Jim and Ruthi Pippin, with Marlene Burnes, GAL Volunteers, received the Guardian Ad Litem Month Proclamation presented by Mayor Kirk, and read into the record as follows: "Whereas, the City of Okeechobee prides itself on giving back to the community, contributing to the quality of life among our citizens; and Whereas, the Guardian Ad Litem Program speaks for the best interests of abused, abandoned and neglected children who are involved in the court system; and Whereas, more than 150 children in the community suffer from some form of abuse or neglect each year; and Whereas, Okeechobee community members are encouraged to join together, throughout the month of April to raise awareness for those children fallen victim to abuse, neglect and abandonment; and Whereas, this effort will give abused, neglected, and abandoned children in our community an improved chance for a safe permanent home and positive future. Council Member Watford requested to add a New Business Item, Mayor noted it as D. 2., Exhibit 6. Council Member O'Connor moved to adopt proposed Ordinance No. 1108; seconded by Council Member Williams. Mayor Kirk asked whether there were any comments or questions from the Public. There were none at this time. The floor was yielded to City Planning Consultant, Mr. Bill Brisson of LaRue Planning and Management Services, to review the materials and respond to questions and comments. He called attention to item two of his memorandum, contained in Exhibit One, which recommends the Council amend the ordinance to allow RH zoned properties with an existing agriculture exemption to have more than three goats, pigs or sheep, so long as the acreage requirement can be met per animal. There is one owner that would be affected negatively without this amendment. Council reiterated their concern to make sure the youth with 4H, FFA, or show animals would still be allowed within the City, as well as those owners who have an agriculture exemption or use their property for agriculture purposes. 206 AGENDA VIII. PUBLIC HEARING CONTINUED. A. 2. b) Public comments and discussion continued. c) Vote on motion. CLOSE PUBLIC HEARING - Mayor. IX. NEW BUSINESS. A. Consider a Temporary Street Closing Application to close Southwest 4th Avenue, between North and South Park Streets, from 11:30 a.m. to 1:30 p.m. on April 6, 2014 for a Motorcycle Run Event in recognition of National Crime Victims' Rights Week - Joan Johnson, Okeechobee County Sheriff's Office (Exhibit 2). B. Consider a recommendation by the Code Enforcement Board to proceed with foreclosure in Case No. 11 -072, Barbara Mills, 406 Northwest 5th Street, Lots 3 -4 of Block 105, City of Okeechobee - Attorney Cook. MARCH 18, 2014 - REGULAR MEETING - PAGE 5 OF 10 COUNCIL ACTION - DISCUSSION - VOTE Mr. Gary Carver of 1105 Southeast 9th Drive, addressed the Council by commenting he wanted to be sure his grandchildren were going to have the same opportunity as his children regarding raising their 4H projects on his 2 -acre unplatted parcel. The Council reassured Mr. Carver this would still be allowed. Administrator Whitehall cautioned that zoning, other than RH, will have a limitation of animals, as those properties would be regulated by Chapter 10 regarding Animals. He reminded the Council of the issues pointed out at the first reading, and proposed amendments to this chapter will be presented to them soon. Attorney Cook echoed and reaffirmed Mr. Whitehall's comments. VOTE KIRK - YEA WATFORD - YEA MAXWELL - YEA WILLIAMS - YEA O'CONNOR - YEA MOTION CARRIED. MAYOR KIRK CLOSED THE PUBLIC HEARING AT 6: 25 P.M. (Note for Clarification: upon the closing of the public hearing, Staff realized the Council had not considered the amendment to the ordinance. The issue was brought to Council's attention. After New Business item B, the Mayor re- opened the Public Hearing to reconsider the matter). Council Member Watford moved to approve a Temporary Street Closing Application to close Southwest 4th Avenue, between North and South Park Streets, from 11:30 a.m. to 1:30 p.m. on April 6, 2014 for a Motorcycle Run Event in recognition of National Crime Victims' Rights Week; seconded by Council Member O'Connor. Undersheriff Noel Stephen was in attendance to respond to questions or concerns. VOTE KIRK - YEA WATFORD - YEA MAXWELL - YEA WILLIAMS - YEA O'CONNOR - YEA MOTION CARRIED. On March 5 of last year the Council approved, as recommended by the Code Enforcement Board, Case No. 11 -072, for the City to take the necessary legal action to obtain an inspection warrant through the courts, in order to gain access to Lots 3 and 4 of Block 105, City of Okeechobee, (owner: Barbara Mills, 406 Northwest 5th Street) and bring it into compliance. The violations are cited for Code Section 30 -43 Public nuisance and Section 30 -44 General cleaning and beautification. The property has been in violation for the same reasons in 2001, 2003, and 2009. A fine of twenty -five dollars ($25.00) per day was imposed on December 8, 2011 (O.R. Book 709, Pages 18 -19, Okeechobee County Public Records). As of January 31, 2014, the fine has accumulated to nineteen thousand, six hundred fifty dollars ($19,650.00). 1 1 AGENDA IX. NEW BUSINESS CONTINUED. B. Consider a recommendation by the Code Enforcement Board to proceed with foreclosure in Case No. 11 -072, Barbara Mills, 406 Northwest 5th Street, Lots 3 -4 of Block 105, City of Okeechobee continued. VIII. RE -OPEN THE PUBLIC HEARING FOR ORDINANCE ADOPTION - Mayor. A. 2. c) Re- consider the action to adopt Ordinance No. 1108 - City Planner. Consider a motion to amend Ordinance No. 1108. MARCH 18, 2014 - REGULAR MEETING - PAGE 6 OF 10 207 COUNCIL ACTION - DISCUSSION - VOTE Attorney Cook explained the Code Enforcement Board discussed the case at their meeting held March 11, 2014, and recommended the Council consider proceeding with foreclosing on the property, since he had not been successful in obtaining the inspection warrant from County Judge, Jerry Bryant. Council Member Watford moved to proceed with the foreclosure proceedings for Code Enforcement Case No. 11 -072, property owner, Barbara Mills, located at 406 Northwest 5th Street, legal description being: Lots 3 and 4 of Block 105, City of Okeechobee subdivision as recorded in Plat Book 1, Page 10, Okeechobee County public records; seconded by Council Member O'Connor. Mayor Kirk and each Council Member commented individually at the dilemma the City was in by the owners refusal to cooperate in any manner. Mr. Richard Mills (property owners' son who lives out of state), neighbors, and friends of the family such as County Commissioner Ray Domer, have made attempts to intervene in the matter. The City's goal is to bring the property into compliance, and keep it in compliance. VOTE KIRK - YEA WATFORD - YEA MAXWELL - YEA WILLIAMS - YEA O'CONNOR - YEA MOTION CARRIED. It was called to the Council's attention that Ordinance No. 1108, previously address at this meeting, needed to be reconsidered as the amendment suggested by Planning Staff was not acted upon. MAYOR KIRK RE- OPENED THE PUBLIC HEARING AT 6:40 P.M. Council Member Watford made a motion to reconsider previous action, adoption of Ordinance No. 1108; seconded by Council Member O'Connor. KIRK - YEA WATFORD -YEA VOTE ON MOTION TO RECONSIDER (REQUIRES 2/3 MAJORITY) MAXWELL - YEA O'CONNOR - YEA WILLIAMS - YEA MOTION CARRIED To RECONSIDER. Planner Brisson explained, an amendment to add language to proposed Ordinance No. 1108, expanding the permitted uses list for the Rural Heritage Zoning, will allow owners who have more than three goats, pigs or sheep and a valid agriculture exemption on their property assessment, to continue using their property as they are now. Council Members Watford and Maxwell commented they were of the understanding that the amendment was already included in the ordinance. Clerk Gamiotea explained Staff cannot change the content of an ordinance once the first reading has been approved, only the Council, by motion to amend, can change the language. 208 MARCH 18, 2014 - REGULAR MEETING - PAGE 7 OF 10 AGENDA COUNCIL ACTION - DISCUSSION - VOTE VIII. Council Member Watford moved to amend Section 2 of Ordinance No. 1108 by adding paragraph number "(3)" to Section 90 -435, as presented (Planner Brisson's memorandum dated March 6, 2014, and reads: "Notwithstanding the limitations set forth in subsection (2), above, agricultural uses of a commercial nature on properties on which there is an active agricultural exemption granted by the Okeechobee Property Appraiser no later than September 19, 2013. "); seconded by Council Member Williams. Mayor Kirk asked Consider adopting Ordinance No. 1108, as amended. whether there were any questions or comments. There were none. Motion to approve an Agreement for Professional Engineering with Culpepper and Terpening, Inc, for the Taylor Creek Park Project - City Administrator (Exhibit 3). KIRK - YEA MAXWELL - YEA O'CONNOR - YEA WATFORD - YEA WILLIAMS - YEA MOTION CARRIED As AMENDED. MAYOR KIRK CLOSED THE PUBLIC HEARING AT 6:43 P.M. Council Member O'Connor moved to approve an Agreement (Project Authorization No. 2 to the Civil Engineering Services Agreement, approved September 17, 2013) for Professional Engineering with Culpepper and Terpening, Inc, for the Taylor Creek Park Improvements Project (No. 14 -024); seconded by Council Member Williams. The planning and funding of a recreational park on the City's 2 -acre unplatted parcel located at Southeast 7th Street and 6th Avenue has been broken down into six phases. The components of the park include temporary boat dockage, boardwalk, fishing /observation platform, canoe /kayak launch areas, "Chickee" picnic areas, a central pavilion, children's playground, open grass lawn areas, inter - connective walkways, restroom facility, landscape and lighting, parking and drainage improvements. The Council approved the conceptual plan on January 21, 2014. MARCH 18, 2014 - REGULAR MEETING - PAGE 8 OF 10 209 AGENDA COUNCIL ACTION - DISCUSSION - VOTE IX. NEW BUSINESS C. D. CONTINUED. Motion to approve an Agreement for Professional Engineering with Culpepper and Terpening, Inc, for the Taylor Creek Park Project continued. Motion to award a bid to Vest Concrete Inc, in the amount of $91,140.00 for the 2014 City Sidewalk Rehabilitation Project PW- 03- 00 -02 -14 - Public Works Director (Exhibit 4). The agreement begins with Phase Two, tasks, services, and a fee table, includes: Preliminary Design Services, three thousand, sixty dollars ($3,060.00); Design Survey, thirteen thousand, nine hundred five dollars ($13,905.00); Master Site Plan, six thousand, five hundred ninety dollars ($6,590.00); Grant Funding Assistance does not have a fee listed; and Reimbursable Expenses not to exceed five hundred dollars ($500.00). Total for Phase Two, not to exceed twenty - four thousand, fifty -five dollars ($24,055.00). Not included, and to be provided under subsequent Project Authorizations are Phase 3 -Final Design Services ; Phase 4- Bidding Services; Phase 5- Services During Construction; and Phase 6 -Post Construction Services. VOTE KIRK - YEA MAXWELL - YEA O'CONNOR - YEA WATFORD - YEA WILLIAMS - YEA MOTION CARRIED. Council Member O'Connor moved to award a bid to Vest Concrete, Inc., in the amount of ninety -one thousand, one hundred forty - dollars ($91,140.00). The motion was withdrawn, as requested by Administrator Whitehall in order for the motion to accurately reflect the unit price, rather than the overall price, as the project came in less than the estimated budget, this could allow the City latitude for adding or patching various areas. Council Member O'Connor moved to award Bid No. PW- 03- 00- 02 -14, (to the lowest bidder,) Vest Concrete, Inca (of Okeechobee), with a unit price of fifteen dollars and fifty cents ($15.50) per linear foot for the 2014 Sidewalk Rehabilitation Project; seconded by Council Member Williams. Bids were advertised on February 14. A mandatory pre -bid meeting was held on February 20, 2014, with the bid opening held on March 12. In addition to the one above, bids were received from Dickerson FL, Inc., unit price of $27.45, Close Construction, LLC, unit price of $30.00, and R. Mossell Construction, unit price of $19.84. A "no bid" reply was submitted by Carr Construction., LLC, and Williams Masonry, Inc. The scope of services lists the contractor to provide all labor, equipment and materials necessary for construction of approximately 5,880 liner feet of 5 -feet wide, 6 -inch concrete sidewalk. The project should take approximately 120 days, with an estimated completion date of July 31, 2014. The City will be providing inspections. In an effort to have the least impact on residents and businesses, the City will notify them prior to the start of the project, as well as the Post Office, and document the condition of existing mailboxes. Mailbox relocations will be done by the contractor, including replacement posts, should they be required. 210 AGENDA IX. NEW BUSINESS CONTINUED. D. Motion to award a bid to Vest Concrete Inc, in the amount of $91,140.00 for the 2014 City Sidewalk Rehabilitation Project PW- 03-00-02-14 continued. ITEM ADDED: D.2. Motion to appoint an Alternate Member to the Treasure Coast Regional League of Cities - Council Member Watford (Exhibit 6). MARCH 18, 2014 - REGULAR MEETING - PAGE 9 OF 10 COUNCIL ACTION - DISCUSSION - VOTE Driveways and property access will not be blocked for construction more than 24 -hours and will be maintained to the maximum extent possible. Director Allen provided samples of the 'door knockers' that will be distributed explaining the project, and lists all contact information for the Public Works Department and the Contractor. The Council expressed their appreciation for the pro- active steps Director Allen is taking to inform the residents /businesses who will be impacted by the project, and giving them correct information for complaints or issues. Maps illustrating the proposed sidewalk and existing sidewalks were distributed to the Council. The areas for the sidewalks to be constructed, consisting of 5,880 linear feet are: West side of Northwest 9th Avenue, from 6th to 8th Streets; North side of Southeast 7th Street, from 2nd to 6th Avenues; West side of Southeast 2nd Avenue, from existing sidewalk ending mid -way in the 500 block to 6th Avenue; East side of Southeast 2nd Avenue, from 6th to 7th Streets; West side of Southeast 4th Avenue, from 4th to 5th Streets; East side of Southeast 4th Avenue, from 5th to 7th Streets; West side of Southwest 2nd Avenue, from 10th to 15th Streets; North side of Southwest 9th Street from 3`d Avenue to existing sidewalk mid - block; South side of Southwest 9th Street, from 2nd Avenue to existing sidewalk mid - block; West side of Southwest 7th Avenue, from existing sidewalk to 15th Street. Mayor Kirk received the evaluations and calculated an average score of 4.85 out of 5.0. Mayor Kirk thanked Administrator Whitehall for the service he provides to the City. Administrator Whitehall thanked the Council for their confidence in him. The evaluations were forwarded to the City Clerk for final processing and retention. The positive review allows eligibility for the Salary Step Increase on his anniversary date June 1, 2014. The term of the existing contract expires May 31, 2014. As provided in Attorney Cook's employment services contract, each year the Mayor and Council Members complete an evaluation on his employment performance. Mayor Kirk received the evaluations and calculated an average score of 4.175 out of 5.0. Mayor Kirk thanked Attorney Cook for the service he provides to the City. The positive review allows for the contract to renew for another year. The contract provides basic payment shall be increased annually at the same percentage increase as general employee pay increases. During the Fiscal Year 2013 -14 budget adoption, the Council approved a one percent across the board cost of living (COLA) increase, therefore, Mr. Cook's annual compensation was increased the same, as of October 1, 2013. WHEREAS, the City Council for the City of Okeechobee, Florida adopted Ordinance No. 716, as amended, known as the Land Development Regulations, and codified within the Code of Ordinances as Part II, Subpart B to provide consistency for growth and development; and WHEREAS, the City of Okeechobee, Florida has a legitimate interest in periodic review of its ordinances and Land Development Regulations to address certain inconsistencies or outdated regulations contained in the Code of Ordinances; to make amendments to meet changing community standards, or to accommodate new development; to create new ordinances or regulations to better serve the public and to make the Code of Ordinances a more consistent and easier to understand document; and WHEREAS, the Planning Board, acting as the Local Planning Agency of the City of Okeechobee, Florida, recently reviewed the Code of Ordinances and Land Development Regulations to determine areas of improvement; discussing proposed amendments at duly advertised public workshops and meetings held on February 21, 2013, July 18, 2013, September 19, 2013, and October 17, 2013, and based on findings of fact by Planning Staff, hereby recommends certain changes, amendments or modification to the Code of Ordinances, to present to the City Council for ordinance adoption and codification; and WHEREAS, the City Council for the City of Okeechobee, Florida, has considered the recommendations and concludes that each of the proposed amendments is in the best interest of the City and its citizens; that said amendments are necessary and appropriate to make the Code of Ordinances more consistent and responsive to the needs of the City and its citizens. NOW, THEREFORE, be it ordained before the City Council of the City of Okeechobee, Language to be added is underlined Ordinance No. 1108 - Page 1 of 5 Florida; presented at a duly advertised public meeting; and passed by majority vote of the City Council; and properly executed by the Mayor or designee, as Chief Presiding Officer for the City; that: SECTION 1: That Section 66 -1 Definitions of Chapter 66 General Provisions of the City of Okeechobee, Florida, Code of Ordinances Part II, Subpart B Land Development Regulations, is hereby amended by adding the following definition which read as follows: Limited agriculture means commercial or noncommercial boarding, raising and grazing of horses and cattle; noncommercial raising or keeping of a maximum of three in total number of hogs, sheep, and goats; noncommercial plant and vegetable gardens; and cultivation of hay for use or sale. SECTION 2: That the City of Okeechobee, Florida, Code of Ordinances Part II, Subpart B Land Development Regulations, Chapter 90 Zoning, Article III Districts and District Regulations, is hereby amended by adding a Division entitled Rural Heritage (RH) District to be numbered as 15, and Sections: 90 -434 Generally, 90 -435 Permitted Uses, 90 -436 Special Exception Uses, 90 -437 Customary Accessory Uses, and 90 -438 Lot and Structure Requirements, which said Sections read as follows: Division 15. Rural Heritage (RH) District Section 90 -434. Generally. (a) There are, within the City, parcels of land or ownerships (even though technically subdivided) that are presently undeveloped or used for agricultural purposes and were formerly zoned Holding, a zoning district no longer in existence. The City wishes to preserve the potential for limited agricultural use on these properties through creation of the RH District. (b) The RH Zoning District may be applied only to lands designated Single - Family Residential, Multi - Family Residential, Mixed -Use Residential, and Industrial on the Future Land Use Map of the Comprehensive Plan. (c) Uses in the RH District shall be subject to the regulations of this division. Section 90 -435. Permitted Uses. The following principal uses and structures are permitted in the RH District: al Detached single - family dwellings. (2) Limited agricultural uses and associated structures for the commercial or noncommercial boarding, raising and grazing of horses and cattle; non- commercial raising or keeping of a maximum of three in total number of hogs, sheep and goats; noncommercial plant and vegetable gardens; and cultivation of hay for use or sale. Section 90 -436. Special Exception Uses. The following uses and structures are permitted in the RH District after the issuance of a Special Exception Use Petition. The minimum yard requirements in the RH District, except where greater distance is required by yard setbacks, shall be as follows: a. Single- family dwelling: Front 25 feet Side 10 feet Rear 10 feet Waterfront 20 feet b. Other permissible structures: Front 25 feet Side 20 feet Rear 20 feet Waterfront 20 feet (3) Maximum lot coverage by all buildings. a. Single- family dwelling: 45 percent b. Other permissible principal uses: 45 percent (4) Maximum impervious surface. a. Single- family dwelling: 55 percent b. SECTION 4: That Section 90 -192 Permitted Uses of Chapter 90 Zoning, Article 111 Districts and District Regulations, Division 5 Residential Multiple Family (RMF) District, of the City of Okeechobee, Florida, Code of Ordinances Part II, Subpart B Land Development Regulations, is hereby amended by adding item (8) to read as follows: (8) Limited agriculture of a commercial nature on properties on which there is an active agricultural exemption, which was granted by the Okeechobee Property Appraiser not later than September 19, 2013. SECTION 5: That Section 90 -342 Permitted Uses of Chapter 90 Zoning, Article III Districts and District Regulations, Division 10 Industrial (IND) District, of the City of Okeechobee, Florida, Code of Ordinances Part II, Subpart B Land Development Regulations, is hereby amended by adding item (29) to read as follows: (29) Limited agriculture of a commercial nature on properties on which there is an active agricultural exemption, which was granted by the Okeechobee Property Appraiser not later than September 19, 2013. SECTION 6: That Section 90 -417 Permitted Uses of Chapter 90 Zoning, Article 111 Districts and District Regulations, Division 13 Residential Planned Unite Development (PUD -R) District, of the City of Okeechobee, Florida, Code of Ordinances Part II, Subpart B Land Development Regulations, is hereby amended by adding item (4) under paragraph (a) and item (7) under paragraph (b) to read as follows: (a) (4) Limited agriculture shall be permissible as an interim use until such time as urban development is undertaken in accordance with an approved planned development. PROJECT DESCRIPTION: TAYLOR CREEK PARK IMPROVEMENTS Master Site Plan, survey, preliminary design and grant applications for improvements to the Taylor Creek Park site located at the intersection of SE 7'h Street and SE 6th Avenue in the City of Okeechobee, Florida. I. PURPOSE This is an attachment to the Standard Agreement for Civil Engineering Services dated September 17th, 2013 between the City of Okeechobee (CITY) and the firm of Culpepper & Terpening, Inc. (PROFESSIONAL) and made a part thereof. The purpose of this Project Authorization is to specify the required services of the PROFESSIONAL to prepare site master plan, preliminary plans & details and to make grant applications for the funding of the improvements as assistance to City staff for the Project described above. II. PROFESSIONAL SERVICES The PROFESSIONAL shall design a master site plan, preliminary plans & details and grant application services for the planning and funding of a recreational facility in the Taylor Creek Park site. III. GENERAL SCOPE OF WORK The scope of work shall result in facility that will provide a primary focus on the use of Taylor Creek as a recreational facility. The park components shall include temporary boat dockage, boardwalk, fishing /observation platform, canoe /kayak launch areas, "Chickee" picnic areas, a central pavilion, children's playground, open grass lawn areas, inter- connective walkways, restroom facility, landscape & lighting, parking and drainage improvements. Consultant shall assist the City with the development of design level documents sufficient to make grant applications to various agencies. The work shall include the following elements: o blaster Site Plan ▪ Grant Fund Assistance The intent of the following detailed scope of service is to provide sufficient information for the project to be developed in accordance with the Conceptual Plan as present to the City Council on January 21, 2014. Specific tasks to be performed by Consultant are as follows: PHASE 2: PRELIMINARY DESIGN SERVICES Task 2.1 Design Survey Consultant shall prepare a boundary a topographic survey of the site. The survey shall be utilized as the basenap for the site and construction plans. The survey shall be prepared in accordance with Florida Status 5J -17 and based upon the Okeechobee County 1929 NGVD control network datum. Task 2.2 Master Site Plan Consultant shall prepare a Master Site Plan of the proposed facility based upon the Conceptual Plans referenced above. The Master Site Plan shall be prepare as a schematic drawing which will provide a controlled, enhanced level of detail for the proposed elements of the Taylor Creek Park. The elements will include floating boat docks, canoe & kayak launch, boardwalk, fishing pier, observation platform, pavilion, child playground, restroom facilities, parking, landscaping, streetscaping, park furniture, site lighting, picnic "Chickees ", barbeque grills, and inter- connective pathways. The phasing plan shall take into account the various funding mechanisms available to provide construction funding for the project. Task 2.3 Grant Fund Assistance Consultant shall assist the City with applications to the following agencies for grant funding requests: • FDEP Section 319 Stormwater Improvement • EPA Total Maximum Daily Load (TMV DL) Water Quality Improvement • Florida Inland Navigation District (FIND) The assistance shall include the grant application package preparation including sketches, graphics, and estimates of costs along with one response to agency requests for additional information. PHASE 3: FINAL DESIGN SERVICES Not Included — To be provided under subsequent Project Authorization PHASE 4: BIDDING SERVICES Not Included — To be provided under subsequent Project Authorization PHASE 5: SERVICES DURING CONSTRUCTION Not Included — To be provided under subsequent Project Authorization PHASE 6: POST CONSTRUCTION SERVICES Not Included — To be provided under subsequent Project Authorization IV CITY RESPONSIBILITIES The CITY will provide specific data for the project. Such data shall; include as a minimum available record drawings, Property deed and easements. Prepare the final bid documents and manage construction activities. V WARRANTY The PROFESSIONAL warrants that the plans and specifications produced as a result of this contract are complete, correct and suitable for the purpose intended. VI AMERICANS WITH DISABILITIES The PROFESSIONAL shall ensure compliance with all applicable governmental accessibility standards, including without limitation those applicable under sections 35.151 CFR. Page 2 of 6 Project No. 14 -024 VII DELIVERABLES The project deliverables associated with each of Phase 2 provided in Exhibit "A" will be delivered to the County in accordance with the schedule provided above. Three (3) hard copies and an electronic file of each of the deliverables will be as follows: • 24" x 36" Master Site Plan ▪ Grant Applications VIII PLAN AND SPECIFICATIONS REPRODUCTION The PROFESSIONAL will provide two (2) sets of the master plans and grant applications. The cost of these sets is to be included in the design cost paid under the PROFESSIONAL as compensation for services required under this Project Authorization. If additional sets of Construction Documents are required by the City, the PROFESSIONAL shall furnish such sets at cost. Payment for such additional sets shall be promptly made by the CITY, upon properly supported invoices, submitted by PROFESSIONAL. IX PLAN AND DOCUMENT OWNERSHIP The original plans and specifications will become the property of the CITY upon completion of the Project. Computer Aided Design Drawings (CADD) is to be used in the preparation of the construction plans; a copy of all electronic data and drawing files are to be submitted on CD media. These will utilize AutoCAD version 14.0 or 2000 software. If other software is used, it is to be translated to the aforementioned software. The supplied disks are to include all points and working files. X SCHEDULES AND TIME CONSTRAINTS Within ten (10) days after receiving the Notice to Proceed, the PROFESSIONAL shall provide a schedule and an anticipated payment schedule. The total time allowed for the PROFESSIONAL's services required under this Project Authorization shall be 12 months from the date of the Notice to Proceed. Phases 2& 3 shall commence upon notice to proceed from the City of Okeechobee and shall be completed by December 31, 2014. Time includes 14 days for City review of each milestone submittal. The purpose of this project is to enhance pedestrian safety, and improve property values in the City. The new sidewalks will be constructed on City owned Right of Way, adjacent to your property. However minimal disruption to some daily activities may be necessary, particularly: • As part of the sidewalk installation, relocation of your existing mail box will be needed to accommodate the new sidewalk. On the one hand, it's good to see the activity, but it's certainly creating a cumbersome issue. I'd like to investigate the acquisition of the empty 50 X 142.5 lot at the intersection of SW Park & SW 4th Av (where the Christmas trees were sold). It's been placed on the Agenda. • Former Police Officer Larry Parzygnat filed a grievance for his termination and the Committee met on Thurs., Mar 13 to hear the appeal from the parties involved. Again, as per Ch 7 of the Pers Code either party, Mr. Parzygnat or the Dept Head, depending on the Committee's recommendation, then has a right to appeal the decision to the City Council. I'm not at liberty to render much information at this time as the Council may inevitably be asked to render an unbiased opinion. Fire & Code Enforcement: • Neighborhood Stabilization program (County NSP) — The last updates I gave to you reflected a list of houses within the City that were identified as part of the DREF demolition program and that one owned by Shirley Johnson at 913 NW 11th St was essentially approved. That program is different than the NSP of which, according to Debbie Belcher, there are 7 (soon to be 8) houses in the City that have been rejuvenated. Two houses were listed in last week's newspaper as part of the County's 2/13/14 agenda items. Ms. Belcher explained that of the 7 -8 houses, five of them are now under a 15- year affordable rental arrangement and two are being resold. While I could examine the records in the bldg dept, I've asked her to supply (and continue to supply) any houses that are part of a County grant program to my office. These two areas will also be used to temporarily store muck for a brief dewatering (maybe 2 weeks) 3. Will probably start in two areas simultaneously... both the SE 7th Street area and the SE 8th Av area. 4. The flyers that were attached to my update report have now been distributed to all occupants and according to Mr. Elmore the residents are on the verge of ecstatic. Only one resident expressed concern about his seawall, which is in a bad state with considerable erosion on the house side of the wall.
