NOTICE OF VOLUNTARY WITHDRAWAL AND DISMISSAL
Petitioner City of Okeechobee, by and through its undersigned
attorneys, and pursuant to DOAH Rules 60Q-2 . 036 and 60Q-2 . 037 ,
Florida Administrative Code, hereby files his Notice of Voluntary
Withdrawal and Dismissal, withdrawing their request for hearing and
dismissing with prejudice the claims in its petition in light of a
settlement agreement between the City, Okeechobee County and the
Department of Community Affairs implemented by plan amendments
adopted on December 16, 1993 by Okeechobee County Ordinance No. 92-
05 . The City specifically reserves all rights concerning the
interpretation and application of the adopted settlement agreement
plan amendments. The City further specifically reserves all rights
concerning any other comprehensive plan amendments or amendments to
land development regulations (LDRs) that may be applied for,

proposed, transmitted to the Department for review, challenged, or
adopted by the County in the future.
