1979-10-10 Recessed Meeting RECESSED MEETING WEDNESDAY, OCTOBER 10~ 1979 The City Council of the City of Okeechobee, Florida, convened in a Recessed Meeting in the Council Chambers at City Hall, Okeechobee, Florida, at 7:00 P.M., Wednesday, October 10, 1979. President Edward W. Douglas presiding. Councilmen Oakland Chapman, Jim Knight, Donald Burk and Lytle Raulerson were present. Others present were: David Conlon, City Attorney; Larry Mobley, Police Chief; Sylvia Christian, Deputy Clerk and Janice M. Mann, Secretary. PUBLIC HEARING TAX MILLAGE INCREASE President Douglas called the meeting to order on the Tax Millage increase. ~ Citizen Frank Altobello was present only to listen and educate himself on this matter. Councilman Raulerson explained the tax increase in relation to the budget, and the method of investing surplus funds. Mr. Altobello suggested the City inform the public of the minimal increase, as opposed to the anticipated greater increase. There being no further business or public input, Councilman Raulerson moved to conclude the first public hearing on the tax increase, seconded by Councilman --" Burk, vote carried. RECESSED MEETING NOISE ORDINANCE - DECIBEL METER Mr. Alvin Thompson was present to demonstrate the decibel meter needed to regulate and enforce the Noise Ordinance. Attorney Conlon read by title only for first hearing the proposed Noise Ordinance as follows: AN ORDINANCE OF THE CITY OF OKEECHOBEE, ENTITLED NOISE CONTROL; ESTABLISHING CONTROLS ON EMISSION OF NOISE; PROVIDING DEFINITIONS; MAKING IT UNLAWFUL TO MAKE EXCESSIVE NOISE; REQUIRING MUFFLERS ON ENGINES; PROHIBITING NOISY AND BOISTEROUS CONDUCT; PROVIDING NOISE MEASUREMENT; PERIOD OF OBSERVATION; SETTING LIMIT ON NOISE LEVEL FOR AREAS ZONED RSF, RG-1, RMH, EXEMPTING CERTAIN CONSTRUCTION, AND RG-2, PROHIBITING CERTAIN EXCESSIVE ELECTRONIC AND MUSICAL INSTRUMENT NOISE; AND PROVIDING A PENALTY FOR VIOLATION. After discussion of time limitations, decibels aloud and fines, Councilman Chapman moved to accept the first reading and instruct the City Clerk to advertise 1 second and final hearing of the Noise Ordinance on October 23, 1979, seconded by Councilman Burk, vote carried. 79-93 LAND PURCHASE Attorney Conlon noted the original contract on the land acquisition stated __~ the purposes as being a future parks and recreation site and a future bridge site. However, the Resolution drawn up does not specify for what purposes the land will be used. The contract has expired. Councilman Raulerson moved to authorize a continuance of the contract for purchase of 154 acres in the Northeast quadrant of the City upon the same terms, same provisions and same proposed uses, seconded by Councilman Knight, vote carried. President Edward W. Douglas presiding. Councilmen Donald Burk, Jim Knight, and Oakland Chapman were present. Councilman Lytle Raulerson was absent. Others present were: Bonnie S. Thomas, City Clerk; David Conlon, City Attorney and Sylvia Christian, Deputy Clerk. Y9-5 FEDERAL REVENUE SHARING President Douglas called for comments or objections from citizens present regarding the second and final hearing on the Federal Revenue Sharing. Citizen Susan Ferebee, 802 S.E. 9th Court, inquired as to the paving of City streets. President Douglas informed her the County is responsible for all paving of streets. Citizen Dean Byrd, 1202 S.E. 8th Drive, questioned the budgeted item for Flagler Park. He was under the impression the County maintained all parks. President Douglas informed him the County is responsible for the swimming pool and library, and that the City maintains Flagler Park. There being no further discussion regarding the budgeted outline of Federal -~ Revenue Sharing funds for 1979-80 budget, Councilman Knight moved to accept Federal Revenue Sharing budget as outlined, seconded by Councilman Burk, vote carried.
