As indicated in the transmittal letter by the City attorney, this proposal has not yet been reviewed or approved by the City Council. On June 24, 1993, the Board of County Commissioners unanimously approved a settlement draft which was then forwarded to you for Council review with the hope that either the draft submitted, or a version with minor changes, would be approved. In an effort to prevent endless and expensive rounds of settlement drafts, the Commission would propose that your Council agenda and review both our submission and your attorney's latest offering, with the goal of approving a document that would end the administrative challenge. This process will result in an official settlement proposal from each governing body and all concerned will know what, if any, issues remain to be resolved. Logically, the next step would be to have a "joint session" at the HRS building to iron out any remaining differences between the two documents. Interestingly, our proposed method is precisely that used by the state legislature when the House and Senate versions of a bill differ and must be reconciled. As indicated previously, the Board remains ready and willing to call a special session to meet with the City Council to settle this divisive litigation. Simply give us the date!
