved to authorize advertisement for bids on Lift Station and Force Main, seconded by Councilman Knight and vote carried. 5. STREET OPENING REQUEST Director Fortner stated he had investigated Irena ~illiams request to open South West llth Street between South West 5rd and ~th Avenues. He stated there are a few bushes to be removed and fill dirt hauled. Councilman Knight moved to authorize Director Fortn~r to take necessary steps to open South West llth Street between South West 5rd and ~th Avenues, seconded by Councilman Raulerson and vote carried. &. STREET SIGN REQUEST Director Fortner stated Police Chief Mobley had requested "No U Turn" Signs be placed at South West 5th Avenue and 6th Street on all four meridians. Two signs on each meridian from School Zone to intersection. Councilman Bass moved to authorize signs, seconded by Councilman Raulerson and vote carried. 5. NEW PROPOSED RESIDENTIAL DEVELOPMENT NORTHWEST AREA Director Fortner stated the Development starting in the North West Section of the City between Parrott Avenue and 7th Avenue, are ready for City to shell the Streets. He stated the City had requested some type of bonding for them to assure the City they will perform. There is nothing in the minutes stating what this should be and it needs to be clarified because they are ready to start construction, and the City can not do anything until this bond is presented to the City's sat- isfaction. ~ttorney Conlon stated the City had asked for a $50,000 dollar Bond. Director Fortner stated this was discussed with the Council and the price was set at $50,000 with 20 homes completed, but there is nothing in the records to support this. Attorney Conlon stated there is a question of bonding whether or not they were going to be required to put up a Bond. They do not want to post a $50,000 Bond, but the City 2318 wants an assurance that they will finish their project. Attorney Conlon questioned if there was any sign they had started this project. Director Fortner stated the Streets have been rough graded and the center lines of roads surveyed. Attorney Conlon to check with Banks to see what committment had been made for this project, and report at next meeting. Councilman Bass moved to authorize Attorney Conlon to investigate and report back at next meeting, seconded by Councilman Knight and vote carried. CITY CLERK 1. REZONING APPLICATION Acting Clerk Christian submitted a rezoning application from Julian Leggett, requesting the Council to advertise and rezone from RG-2 to Commercial, Beginning 100 feet South, 25 feet West of North East.corner of Government Lot 2, run South parallel to East boundary of Lot 2, 210 feet West 100 feet North 210 feet East 100 feet to Point of Beginning. Following discussion Councilman Douglas moved to instruct Acting Clerk Christian to proceed with notification to th~ owner and to advertise the public hearings, seconded by Councilman Bass and vote carried. 2. LICENSE APPLICATION TO PEDDLE Acting Clerk Christian submitted a license application from Esther Bass to peddle produce and fish from house to house. An approval from the Health Department was attached. Following discussion Councilman Knight moved to accept application from Esther Bass to peddle door to door, seconded by Councilman Bass and vote carried. 3. REQUEST FOR COPY OF AUDIT Acting Clerk Christian submitted a letter from William R. Hough & Company requesting an audit report. She also submitted a letter explaining the reason for %heir request. A copy will have to be zeroxed so a charge of 25¢ per page by Council consent. 4. CLEAN WINDOWS Acting Clerk Christian requested authorization to have the windows cleaned in the Clerk's Office and Mayor's Office at a cost of $50.40. Following discussion Councilman Douglas moved to authorize Acting Clerk Christian to have windows cleaned, seconded by Councilman Bass and vote carried. NO PARKING SIGNS Mayor Dunham informed the Council he had received several complaints about vehicles double parking on the side read next to Burger Queen. He felt a no parking sign should be put up in this area. Chief Mobley stated if no parking signs were put in the area the traffic would be 2319 forced out on 441, causing an even greater hazzard. SIGNS IN MEDIAN ON 441 Mayor Dunham stated the Chamber of Commerce and Rodeo authorities would be requesting to put a sign in the median of 441 for Labor Day Activities. The Department of Transportation request for no signs to be placed in the median. Council stated if Department of Transportation says no then the City will have to abide by their request. REQUEST .STH AVENUE AND 7TH STREET CLOSED Mayor Dunham informed he had received a request from the Road Runners Club to hold a foot race on Labor Day on 5th Avenue and 7th Street. President Domer suggested they use the air strip. Mayor Dunham to contact Lee Dixon and suggest the air strip for their race. ELECTRIC SIGN Councilman Knight stated the Coach at the High School wanted to put a marque on the Chamber of Commerce Side of 441. It could be seen fr~m the South and North direction. Councilman Knight to investigate. CETA PROGRAM Director Fortner informed that the Ceta Program will end September 30, 1978. He questioned i'f the City wishes to continue with the program. Director Fortner prefers to hire one emp&oyee for the City and not use Ceta Employees this year. Director Fortner stated a minimum of 5 Employees was needed. Director Fortner to check and see if one of the five could be a supervisor over the other four. If not then discontinue using Ceta Employees.
