Mr. Jacob Larson, President of Okeechobee Farm Bureau, received the November 22 through 28, 2013, Farm City
Week proclamation, which was read in its entirety by Mayor Pro -Tem Watford as follows: "WHEREAS, American
farmers and ranchers literally help feed the world by producing a bounty of agricultural products. To do this,
they rely on essential partnerships with urban and suburban communities to supply, sell and deliver finished
products across the country and around the globe; and WHEREAS, rural and urban communities working
together have built our nation's rich agricultural resources so that they contribute to the health and well being
of our country and to the strength of our economy; and WHEREAS, during Farm City Week, we recognize the
importance of this cooperative network. Agriculture employs more than 24 million workers, including farmers

others who annually contribute more than $1.3 trillion to our gross domestic product; and WHEREAS, Farm
City Week activities celebrate these vital rural -urban partnerships. We commend the many Americans whose
hard work and ingenuity reflect the true spirit of our nation; and WHEREAS, this week as we gather with family
and friends around the Thanksgiving table, it is fitting that we count among our blessings the Farm City
partnerships that have done so much to improve the quality of our lives. NOW, THEREFORE, 1, James E. Kirk,
by virtue of the authority vested in me as Mayor of the City of Okeechobee, Florida, do hereby proclaim
November 22 -28, 2013 as "Farm City Week'; and I do further call upon all citizens in rural and urban areas to
acknowledge and celebrate the achievements of all those who, working together, produce and supply our
community and nation with an abundance of agricultural products. "Mr. Larson noted Farm Bureau's appreciation
for the proclamation, thanked the City for supporting agriculture within the community, and presented fresh vegetables
to the Council.
Mr. James Bell and his family were asked to attend the meeting in order to allow the City Council to recognize his
achievement of Eagle Scout. He was presented a framed Certificate of Honor, which was read in its entirety by Mayor
Pro -Tem Watford as follows: "Office of the Mayor, Certificate of Honor presented to James Edward Bell,
honoring your dedication, and excellent accomplishment of achieving Eagle Scout, the highest rank of the
Boy Scouts of America; and by assuming a solemn obligation to God, Country, your Fellow Scouts and the
community." Mr. Bell was also accompanied by Troop 913, to honor his achievement.
Council Member O'Connor moved to dispense with the reading and approve the Summary of Council Action for the

A. 2. a) Motion to adopt proposed Ordinance No. 1099.
b) Public discussion and comments.
Council Member Williams moved to adopt proposed Ordinance No. 1099; seconded by Council Member O'Connor.
This ordinance addresses current legislation requirements for compatibility of land uses located near or within certain
distance of airport runways, and provides for the appointment of a representative from the School Board to sit as a
non - voting member of the Local Planning Agency, when there are Comprehensive or Zoning amendments that would
increase residential density. Mayor Pro -Tem Watford asked whether there were any questions or comments from the
public. There were none.
City Clerk Gamiotea provided a memorandum, in Exhibit One, explaining the ordinance needs to be amended, as there
are changes to the effective date language, requested by the Department of Economic Opportunity. Exhibit One
provided a copy of proposed Ordinance No. 1099, as approved at the first public hearing, as well as a revised copy
that reflects the language change.
Council Member Williams moved to amend proposed Ordinance No. 1099, reflecting the required language
by the Department of Economic Opportunity, for Section 5. Effective Date; seconded by Council Member
O'Connor.

OKEECHOBEE, FLORIDA, AMENDING ORDINANCE NO. 971 VACATING CERTAIN ALLEYWAYS BY
RESCINDING SECTION THREE, RIGHT OF REVERSION AND ADDING A SECTION TO PROVIDE FOR
CONFLICTS AS NUMBER FOUR, AND A SECTION TO PROVIDE FOR SEVERABILITY AS NUMBER FIVE;
PROVIDING FORCONFLICTS; PROVIDING FORSEVERABILITY; AND PROVIDING FORAN EFFECTIVE DATE."
2. a) Motion to adopt proposed Ordinance No. 1106. 111 Council Member O'Connor moved to adopt proposed Ordinance No. 1106; seconded by Council Member Maxwell.
b) Public discussion and comments. Ili Mayor Pro -Tern Watford asked whether there were any questions or comments from the public. There were none.
Attorney Cook addressed Council's concerns, which were discussed at the first public hearing, November 5, 2013,
being: the uncertainty of this project since its conception in 2007, and it is still not developed, and then granting an
extension rather than deleting the reversion rights. He explained unless the City wanted to reimburse the owner the
amount paid to the Hamrick Trust for the deeds to the alleyways he did not see any reason to have the reversion
clause clouding the title. Council questioned, since the deeds were recorded seven months after the right of reversion
expired, giving the City the rights to the alleys, whether that would have any legal bearing? Attorney Cook replied it
would have to be argued in a lawsuit. Mr. Steve Dobbs, project Engineer, was present, and elaborated that the
development is contingent on the alleys being closed, for financing probabilities and they are considered as part of
the development's site plan. The Developers Agreement and site plan is effective until January 20, 2019. The Council
asked Mr. Dobbs whether an extension of 36 months would be sufficient for the developer to move forward with this
project or would it jeopardize the loan process? Mr. Dobbs will research this and bring back to the Council.
Council Williams moved to postpone the motion to adopt proposed Ordinance No. 1106 to the December 3,
2013 meeting at 2 p.m.; seconded by Council Member O'Connor.

E. Motion to approve replacement of the chickee at City Hall Park -
City Administrator (Exhibit 7).
A. Motion to approve Department of Management Services Bureau of
Federal Property Assistance Agreement for eligibility to receive
Federal surplus property for the HH-1 H Huey Model 205 Helicopter
that has been placed in the Veteran's Park - City Administrator
(Exhibit 3).
Mayor Pro-Tem Watford requested to change the order of items on the agenda and consider item E as a courtesy to
Mr. Gopher. No objections were stated.
Mr. Louis Gopher, member of the Seminole Indian Tribe of Florida, appeared before the Council to explain that the
City obtained a quote to replace the chickee at the City Hall Park from a 6 by 10 foot to a 8 by 10 foot, in the amount
of $2,800.00, and thanks to the generosity of Mr. Andy Bowers and the Brighton Seminole Tribal Council, they are
offering to reimburse the City's expense. A letter from the City asking for the assistance of the replacement of the
chickee will be needed. Administrator Whitehall added the project can begin immediately so it may be completed in
time for the City's Annual Christmas Tree Lighting, scheduled for December 3, 2013.
Council Member O'Connor moved to approve the replacement of the chickee in the City Hall Park, by Mr. Wade
Osceola, in the amount of two thousand, eight hundred dollars ($2,800.00), and a letter to be sent to the Seminole
Tribe requesting reimbursement; seconded by Council Member Williams.
Council thanked Mr. Gopher and asked him to convey the City's gratitude to Mr. Bowers and the Seminole Tribe for
their partnership, and generosity. The chickee is symbolic of our local heritage and history, Mayor Pro-Tem Watford
disclosed for the record that Mr. Gopher is his son-in-law.

Council Member O'Connor moved to approve the Department of Management Services Bureau of Federal Property
Assistance Agreement for eligibility to receive Federal surplus property for the HH-1 H Huey Model 205 Helicopter that
has been placed in the Veteran's Park; seconded by Council Member Williams.
Administrator Whitehall informed the Council that the Helicopter was in place for the Veterans Day Ceremony at the
Veterans Memorial Park. It is still a work in progress as parts need to be assembled and some areas need to be
painted. An application from the City, for the aircraft to be donated for display is being submitted to the Bureau of
Federal Property Assistance.The Board of County Commissioners was kind enough to assume ownership in order to
have it transported to Okeechobee.

Council Member Maxwell indicated the Grant of License Agreement, dated September 2, 1997, with the American
Legion may need to be revisited to affirm all the items are now included and to discuss possible revisions in the
maintenance schedule responsibilities and indemnification. Administrator Whitehall will bring the matter back to Council
for discussion and consideration,
Council thanked the Public Work's Staff for their work on this project. It is a great addition to the park.

Finance Director India Riedel presented the report and announced thanks to the efforts by all the Department Heads,
there was no need for the use of reserves to balance the budget. The General Fund recapitulation of Revenues and
Expenses are as follows: Revenues budgeted: $4,516,500.00, amended: $4,800,477.00, difference: $283,977.00;
Transfers -In budgeted: $967,080.00, amended: $398,097.00, difference: - $568,983.00; Total Expenditures budgeted:
$5,483,580.00, amended: $5,095,218.00, difference: - $388,362.00. Year End Fund Balance budgeted: $3,360,118,00,
amended: $3,463,474.00, difference: $103,356.00.

Watford - we had ?7s for attorney who was absent at the first reading.
Cook - council has concerns with deleting the reversion clause, but I don't see any way under the sun we can extend the
reversion unless we want to reimburse the land ownerthe money expended to purchase the land from the hamrick trust, approx
$90,000.00.
Maxwell - what was the purpose of the reversion for this project?
Cook - it was a large development, held many many meetings on it, various boards, precautionary most likely.
Maxwell, someone could sell the alleys with the property?
Cook - yes.
Maxwell - deed wasn't recorded until 7 months after the reversionary clause deadline was met. Can we argue that? Concerned
that if we approve it, then it takes any possibility off the table to have a mechanism to get the alleys back. If we extend it at least
we'd have the mechanism.
Watford - what if the dev didn't happen, the owner sold property, a new development could have to do a new site plan, etc?
Cook - yes, and to the city's specification by the TRC.

Williams - wouldn't have come up if wasn't involved with the hamrick trust correct? Yes. 3 years ago we had a reason why we
made this decision.
O'Connor - repeat what you said John... Cook - legal argument to be had at end of 36 months no deed recorded, we didn't do
anything, then 7 months later they recorded the deeds, pass tonight we're done with it. If you extend it, and I don't believe it's
a good idea, but you may could still say the reversion is still out there and we want it back.
Maxwell - reversion is self pectuating, irrelevant after the 36 months?
Cook - not irrelevant, someone is out $90,000. Not sure what happened in this case. Generally Lane notifies me when the
deadlien on these are approaching. Not sure what happened with this one orwhy it may have been overlooked. We could have
done something prior to the deeds being recorded.
Whitehall - it would have mattered either way, they ignored the reversion, wouldn't matter if we did do anything
Cook -
Watford - what do we want to do? Adopt it, amend it, postpone it?
Whitehall - is there a new time line on the project, is the owner needing this done now, what are we looking at that may put
project in jeopardy? Who called for this to the Clerk?
Lane - Mr. Dobbs contacted my office and verifiy the status of ownership on the alleys. Asked what could be done since 36
months is up and they have deeds. Reviewed it with attorney cook. Owner may have a time line, would defer to Mr. Steve
Dobbs whose present and the engineer for the developer/owner.
Steve Dobbs - original developer and lender, developer went belly up, lender took over to do the best he could. He wanted
to tally up all the loose ends. Then decided he didn't, changed his mind and went ahead and paid the money to have the deeds
recorded for the alleys. The same lender is ready to move forward, the lender wanted to confirm the alleys were closed. The
alleys are contingent on finance and develop it.
Watford - leave like its, get it all ready then come back to remove the reversion?
Dobbs - alleys are contingent upon them getting the loan they need to do the development. They don't have a project without
the alleys.
Watford - ok concensus of the council is to extend this, to waiving it. Want info from developer that decision would put project
in jeopardy, need more from him to make decision. Don't want the project not to happen, but want to protect alleys.
Maxwell - like to see with a current project.
Williams - would postpone to get more information. O'Connor - I agree with that.
Whitehall - so Steve will be researching whether the extension is damaging to the financing of the project? Yes.

proposed Ordinance No. 1106 to the December 3, 2013 meeting at 2 p.m.

Mr. Louis Gopher of Seminole Indian Tribe appeared before the Council to explain that the City obtained a quote to replace
the chickee at city hall park for $2800, and Mr, Andy Bowers would like to reimburse the City for the expense.
Need letter from city asking for assistance for the chickee, to put in our files so we can show evidence what the funds where
expended for.
Watford - disclose for the record Mr. Gopher is my son-in-law.
Cook - time frame? Wade Osceola, Joe Dan Osceola is his father, 20 to 30 sq ft to the one you have now. (6x1 0 out there now)
materials are on hand and can start tomorrow, should take less than a week, ready by tree lighting.

Okeechobee City Council approves addition to park

Okeechobee City Council approved an
addition to City Hall Park and started the ad-
ministrative process of accepting a popular
combat helicopter for Veterans Memorial
Park at their meeting Tuesday, Nov.19.
The council approved the replacement of
a chickee at City Hall Park. The Seminole In-
dian Tribe of Florida will reimburse the city
for the expense of the project estimated to
be $2,800. The chickee should be replaced
in time for the annual Christmas Tree Light-
ing Ceremony scheduled for Dec. 3. Louis
Gopher of the Tribe explained the chickee is
symbolic of the tribes' heritage and history.
Wade Osceola will replace the chickee. The
work should take less than one week.
The council approved an agreement with
the Department of Management Services
Bureau of Federal Property to receive the
HH -1 H Huey Helicopter Model 205 that was
recently placed in Veterans Memorial Park.
City administrator Brian Whitehall said
there is still some work to do with the heli-
copter as far as assembly of parts and a paint
job.
Councilman Dowling Watford called it a
great addition to the park.
"I have heard nothing but good com-
ments. We appreciate the city staff for their
hard work on this," he said.
Councilman Devin Maxwell suggested the

continue making holiday pillowcases to
be distributed to St. Mary's, Palms West
and Lakeside hospitals. There will also be
Christmas- themed pillowcase kits avail-

ans Park to ensure there are a maintenance
schedule for the improvements there.
"I'd like for the city to have more involve-
ment to see if it's an unfair burden on the
Legion to make them maintain it. They have
done a lot of work to get the helicopter in
there," he added.
Mr. Whitehall said the veterans are pro-
tective of the park but that maintenance will
have to be done in the park. He said the city
might consider a fence around the helicop-
ter to protect it.
"It might be susceptible to vandalism,
just food for thought," he told the council.
He said he was concerned that someone
was seen on the roof of the helicopter over
the weekend which posed a danger or liabil-
ity to the city.
"We can't have that. We don't have to
discuss it here, but it is food for thought,"
he added.
The council voted to table an ordinance
that would vacate an alleyway for a public
hearing on Tuesday, Dec. 2, at 2 p.m.
The council also approved end-of- fiscal-
year budget amendments requested by city
finance director India Riedel. The city did not
use any reserves to balance the spending
plan. The adjustments included $398,000
from public facilities improvements. The
current budget reserves are $568,580.
The council issued proclamations for James Edward
Farm City Week, Nov. 22 through Nov. 28. achievement as
Jacob Larson of the Okeechobee Farm
Bureau accepted the proclamation. He
explained there are over 1,300 members
of the Okeechobee Farm Bureau. He said
Okeechobee is very blessed to have so much
agriculture that is a large part of the counties
heritage and roots.
The council also congratulated Boy
S +ut Eagle Scout James Edward Bell for his
achievement with a certificate of honor.
The council voted to appoint Melisa Jah-
ner to the City General Employees /OUA Pen-
sion Fund Board of Trustees for a four -year
term, from January 2014 through Dec. 31,
2018.
Boy Scout Troop 913 led the Pledge of Al-
legiance before the meeting.

PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE

WHEREAS, the Comprehensive Planning Act of 2011 requires that the City prepare and transmit
an amendment addressing items identified in the Evaluation and Appraisal Notification
Letter within 12 months of submittal of the letter, said letter having been on September 1,
2012', and
WHEREAS, Staff has prepared proposed amendments addressing items so identified in its
Evaluation and Appraisal Letter; and
WHEREAS, the Planning Board, acting as the Local Planning Agency of the City of Okeechobee,
Florida, recently reviewed the proposed amendments; has discussed same at a duly
advertised public hearing on June 20, 2013, and recommends the City Council transmitthe
proposed amendments to the State Land Planning Agency for review and approval, and
subsequent adoption by ordinance by the City Council; and
WHEREAS, in order to effectively address these recommendations in an orderly manner with the
intent of including all recommendations in a single ordinance, which will save the City and
its citizens costs and time, this ordinance is a compilation of many amendments, which
when adopted, will amend each of the cited code sections upon its effective date.
NOW, THEREFORE, BE IT ORDAINED by the City Council for the City of Okeechobee, Florida;
presented at a duly advertised public meeting; and passed by majority vote of the City
Council; and property executed by the Mayor or designee, as Chief Presiding Officerfor the
City, that:
SECTION 1. The City Council for the Cityof Okeechobee, Florida amends herein the Future Land
Use Element of the Comprehensive Plan by adding Objective 13 and Policy 131,
to read as follows:
ObjectiveI13 The City of Okeechobee recognizes that under certain conditions some uses
of land are not compatible in proximity to public use airports and must be
regulated to reduce or eliminate potential hazards to health or safety.
Policy 13.1 The City of Okeechobee shall adopt airport zoning regulations that:
a. prohibit residential construction and educational facilities in the City to be
located within 2,500 feet of a runway at the Okeechobee County Airport.
b. are consistent with the requirements of See. 333.03(i)(c) F.S.
c. prohibit the location of any sanitary landfill that is:
1) within 10,000 feet from the nearest point of any runway used or planned
to be used by turbojet or turboprop aircraft;

2) within 5,000 feet from the nearest point of any runway used only by
piston -type aircraft;
3) outside the perimeters defined in subparagraphs 1. and 2., but still

d. require notification of the FAA when a structure located within three statute
miles of the Airport Reference Point and will be higher than the distance
from the end of the runway divided by 100 feet.
e. prohibit, inthe interestof airsafetyand commerce, temporary or permanent
structures that do not comply with Federal Aviation Administration rules or
regulations.
SECTION 2. That the City Council for the City of Okeechobee, Florida amends herein the
Intergovernmental Coordination Element of the Comprehensive Plan by adding
Policy 5.5, to read as follows, and renumber existing Policy 5.5 through 5.8 to be 5.6
to 5.9:
Policy 5.5 The City of Okeechobee shall include a representative of the Okeechobee County
School District, appointed by the School Board, as a non -voting member of the Local
Planning Agency (LPA) to attend those meetings at which the LPA considers
amendments to the City's Comprehensive Plan and/or Zoning Map that would, if
approved, increase residential density on the property that is the subject of the
proposed amendment(s).
SEcTioN 3. Conflict. All ordinances or parts of ordinances in conflict herewith are hereby
repealed.
SECTION 4. Severability. If any provision or portion of this ordinance is declared by any court of
competent jurisdiction to be void, unconstitutional, or unenforceable, then all
remaining provisions and portions of this ordinance shall remain in full force and
effect.
Sr=CTION S. Effective Date. The effective date of this plan amendment, if the amendment is
not timely challenged, shall be the date the State Land Planning Agency posts a
notice of intent determining that this amendment is in compliance. If timely
challenged, or if the State Land Planning Agency issues a notice of intent
determining that this amendment is not in compliance, this amendment shall
become effective on the date the State Land Planning Agency or the
Administration Commission enters a final order determining this adopted
amendment to be in compliance. No development orders, development permits,
or land uses dependent on this amendment may be issued or commence before
it has become effective. If a final order of noncompliance is issued by the
Administration Commission, this amendment may nevertheless be made
effective by adoption of a resolution affirming its effective status, a copy of which
resolution shall be sent to the State Land Planning Agency.

- Ordinance #971, adopted 2/20/2007 - Alley Closing Application #85
- Property Owner: InSite Development LLC - Development Name: Southern Trace
- Closed the North to South and East to West alleyways in Blocks 12 and 21, and the East to West
alleyways in Blocks 4, 13, and 20, City of Okeechobee Subdivision.
- Ordinance contained reversionary rights language, Certificate of Occupancy to be issued within 36
months or ordinance is void and alleys are open as of February, 2010.
- Subdivision part of the Hamrick Trust. Owners obtained Quit Claim Deeds upon purchasing the
alleyways from the Hamrick Trust, and have been paying the taxes on them since 2010 for Blocks 12
and 21, and 2011 for the Blocks 4, 13, and 20.
- On May 13, 2011, Mr. Irving Haase contacted our office to find the best solution in resolving the
reversionary clause as he was unable to acquire financial lending due to a clouded title on the alleys. Mr.
Haase went on to say that when he and Mr. Dobbs appeared before the City Council on October 19,
2010, the Council reaffirmed the Site Plan for Southern Trace, and the Developers'Agreement effective
date of January 20, 200.9 term being for 10 years, he was under the impression that this would include
the alleys since they are part of the development site plan. I explained the alley closings were a separate
document, they were not mentioned at the meeting, and suggested he contact Attorney Cook to resolve
theissue.
A few weeks ago, Mr. Steve Dobbs contacted my office on behalf of InSite Development, LLC, explaining
they had not resolved the title issue with the alleys and asked the procedures to amend Ordinance #971
to delete the reversionary rights section. Upon review of the issue with Attorney Cook, proposed
Ordinance #1106 was drafted for City Council consideration.
What has changed since 2007: Property Owners for Lots 4-8 and part of 9 in Block 21.

submitted by Steve Dobbs, on behalf of property owner InSite Development LLC. Easements are being requested
by Florida Power & Light, Embarq and OUA. The property is proposed to be used for a multi - family development.
There were 62 letters sent to surrounding property owners with no response to date.

Mayor Kirk asked whether there were any question or comments from the public? Mr. Steve Dobbs, representing the
applicant, addressed the Council and distributed a revised site plan. The density has changed from 255 units to 238,
and the club house has been removed. Mr. Dobbs reviewed the site plan and was inquiring an acceptance from the
Council of what was presented. Administrator Whitehall interjected that the revised site plan presented will need to
go back to the Technical Review Committee (TRC) for approval. The Council should only be considering the alley
closings at this meeting. Mr. Dobbs noted that was correct and he was not trying to get things out of order, but trying
to respond to the Council's density concerns. Council Member Markham was the one who brought the density issue
to the Council's attention, and in a memorandum submitted by him, he noted that he had reviewed the revised site
plan, as presented, and it appears to be a better solution, he would not object to closing the alleyways with this type
of plan. He also appreciated the applicant decreasing the density. Council Member C. Williams remarked that he has
reservations about the whole project, this area has a lot of these type of apartments already. Council Member Watford
also had reservations, it is a lot of alleys to close at one time, but the issues at hand have been addressed. He also
asked for reassurance from Mr. Dobbs in regards to a reoccurring appearance before the City Council to ask for
Special Exceptions or Variances for this project. Mr. Dobbs understood what Council Member Watford was saying
and stated he wanted this to be a good project and will do everything by the code.
Ms. Mary Hinton, Governmental Liaison of InSite Development, LLC, was present and informed the Council that there
is a need for affordable and attainable housing for professional services, such as nurses, teachers, police officers and
firefighters. She herself is a nurse and so she knows firsthand the need for nurses. She has contacted the School
Board and they have told her of their need for teachers. This project will be able to provide the type of housing with
an option to buy that is needed for these professions and for the area.

Council Member C. Williams moved to approve the first reading of proposed Ordinance No. 971; seconded by Council

Ailey Closing Application No. 85 was submitted by Steve Dobbs, on behalf of property owner InSite Development LLC.
The purpose of the ordinance is to close the East to West and the North to South alleyways of Block 12 and Block 21,
Okeechobee and the East to West alleys of Block 4, Block 13 and Block 20, Okeechobee. Easements are being
requested by Florida Power & Light, Embarq and OUA. The property is proposed to be used for a mufti - family
development.
Mayor Kirk, Council Members C. Williams, L. Williams and Markham noted for the record that they met with the
Engineer (Steve Dobbs) on the project prior to the meeting and reviewed the plans with him to have a better
understanding of the project. Council Member Watford noted that he was only able to speak with Mr. Dobbs briefly
by telephone.
Council MemberMarkham noted the amount of density that will be increased concerned him, specifically the density
per block once the alleyways are closed and the area is reptatted. Basically, an additional 2.64 acres will be added
for the alleys alone. Replatting will allow even more. A Future Land Use Map Amendment and Rezoning must still
be processed as wet. The development will have to meet the minimum lot standard, and the gross density, pervious
and impervious standards. The point is still valid by Council Member Markham, since in essence It increases the
density per block. A Planned Unit Development could be used as a net cluster which is greater density than the
existing lot sizes, as opposed to the project only consisting of one block This development is in the area of the City's
North drainage ditch. Drainage is a burden as it is, but the additional density could put more burden on the drainage
situation. The discussion then focused on how the water flows from one block to another in order to accept run off
since Block 22 is not being proposed for any type of on site retention.
Mayor Kirk noted that with the lake the development has to construct, it appears the City might have better drainage
than with just the alleyways staying there. Council Member Markham responded that yes you have more, but you will
burden the area more with the additional density. You have to hold more water in retention due to the number of units
per acre.
Council Member Watford commented that the density is a good point, this is one of the largest projects, I believe, we
have had to take action on. We may need to look at what we have done for other developments. We have helped
them by closing the alleyways, so the question t need to resolve is, is this any different from any other development
that consisted of one or two blocks?

Council Member Watford remarked that opposing Amendment No. 4 does not take away any rights of the public. They

A potential apartment complex began the development process back in 2006 for Blocks 4,11,12,13, 21 and 22, City
of Okeechobee Subdivision, for 217 multifamily units. The property is located West of North Parrott Avenue, between
Northwest 5°1 and r Avenues and Northwest 11' and 13' Streets, and is approximately 25.11 acres. The company
that owns the property is InSite, LLC. During the process of the rezoning, land use map changes, closing of alleyways
and Site Plan approval, various investors of the development have changed. One owner, Mr. Irving Haase has
remained throughout the process. Mr. Haase is also who signed the final Developer's Agreement.
The project became victim of the economic downtum and was not developed. Mr. Haase now has new potential
investors, and would like to sell InSite LLC and the proposed development as already approved to the new owners.
These new developers can not afford to start the entire approval process back to the beginning, as the project would
not be worth the investment. They are prepared to construct the project as approved by the Technical Review
Committee on September 26, 2007.
The problem is that a Site Plan is only good for two years, according to Code Book Section 70- 348(2), therefore the
Site Plan expired September 26, 2009. However, the Developers Agreement was not approved until January 20, 2009,
with the Site Plan as an attachment. Mr. Steve Dobbs, Project Engineer, is requesting that since the development
could not move forward with a building permit until the Developers Agreement was approved, the Site Plan's effective
date should not be until January 20, 2009 and the agreement is good for 10 years.

Attorney Cook advised that another issue is that the Developers Agreement does not address transfer of ownership.
Should Mr. Haase sell the property to the new investors the Developers Agreement is null and void.
The request being made is for the City Council to reaffirm the Southern Trace Development Site Plan as approved
by Technical Review Committee on September 26, 2007, and that as long as the property remains in ownership of
InSite, LLC, the individual owners can change without having to approve a new Developers Agreement. City Staff had
no objections to the requests, Mr. Dobbs also noted for the record that he was one of the new potential investors for
this project.
Council Member Watford moved to reaffirm the Site Plan for Southern Trace as submitted and approved by Technical
Review Committee on September 26, 2007; and the Developer's Agreement as approved on January 20, 2009;
seconded by Council Member O'Connor.
Council Member O'Connor stressed to Mr. Haase and Mr. Dobbs who stated their understanding, that this approval
is based on no changes to the Site Plan whatsoever.
Attorney Cook concluded that so long as the property remained in the name of InSite, LLC, the legality of the
Developer's Agreement should not be an issue. Therefore, further action on that matter is not necessary.

Model 205 Helicopter. We are requesting the assistance of the Florida Bureau of
Federal Property Assistance to donate this aircraft for museum purposes at our
Veteran's Memorial Park, which is located adjacent to SR 70 and US Hwy 441. This
aircraft will be on display and will not be used for flight or non - flight purposes.
The Veteran's Park is centrally located in our community and will be appreciated by not
only local residents and visitors, but also by others that are passing through our
community.

The Summary `Exhibit' for Budget Adjustments reflects NO use of reserves
for f /y /e 2013. But there are a few qualifiers that deserve attention.
• The City continued to transfer $398,000 from public facilities
• The Gen Fund reporting (for internal budgeting purposes) does not
reflect expenditures in the Capital Improvements Fund. As you know,
the eventual audited financial will combine the Funds for reporting
purposes along with reflecting year to year payables, receivables and
encumbrances.
• Quick review of budget summary:
Beginning of year budgeted reserves use $568,580
Incr revenue as reflected on summary sheet $286,977
Decreased transfer reflected on summary $285,006

project for the side streets that includes donated
trees (Washingtonian palms) from the Goodbreads.
Plan to place the unbudgeted matter on the agenda
for discussion and hope to have some installation
costs identified

RE: Replace Chickee at City Hall Park
• Replace deteriorated Chickee at City Hall Park
on agenda— Spoke to the tribe (Andy Bowers
763 -4128) and, while still have some
confirmation to do, they want to have the City
assume repair (by Wade Osceola (954 -914-
6413) and they will reimburse. Have an est to
completely replace the 8' X 10' hut at $2800
which is suggested by Mr. Osceola. As soon
as the Council concurs w/ the proposition l need to immediately send
confirmation to the Brighton Council of our interest in accepting the
donation.
