Release "of Perpetual Spoil Easements, Taylor Creek Channel in the Vicinity
of City of Okeechobee
WHEREAS,v the Taylor Creek navigation project, a unit of the Okeechobee Waterway,
Florida, improvement has been completed for many years., and
WHEREAS
,9 the Central and Southern Florida Project authorized by the Flood Control
Act of June 30, 1948, and subsequent acts of Congress includes no authorization for
enlargement or modification or the Taylor Creek Chanriel, and
WHEREAS, a number of large spoil areas were made available to the Corps of
Engineers for conttruction of the Taylor Creek Project and such areas have been avail-
able for use by the Corps of Engiheeri since 1936, and
WHEREABi these large spoil areas have not been used by the Corps of Engineers for
many years and there is no apparent need for their use in the foreseeable future, And
WHEREAS,, the continued existence of the perpetual spoil easements serves to with-
hold the entire area of such easements from development by the fee owners of the lands
involved, and
WHEREAS,,some very desirable land which could be developed for recreational and
residential use is.involved in the areas in question,
NOid, THEREFORE, BE IT RESOLVED that the City Ccancili City of Okeechdbsa, in regular
meeting assembled does request the Corps of Engineers to release the perpetual spoil
r
easements of the Taylor Creek Project in order that the lands inky be developed for
recreation and residential use, and
BE IT FURTHER RESOLVED THATi copie'; of this resolution be furnished the District
Engineer, Corps of Engineers, Jacksonville District, the Central and Southern Florida
Flood Control District, Senator Spessard L. Holland, Senator George A. Smathers and
Congressman Paul G. Rogera
Passed and Adopted this 3rd day of October by City Council, City of Okeechobee.
