Disposition of Cases presented by Code Officer Sterling : This being a quasi-judicial proceeding, an oath was administered to those offering testimony, all responded affirmatively. Officer Sterling advised all events occurred within the corporate limits of the City of Okeechobee. The Officer's notes, testimony, photographs, and supporting documents were all entered as part of the official record. Case No. 13-015 Officer Sterling testified service for Notice of Violation/Notice of Hearing was via certified mail and received by property owner William Mason. 1012 SW 60' Avenue William Mason. He said the property at 1012 SW Vh Avenue was a vacant lot in a residential area owned by Mr. Mason. Officer Ch 54 Sec 54-51 Parking commercial vehicles in residential area Sterling stated Mr. Mason has given Anthony Bertram permission to park commercial vehicles on his property which is not 11 permitted in a residential neighborhood. He added he had received a request from a neighbor to have the vehicles removed. Attorney Cook advised the Board of what City ordinances defines as commercial vehicles and/or industrial equipment. He said if even one of the vehicles is found to be a commercial vehicle then the property is in violation of Chapter 54 Section 54-51 Parking commercial vehicles in residential area. Member Close moved to find Case No.13-015, William Mason, 1012 SW 6' Avenue, in violation of Ch 54 Sec 54.51 Parking commercial vehicles in residential area, based on the testimony of Code Officer Sterling, imposing a fine of twenty five dollars per day beginning ten .days after receipt of proper notification if commercial vehicles and/or industrial equipment are not removed from property; seconded by Member Denisuk. CITY OF OKEECHOBEE BUILDING DEPARTMENT SS SE THIRD A VENUE OKEECHOBEE, FL 34974 Tele: 863-763-3372 Far: 863-763-1686 jnewell@cityofokeechobee. com January 14, 2014 Reference: Ms. Janet L Estrella 842 Parris Island Gateway Beaufort, SC 299066927 Property: 919 NW IOth Street Code Enforcement Officer Fred Sterling: The condition of the structure located at 919 NW loth Street is in the process of structural failure and therefore is not safe for human habitation. It is evident from the separation of the concrete masonry units from the footer thru the bond beam that a failure has taken place with the foundation footer and supporting earth. The primary failure is visibly seen on the north elevation where the separation of the masonry units is greater than one inch and the separation is completely through the structural wall. The interior floor (slab) in the living room is out of level and sloping towards the failed footer located in the north elevation. In my opinion, the cause of the failure is due to the supporting earth collapsing underneath the structural foundation. The remediation to correct the current conditions of the structure would require the total demolition of the structure. The earth located below the foundation would have to be analyzed by an engineer to determine the cause of the failure of the supporting earth.
