1981-10-08 Public Hearing2940 After further discussion between Council members and Mr. Weyant, the consensus of the Council was to allow a reservation of 9,000 gallons for six months and at the end of the six months, grant further allocation. Director Fortner briefly discussed with Council members "Water Availability Fee" and "Sewer Availability Fee". It was the consensus of the Council to allow Attorney Conlon, Director Fortner and Assistant Fellows to draw up a comprehensive agreement that would be fair to both the City and the people making the request for capacity. Mr. Weyant questioned the Council about lines being lowered to accomodate extension to area outside the developers ownership at the owners' expense. Weyant stated that he had worked with some municipalities who had made some type of agreement for reimbursement to the developer when "late comers" come in and hook-up. Chairman Douglas stated that at this time the Council has no set policy on this situation. Council members briefly discussed the problems of having such a policy and it was the consensus of the Council that they do not want to get into the payback situation at this time. There being no further discussion on the matter, Councilman Burk moved to adjourn the workshop, seconded by Councilman Chapman. Motion carried, meeting adjourned at 9:15 P.M. Edward W. Douglas J Mayor/Chairman / City of Okeechobee ATTEST .~/ City Clerk City of Okeechobee PUBLIC HEARING THURSDAY, OCTOBER 8, 1981 The City Council of the City of Okeechobee, Florida, convened in special session in the City Council Chambers at City Hall, Okeechobee on Thursday, October 8, for the purpose of holding the final public hearing and adoption of a resolution for the City of Okeechobee Comprehensive Plan. Chairman/Mayor Edward W. Douglas called the meeting to order at 7:00 P.M. with the following Councilmen present: Dowling Watford, Jr., Jim Knight, Donald Burk and Oakland Chapman. Others present were City Clerk Bonnie S. Thomas, Administrative Assistant Richard C. Fellows, City Attorney David Conlon. Chairman Douglas stated that the Comprehensive Plan is something that has been required by the State of Florida and asked if there was anyone present in the audience who wished to speak in regard to the adoption of the Comprehensive Plan. There being no response, Chairman Douglas called on Mr. Jim Dwayne of the Central Florida Regional Planning Council to give a brief overview of the Plan. 2941 Mr. Dwayne noted that the Plan, which is required by the Local Government Comprehensive Planning Act of 1975, contains eight elements: 1) a Future Land Use Element 2) a Traffic Circulation Element 3) a General Sanitary, Sewer, Solid-Waste Drainage and Portable Water Element 4) a Natural Resource Conservation Element 5) a Recreation and Open Space Element 6) a Housing Element 7) an Intergovernmental Coordination Element 8) an Electric Utility Element After a brief discussion of the Plan by Mr. Dwayne, Chairman Douglas called for any questions. Mr. Donald Bradley, a citizen present at the hearing, voiced his concern about residential sections of the City being changed to commercial under the adoption of the Comprehensive Plan. Councilman Watford responded to Mr. Bradley's concern stating that the Council has asked the Planning and Zoning Board to make recommendations regarding another category of commercial zoning. The Council and Mr. Dwayne further explained that the Plan is a guide to future zoning and will in no way change the current zoning of the City. Chairman Douglas read the Resolution in its entirety for adoption: RESOLUTION NO. 81-20 WHEREAS, the City of Okeechobee has been required by the State of Florida to adopt a comprehensive plan and WHEREAS, the city has followed the procedures as provided in Chapter 163.3161 ,~ Florida Statutes and WHEREAS, the proposed plan has been transmitted for review and comment to the State, the Central Florida Regional Planning Council and the Planning Department of Okeechobee County and WHEREAS, the appropriate time has elapsed for replies and WHEREAS, the plan has been developed and meets the needs of the citizens of the City of Okeechobee. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Okeechobee, Florida as follows: 1. The City of Okeechobee Comprehensive Plan, prepared by the Central Florida Regional Planning Council be and it hereby is formally adopted as the official plan for the City of Okeechobee. 2. This resolution shall take effect immediately upon its adoption. Introduced and adopted in special session assembled this eighth day of October, 1981. Councilman Knight moved to adopt Resolution 81-20, seconded by Councilman Chapman. Motion carried. Chairman Douglas called the meeting to order, Councilman Knight offered the invocation. 81-2 APPROVAL OF MINUTES Councilman Burk moved to approve the minutes of September 22, September 24 and October 8 as written. Seconded by Councilman Chapman. Motion carried. 81-135 PRESENTATION OF FIRE PREVENTION AWARDS Fire Chief Tomey recognized personnel from the Central Elementary School who helped make Fire Prevention Week a success: Debbie Shofner, first grade teacher, Linda King, Principal and Sam Smith, Assistant Principal. Chairman Douglas and Chief Tomey presented fire helmets to Gena Spradlin and Kim Graves, winners of the poster contest for their efforts in fire prevention. 81-136 FIRST READING-REZONING REQEUST-WtLLIAMS Chairman Douglas informed the Council of a request for rezoning of property at N.W. 7th Street and N.W. 11th Avenue from Holding (H) to RG-2 for construction of four triplex apartments and setting of a public hearing for November 24th, 1981. Councilman Knight moved to read the ordinance by title only, seconded by Councilman Burk. Motion carried. Chairman Douglas read the ordinance by title only: ORDINANCE AMENDING ORDINANCE NO. 402, BEING THE COMPREHENSIVE ZONING ORDINANCE WHICH ESTABLISHED ZOWING REGULATIONS FOR THE CITY OF OKEECHOBEE, FLORIDA, AND PROVIDES FOR THE ADMINISTRATION, ENFORCEMENT, AND AMENDMENT THEREOF. AMENDMENT CHANGES CLASSIFICATION OF SPECIFIED LAND FROM HOLDING TO RG-2. Councilman Watford moved to set the ordinance for public hearing November 24, 1981, seconded by Councilmen Knight and Chapman.
