Thomas City Clerk City of Okeechobee REGULAR MEETING TUESDAY, OCTOBER 13, 1981 The City Council of Okeechobee, Florida, convened in regular session in the City Council Chambers of City Hall, Okeechobee on Tuesday, October 13, 1981 at 7:00 P.M. Chairman /Mayor Edward W. Douglas presided with the following Councilmen present: Dowling Watford, Jr., Jim Knight, Donald Burk and Oakland Chapman. Others present were: City Clerk Bonnie S. Thomas, Administrative Assistant Richard C. Fellows, City Attorney David Conlon and Fire Chief Keith Tomey. Chairman Douglas called the meeting to order, Councilman Knight offered the invocation. APPROVAL OF MINUTES Councilman Burk moved to approve the minutes of September 22, September 24 and October 8 as written. Seconded by Councilman Chapman. Motion carried. PRESENTATION OF FIRE PREVENTION AWARDS Fire Chief Tomey recognized personnel from the Central Elementary School who helped make Fire Prevention Week a success: Debbie Shofner, first grade teacher, Linda King, Principal and Sam Smith, Assistant Principal. Chairman Douglas and Chief Tomey presented fire helmets to Gena Spradlin and Kim Graves, winners of the poster contest for their efforts in fire prevention. FIRST READING - REZONING REQEUST - WILLIAMS Chairman Douglas informed the Council of a request for rezoning of property at N.W. 7th Street and N.W. 11th Avenue from Holding (H) to RG -2 for construction of four triplex apartments and setting of a public hearing for November 24th, 1981. Councilman Knight moved to read the ordinance by title only, seconded by Councilman Burk. Motion carried. Chairman Douglas read the ordinance by title only: ORDINANCE AMENDING ORDINANCE NO. 402, BEING THE COMPREHENSIVE ZONING ORDINANCE WHICH ESTABLISHED ZONTING REGULATIONS FOR THE CITY OF OKEECHOBEE, FLORIDA, AND PROVIDES FOR THE ADMINISTRATION, ENFORCEMENT, AND AMENDMENT THEREOF. AMENDMENT CHANGES CLASSIFICATION OF SPECIFIED LAND FROM HOLDING TO RG -2. Councilman Watford moved to set the ordinance for public hearing November 24, 1981, seconded by Councilmen Knight and Chapman. Motion carried. 2943 33 81 -137 81 -118 81 -138 REQUEST FROM GRACE CHRISTIAN SCHOOLS TO APPROVE THE FENCING OF AN ALLEY EASEMENT BEHIND THE SCHOOL Chairman Douglas informed the Council of a request from Grace Christian Schools to approve the fencing of an alley easement behind the school. Councilman Knight moved to approve the request of Grace Christian School for fencing, seconded'by Councilman Chapman. Councilman Watford questioned the need for a contract and the requirement of proof of insurance. Councilman Knight amended his motion to include a contract be drawn up between the City and Grace Christian School. Councilman Chapman concurred on his second. Motion carried. FINAL READING - PUBLIC HEARING REZONING REQUEST - ROY AND SANDRA PEARCE Chairman Douglas informed the Council of the final reading of an ordinance to rezone property at 207 S.W. 5th Avenue, Okeechobee, from RG -2 to Commercial. Chairman Douglas read the ordinance in its entirety: ORDINANCE AMENDING ORDINANCE NO. 402, BEING THE COMPREHENSIVE ZONING ORDINANCE WHICH ESTABLISHED ZONING REGULATIONS FOR THE CITY OF OKEECHOBEE, FLORIDA, AND PROVIDES FOR THE ADMINISTRATION, ENFORCEMENT, AND AMENDMENT THEREOF. AMENDMENT CHANGES CLASSIFICATION OF SPECIFIED LAND FROM RG -2 TO COMMERCIAL. WHEREAS, application has been duly made to change the zoning classification as hereinstated, and WHEREAS, all public notices have been duly published according to law, and WHEREAS, public hearings have been held as required by Ordinance 402, and WHEREAS after consideration of the requirements of Ordinance 402 and the land use plan of the City of Okeechobee and the publics interest, it is deemed to be in the best interest of the City of Okeechobee to change the zoning classification of the land lying within the limits of the City of Okeechobee as hereinstated; now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA. SECTION 1. That the following described real property is hereby rezoned from RG -2 to Commercial: Lots 7 and 8, Block 176, City of Okeechobee SECTION 2. That the application requesting this Amending Ordinance, and proof of publication for any and all public hearings in connection herewith shall be attached to this Ordinance. SECTION 3. The City Clerk shall make the appropriate change on the city zoning map in accordance with this Ordinance. SECTION 4. This Ordinance shall become effective immediately upon final passage. DONE AND RESOLVED and made effective this 13th day of October , 1981. After a brief discussion by Council members, Councilman Watford moved that the rezoning request be granted, seconded by Councilman Knight. Motion carried. FINAL READING - PUBLIC HEARING ORDINANCE AMENDING THE SCHEDULE OF DISTRICT REGULATIONS Chairman Douglas read in its entirety an ordinance amending the schedule of district regulations to provide that wholesale, warehouse, storage or distribution facilities, including 2944 81 -139 bulk storage of flamable liquids may only be used in an Industrial (I) area by special exception noting the Planning and Zoning Board's recommended approval: AN ORDINANCE AMENDING ORDINANCE 402, SCHEDULE OF DISTRICT REGULATIONS; PROVIDING FOR THE ELIMINATION OF ITEM FOUR UNDER PERMITTED PRINCIPAL USES AND STRUCTURES ALLOWING THE CONSTRUCTION OF WHOLESALE, WAREHOUSE, STORAGE OR DISTRIBUTION FACILITIES, INCLUDING BULK STORAGE OF FLAMMABLE LIQUIDS AND PROVIDING THIS USE MAY BE GRANTED ONLY BY SPECIAL EXCEPTION AFTER DUE PUBLIC NOTICE AND HEARING AND THE ESTABLISHMENT OF APPROPRIATE SAFEGUARDS: PROVIDING AN EFFECTIVE DATE. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA AS FOLLOWS: SECTION I: The schedule of district regulations of Ordinance 402, the Comprehensive Zoning Ordinance of the City of Okeechobee be and they hereby are amended to read as follows: I- INDUSTRIAL DISTRICTS AND INTENT PERMITTED PRINCIPAL USES AND STRUCTURES SPECIAL EXCEPTIONS permissible by board of adjustment after public notice and hearing and safeguards (see section 13.3) 3. Wholesale, warehouse, storage, or distribution facilities, including bulk storage of flammable liquids. SECTION II: This ordinance shall take effect upon its adoption. Introduced and passed on final reading this 13th day of October , 1981. Councilman Knight moved to adopt the ordinance, seconded by Councilman Burk. Councilmen briefly discussed the purpose of this ordinance. Chairman Douglas called for a vote of the Council. Motion to approve ordinance carried. FIRST READING- ORDINANCE AMENDING THE CITY CHARTER IN REGARDS TO THE SETTING 'OF COMPENSATION FOR CITY OFFICERS Chairman Douglas informed the Council of an ordinance amending the charter to clarify the power of the City Council to create offices and revise the Council's authority in regards to the setting of compensation for city officers and setting of a public hearing for October 27, 1981. Councilman Knight moved to read the ordinance by title only, seconded by Councilman Chapman. Motion carried. Chairman Douglas read the ordinance by title only: AN ORDINANCE AMENDING THE MUNICIPAL CHARTER OF THE CITY OF OKEECHOBEE, FLORIDA; AMENDING ARTICLE V, SECTION 25, TO PROVIDE THAT THE COUNCIL MAY CREATE AND ABOLISH OFFICES; AMENDING ARTICLE VI, SECTION 28, PROVIDING FOR THE COMPENSATION OF CITY OFFICERS AND REPEALING THE PROVISION PROHIBITING THE CHANGE IN COMPENSATION DURING THE TERM OF OFFICE; PROVIDING AN EFFECTIVE DATE. Councilman Watford moved to amend the ordinance to read ". . . to create such offices by ordinance . . . ". Motion dies for lack of second. After brief discussion by Council members, Councilman Knight moved to set this ordinance for final reading and public hearing October 27th, 1981, seconded by Councilman Burk. 945 33 81 -140 81 -141 81 -142 Councilman Watford commented that he felt problems could arise if the City Council could create any position. The reason for amending the ordinance to read "by ordinance" is that it would make it necessary for the Council to hold public hearings, which would be to the benefit of the Council. Chairman Douglas called for a vote by the Council. Motion to set for final reading and public hearing carried. FIRST READING - ORDINANCE RELATING TO THE FIRE PROTECTION TO BE FURNISHED BY THE CITY FIRE DEPARTMENT Chairman Douglas read in its entirety an ordinance reaffirming the responsibilities of the Okeechobee City Fire Department: AN ORDINANCE PROVIDING FOR THE PROTECTION OF LIFE AND PROPERTY; REAFFIRMING THE RESPONSIBILITIES OF THE OKEECHOBEE CITY FIRE DEPARTMENT; PROVIDING BOUNDARIES OF THE FIRE DISTRICT; PROVIDING FOR THE FIGHTING OF FIRES WITHIN THE FIRE DISTRICT; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA AS FOLLOWS: SECTION 1. It is hereby affirmed that one of the primary responsibilities of the government of the City of Okeechobee, Florida is to provide for the protection of life and property. SECTION 2. For the purposes stated in Section 1. herein, a fire district is created which encompasses the entire incorporated limits of the City of Okeechobee and within this fire district, the city accepts its responsiblitiy for the protection of life and property from fires or other such conflagrations. SECTION 3. The Okeechobee City Fire Department, which has been organized and operating for over two decades is recognized as the firefighting arm of the City of Okeechobee and is the sole lawful department authorized to attack and fight fires and other such conflagrations within the fire district herein created. SECTION 4. THIS ORDINANCE SHALL TAKE EFFECT AS PROVIDED BY LAW. Councilman Watford moved to set for Final Reading and Public Hearing October 27th, seconded by Councilman Chapman. Motion carried. LEEDY, WHEELER, ALLEMAN, INC. FINANCIAL FEASIBILITY STUDY OF EXPANDING THE CITY'S WATER AND SEWER SYSTEM Mr. Brian Harris, Municipal Finance Director of Leedy, Wheeler, Alleman, Inc., appeared before the Council to give an overview of a possible financial feasibility study to determine alternative financing of expanding the city's water and sewer system. Mr. Harris explained that his firm would make a study to determine the feasibility of the City to use the municipal bond system. After further discussion between Council members and Mr. Harris, the consensus of the Council was to table the matter until after the budget is finalized. CITIZENS ADDRESSING THE COUNCIL IN REGARD TO THE PROPOSED CITY BUDGET FOR THE FISCAL YEAR 1981 -82 Several members of the community representing the Concerned Taxpayers of Okeechobee appeared before the Council to make recommendations for possible budget cuts from the taxpayers point of view. Council members discussed at length several proposals from members of the committee. T T T 2946 81 -134 81 -132 COMMUNICATIONS WITH DEPARTMENT HEADS CITY CLERK Clerk Thomas presented the October Water and Sewer and General Warrant registers for approval. Councilman Knight moved to accept both the Water and Sewer and General Warrant Registers, seconded by Councilman Burk. Motion carried. Seconded by Councilman Chapman. Motion carried. 2947 33 81 -6 81 -133 81 -142 COMMUNICATIONS WITH COUNCILMEN DOWLING WATFORD, JR. Councilman Watford stated that at the last meeting of the Central Florida Regional Planning Council, the Council voted to appeal the County's approval of the Country Club of Champions. Councilman Watford stated that the County has voted to pull out of the Planning Council but their withdrawal will in no way affect the City's membership in the Council. MEMBERS OF THE AUDIENCE Anna Jane Breland appeared before the Council to again question payment of garbage fees for rental property that is vacant for months at a time. After discussion between Council members and Mrs. Breland, the consensus of the Council was to allow Mr. Fellows to research how the problem is handled in other towns who have a large number of migratory people and garbage is mandatory.
