Officer Sterling advised that all events occurred within the corporate limits of the City of Okeechobee. The Officer's notes, case narratives, testimony, photograph, and supporting documents were all entered as part of the official record. Mr. and Mrs. Harold Wise, as the new owners of 606 Southwest 14th Street submitted A Request for Reduction of Penalty for Case No.12-114 (Legal: Lots 1 and 2 of Sherman Heights, Plat Book 3, Page 21, and Lot 20 of Block 247, First Addition City of Okeechobee, Plat Book 1, Page 11, Okeechobee County Public Records). They purchased the property from Mr. and Mrs. Mitchum on October 15, 2013. Service was via a courtesy card mailed September 9, 2012; Notice of Violation mailed October 31, 2012 (returned November 5, 2012). Posted Notice of Violation on the property on November 8, 2012, Code Chapter 30 Sections 41 Public Nuisance, and 44 General Cleaning and Beautification. Notice to Appear was posted on January 30, 2013, on the property and at City Hall. This case was first heard on February 12, 2013, to comply immediately. The property was not complied, and the Board's action was to impose a fine of $25.00 per day, upon receipt of proper notification. The fine began to accrue on March 18, 2013, and would continue to accrue until the property was in compliance, which was October 7, 2013. Board Member Close moved to find Case No.12.114, Stephen and Grace Mitchum, 606 Southwest 14"' Street, in compliance by the new owners, Harold and SherryWise, and to reduce the fine [from five thousand seventy- five dollars ($5,075.00)1to zero, seconded by Board Member Denisuk. Sec 44 General Cleaning and Beautification 11 Ch 30 Sec 43 Public Nuisance Service for Case No. 13-106, Ms. Newcomer, for property at 1210 Southwest 2"d Avenue, was via a letter mailed September 3, 2013, from Building Official Jeffery Newell, for Violation of Code Chapter 30 Section 43 Public Nuisance/damaged building. He requested the owner apply for a building permit to repair the structure by September 17, 2013, or the matter will be forwarded to Code Enforcement. Notice of Violation sent from Code Enforcement on October 7, 2013 (returned unclaimed October 24, 2013). Disposition of Cases continued: 13-106 Pamela Newcomer Ch 30 Sec 43 Public Nuisance Notice of Hearing mailed October 18, 2013. Notice to Appear was posted October 22, 2013, on the property and at 1210 SW 2"d Avenue City Hall. Attorney Cook advised the Board not to pursue finding the case in violation without evidence relative to the public safety issue. He explained that Mr. Newell's letter of November 5, 2013, to Officer Sterling states Mr. Newell does not factually know of a structural issue with the truss system that would cause the building to pose a public safety hazard. The burden is on the City to prove there is a structural defect, before finding the owner in violation. However, Mr. Newell has the authority to address structural issues, should he reexamine it and find sufficient evidence, it can be brought back to the board (as a new case). Ms. Newcomer was present, and addressed the Board agreeing the property is unsightly. She intends to get it repaired, however, there have been problems with getting the correct materials and other issues, Board Member Conrad made a motion that Case No.13-106, Pamela Newcomer, Trustee,1210 Southwest 2"d Avenue, (Legal: Lots 4.6 of Block 18, South Okeechobee, Plat Book 5, Page 7, Okeechobee County Public Records) for violation of Chapter 30, Section 43 Public Nuisance, be dismissed as of today; seconded by Board Member Close. The letter tells Pam to prove she's not in violation, basically to hire an engineer, but the burden is on the City to prove it's a structural defect before we can find her in violation. As viewed from the roadway, it appears that building codes and city regulations have not been considered to ensure the safety of the public and tenants. If a building permit is not applied for by September 17, 2013, a hearing before the Code Enforcement Board will be scheduled. The City encourages property owners to maintain their properties to a presentable appearance that is beneficial to all the residence of the City. However, there are regulations and building codes that have to be observed. The continued practice of ignoring these regulations will only result in code violations that will be heard by the Code Enforcement Board. Visual examination shows decayed conditions that have led to their failure. At present, the property owner has not responded to the City's concerns regarding the condition of the columns. The truss system of the structure appears to be a three point bearing system. However, if this is not the case, then the front roofed portion of the structure would be subject to collapse. This, in essence, poses a threat to public safety. It is recommended that the owner, Pamela Newcomer, provide the City of Okeechobee with an engineer's evaluation on the condition of this area of the structure.
