FIRST REGULAR MEETING TUESDA~ JULY 10p 1979
The City Council of the City of Okeechobee, Florida~ convened in a
Regular Meeting in the Council Chambers at City Hall, Okeechobee, Florida
at 7:00 P.M., Tuesday, July 10, 1979.
President Edward W. Douglas presiding.
Councilmen Oakland Chapman and Lytle Raulerson were present. Council-
men Jim Knight and Donald Burk were absent.
Others'present were: Bonnie S. Thomas, City Clerk; LoC. Fortner,
Director of Public Works; Larry Mobley, Police Chief; Keith Tomey, Fire
Chief; Richard B. Spray, Building Official and Sylvia Christian, Deputy
Clerk.
The Invocation was offered by Clerk Bonnie TNomas.
79-1 APPROVAL OF MINUTES
It was moved by Councilman Raulerson to approve the minutes of the
June 21 and 26, 1979, meetings, seconded by Councilman Chapman and vote
carried.
PUBLIC HEARING
79-75. PROPOSED DOG AND CAT ORDINANCE - SECOND AND FINAL READING
President Douglas presented for second and final reading the proposed
Dog And Cat Ordinance. Title only read as follows:

There were no objections from Councilmen or citizens. Councilman
Raulerson moved to adopt the Ordinance as read effective August 1, 1979,
seconded by Councilman Chapman and vote carried.
PUBLIC HEARING
79-76 PROPOSED DISCARDED AND ABANDONED ITEMS ORDINANCE - SECOND AND FINAL READING
President Douglas presented for second and final reading the proposed
Discarded and Abandoned Items Ordinance. Title only read as follows:
AN ORDINANCE REPEALING ORDINANCE NO. 324; BEING AN ORDINANCE DE-
FINING AND REGULATING WASTE MATERIALS AND DISCARDED AND ABANDONED
ITEMS ON-PROPERTY WITHIN THE CITY OF ~OKEECHOBEE. PROVIDING A NEW
DEFINITION OF WASTE MATERIAL; PROVIDING FOR REGULATION OF WASTE
MATERIALS AND DISCARDED AND ABANDONED ITEMS ON PROPERTY WITHIN THE
CITY OF OKEECHOBEE; PROVIDING A PENALTY FOR VIOLATION; AND PRO-

There being no citizens present to voice objections, Councilman
Chapman moved to accept the Ordinance repealing Ordinance #324 as read,
seconded by Councilman Raulerson and vote carried.
79-82 BILL LANCASTER - 7th AVENUE DRAINAGE
Citizens Bill Lancaster and John Everett appeared before the
Council regarding correcting the drainage along 7th Avenue between North
Park Street and North West 2nd Street.
Citizen Lancaster informed the Council they had been before the
County Commissioners regarding the paving of 7th Avenue between North
Park Street and North West 2nd Street. The County Commissioners told
Mr. Lancaster the County would pave the segment of road within sixty (60)
days if the City corrects the drainage.
President Douglas asked Director Fortner if he was familiar with
the area and drainage in question. Director Fortner reported the drain-
age can be corrected by installing culverts with an outlet at the 6th
Avenue storm sewer. An estimate of four culverts would be used.
After lengthy discussion the Council agreed to correct the existing
drainage problem if it does not create another.
PUBLIC HEARING
79-83 BID TABULATIONS - CORRUGATED STEEL CULVERT PIPE
It being the hour of 7:30 P.M., and pursuant to a notice published,
sealed bids were received, opened and read for corrugated steel culvert
pipe.

Rfter the bids were read~ President Douglas instructed Director
Fortner to check the prices, extensions and tabulate.
Director Fortner stated all bid tabulations were correct with low bid
from Florida Steel Corporation. Director Fortner recommended the City
accept the low bid of Florida Steel Corporation.
Councilman Raulerson moved to purchase the items on bid from Florida

Steel Corporation of Tampa, Florida, low bidder, for a total price of Two
Thousand Five Hundred Thirty-Three Dollars and 44/100ths {$2,533.44),
seconded by Councilman Cha~.man and vote carried.
79-$# FRANK PLATT~ DVM - NEW DOG ORDINANCE
Frank Platt, DVM, appeared before the Council to congratulate them on
the passing of the new Dog and Cat Ordinance. He informed the Council he
has heard nothing but praise from individuals.
Dr. Platt questioned the clause regarding vaccination, noting it states
pets are to be vaccinated within Sixty (60) days prior to licensing. This
may cause some problems.
President Douglas informed Dr. Platt this matter had been discussed at
a Workshop. If pets are vaccinated prior to the Sixty (60) days, the owner
needs only to present a record of vaccination to purchase tags at the City
Clerk's office.
Dr. Douglas called for any comments from citizens in the audience.
Citizen Paul Mims spoke up in regards to the new Dog and Cat Ordinance,
as to why it was enacted in the City.
Councilman Raulerson stated because of the growth of the City and the
increase in the animal population, it has become necessary for the City tb
create and adopt such an ordinance.
Mr. Mims felt the ordinance was unfair. He noted that Councilman
Knight has cattle pastured within One Hundred (100) feet of Mr. Mims'
residence and President Douglas has horses in his yard even though the City
has a livestock ordinance. However, Mr. Mims realizes there is a problem
and something needs to be done, but feels the new ordinance is too strict.
President Douglas stated because of the problem, the City had to
begin somewhere with some type of program. In time the City may find some
of the provisions unnecessary. For now, though, this is a good beginning.
79-7~ COMMUNICATIONS FROM DEPARTMENT HEADS
A. BUILDING OFFICIAL
Building Official Spray presented the quarterly report for the Building
Department.
B. POLICE CHIEF
1. BOAT REGULATION
Police Chief Mobley read a boat regulation regarding Steve Nelson's
previous complaint. The regulation read as follows:
RECKLESS OR NEGLIGENT OPERATION OF VESSEL
It is unlawful to operate a vessel in a reckless manner. A person
is guilty of reckless operation of a vessel who operates any vessel,
or manipulates any water skis, aquaplane, or similar device in will-
full or wanton disregard for the safety of persons or property, or

without due regard, caution and circumspection, or at a
speed or in a manner as to endanger, or likely to endanger,
life or limb, or damage the property of, or injure any person.
Chief Mobley stated anyone caught would be in violation of Florida
statute 371.50. Enforcement of this is Statute 371.67. The problem
still lies in enforcement.
79-74 2. ACTIVITY REPORT
Chief Mobley presented the Police Department Activity Report for the
month of June, 1979.
C. FIRE CHIEF
1, Chief Tomey presented the Fire Department Activity Report for the
month of June, 1979. He also presented a breakdown of Voluteer pay for
training and fire responses.
2. TRANSFER OF BUDGET FUNDS
Chief Tomey brought up again for discussion, the matter of taking
funds budgeted to salaries and transfering them to the Fire Department
General Fund. this will enable him to save expenditures on next year's
budget.
Chief Tomey informed the Council he had gotten the opinions of the
City Attorney and the auditor from Ft. Pierce, on this matter. They saw
no problem. The City Clerk has on file a letter from the auditor stating
a fund transfer of this kind could be done at the descretion of the
Council, by budget amendment. Chief Tomey requested a transfer of Thir-
teen Thousand Three Hundred Fifty Dollars ($13,350.00).
Chief Tomey presented itemized lists showing where these monies are
to be spent.
In regard to the cleaning and painting of the Station, Councilman
Raulerson requested to see specifications from the painters bidding on the
project before any decision be made. There is too great a discrepency in
the bids.
After discussion, Councilman Raulerson moved to amend the budget to
transfer salary budgeted funds to the Fire Department General Fund in the
amount of Thirteen Thousand Three Hundred Fifty Dollars ($13,350.00} to
be used on the list of items submitted by the Fire Chief, with the under-
standing that any items not received and paid for by October 1, 1979, will
be deleted from khe lisk, and the Council withhold the items of cleaning
and painting of the Station and the Incoder and Motorola pagers at this
time, seconded by Councilman Chapman and vote carried.
D. DIRECTOR OF PUBLIC WORKS
1. MEMORANDUM #1
Director Fortner presented Memorandum #1 requesting a concrete slab
at the City Barn to put pipe and fittings on. This will eliminate the
problem of weeds and grass. The slab will be poured for possible use of a
building in the future.
Councilman Raulerson moved to authorize construction of a concrete
slab for pipe and fittings in the amount of One Thousand Eight Hundred
Dollars ($1,800.00), seconded by Councilman Chapman and vote carried.
2. MEMORANDUM #2
Director Fortner presented Memorandum #2 requesting the purchase of
an air blower and three (3) dozen smoke bombs to test for leaks in sewer
lines, locate and repair them.
Councilman Chapman m~ved to authorize purchase of an Air Blower and
Three (3) dozen smoke bombs in the amount of Four Hundred Fifty-Nine and
20/lOOths Dollars ($459.20) paid out of equipment budget, seconded by
Councilman Raulerson and vote carried.
3. MEMORANDUM #3
Director Fortner presented~Memorandum #3 regarding the rising Sewer
Plant Lab expenses. Chemical prices are increasing. With the purchase of
a Dissolved Oxygen Meter and a Dissolved Oxygen Probe the cost of tests will
be cut considerable.
Public Works Department has Five Thousand Dollars ($5,000.00) budgeted
for lab equipment.
Councilman Raulerson moved to authorize the purchase of a Dissolved
Oxygen Meter and a Dissolved Oxygen Probe in the amount of Five Hundred Forty-
Six Dollars ($546.00), seconded by Councilman Chapman and vote carried.
4. MEMORANDUMS #4 and #5
Memorandums #4 and #5 were presented regarding fill dirt and shell for
South West 18th Street at South West 5th Avenue and for North West 7th Avenue
and North West 7th Street.
The prices include delivery by Rock-a-Way. Director Fortner suggested
the Council consider putting in fill dirt now, then shell at a later date.
Director Fortner noted, to this date, he had only been able to get a bid from
Rock-a-Way.
Councilman Raulerson recommended, since the bid was so high, to rent
additional trucks to be used along with the two City dump trucks and loader.
The Council instructed Director Fortner to work out the cost, then resubmit
at a latter date.
5. ACTIVITY REPORT
Director For2ner presented the Water, Sewer and Street Department
reports for the month of June, 1979.
79-14 6. CLEARWELL LEAKS
President Douglas asked Director Fortner if all the leaks in the clear-

well were taken care of. Director Fortner informed him they were not. The
leaks occur sporadically.
Councilman Raulerson inquired as to who was responsible for the leaks.
Director Fortner stated it wa~ the contractor's responsibility. Engineers
say the clearwell is Structurally sound, as to why it leaks no one has been
able to d~termine.
Councilman Raulerson felt the trouble was in the original pouring of
the concrete, poured too slow. Director Fortner noted they tried to repair
the leaks with a flexible bonding agent, but with minimal success.
79-9 7. HOSFITAL CORPORATION OF AMERICA
Director Fortner informed the Council he now has the First Amendment
to the Sewer Line Agreement, a Bill of Sale and an Easement from the Hospital
Corporation of America, on their sewer line and lift station.
The Agreement has been signed by the Hospital Corporation of America,
all that is needed are the signatures of the City. The Bill of Sale trans-
fers it all over to the City, and City acceptance and signatures are needed.
The Easement for the Lift Station on hospital property, which has been signed
by HCA.
The City Attorney had reviewed these documents prior to the Meeting and
informed Director Fortner they were all in order.
Councilman Raulerson moved to authorize the signatures of President
Douglas and City Clerk Thomas on the Agreement and Contract of the Hospital
Corporation of America, seconded by Councilman Chapman and vote carried.
E. CITY CLERK
79-85 1. AUDIT ON MOTOR FUEL TAX
Clerk Thomas informed the Council that from June 18 thru July 5, 1979,
the City underwent an audit for motor fuel tax. This was the first audit
of its kind pertaining to the City's motor fuel records completed by the
State Department of Revenue.
Results turned up ~efunds due to the Department of Revenue for dZesel
used in one fire truck totaling One Hundred Thirteen and 23/100ths Dollars
$$113.23) which includes penalties and interest, and an over-all refund on
general fuel totaling Thirty-Eight and 70/100ths Dollars ($38.70) for the
three years audited.
When asked for suggestions regarding the City's record keeping system
for motor fuel use, the tax e~aminer stated that without exception, the City
of Okeechobee's records were the most complete, with all records readily
available, that he had ever audited in his many years of service.
The reason for the error concerning the diesel fuel in the one fire
truck was due to being unaware of any requirements pertaining to diesel fuel,
since there was no place indicated on the State's fuel report for this.
Diesel requires a different application and report form which the auditor
left with Director Fortner for completion and submitting to the State
Revenue office.
2. DICTAPHONE
Clerk Thomas presented a request to purchase a dictaphone from
State Burchasing identical to the one purchased and used by the Police
Department. If ordered by the end of July, 1979, the purchase price is
Two Hundred Twenty-Two Dollars ($222.00).
Councilman Raulerson moved to authorize the purchase of the dicta-
phone in the amount of Two Hundred Twenty-Two Dollars ($222.00), seconded
by Councilman Chapman and Vote carried.
3. OCCUPATIONAL LICENSING
Clerk Thomas addressed the Council with two questions regarding oc-
cupational licensing.
On a peddlers license, since a peddler is transient, should they be
charged the full amount or can they be sold a half-year's license. Check-
ing the City Ordinance, there is a clause that States the City can sell a
half year's license and it does not exclude any catagory.
The second question pertains to presenting proof of qualifications
before issuing occupational license. Specific case came up with a citizen
wanting to purchase a license for psychologist. Clerk Thomas did not issue
the license because the office was unable to reach Building Official Spray
for approval.
To prevent just anyone applying for aR obtaining certain occupational
linceses, can the City Clerk's office require some sort of credentials or
certificate of qualifications, before issuing license.
It was brought to the attention Of the City Clerk that there is a
clause in the Ordinance that requires proof for certain licenses, so it can
be enforced.
79-68 4. COPY OF RESOLUTION - COUNTY vs. HUMANE SOCIETY
Clerk Thomas presented copies of the Resolution between the County
and the Humane Society, as requested by the Council at the last meeting.
This will enable tham to read and study it prior to discussion at a
la~er da%e.
79-26 5. PLANNING BOARD RECOMMENDATION
Clerk Thomas presented the Planning Board recommendation on the re-
zoning request of Dr. Hussain for Lots 21 and 22, Block 2, from Holding to
RG-1.
The Planning Board advises the City Council to reject this request,

which is not in the best interest of the City in complying with it's
comprehensive plan.
79-71 COMMUNICATIONS FROM COUNCILMEN
A. EDWARD W. DOUGLAS
l. RESOLUTIONS FOR CONSIDERATION
President Douglas presented the Resolutions regarding easement, per-
mission to install chain link fence. Resolutions read as follows:
BE IT RESOLVED by the Council of the City of Okeechobee, Florida,
That:
UPON THE REQUEST of Becky McGee to install a chain link fence on
that portion of the City's easement and alleyway that abuts her property
known as Lots 9 and 12 of Block 13, of Wright's Subdivision located in
the City of Okeechobee.
WHEREAS, Becky McGee has appeared before the Council and acknow-
ledged that if granted the temporary right to install a chain link fence
upon said easement, she agrees that this in no way is an abandonement or
release of the City of any of it's real property interests in said alley-
way.
NOW THEREFORE, the City Council grants temporary permission to
Becky McGee to install and connect her chain link fence across said ease-
ment and alleyway.
DONE this 10th day of July, 1979.
BE IT RESOLVED by the Council of the City of Okeechobee, Florida,
That:
UPON THE REGUEST of Donald Bullard to install a chain link fence on
that portion of the City's easement and alleyway that abuts his property
known as E½ of Lot 10 and Lot 11, Block 13, of Wright's Subdivision
located in the City of Okeechobee.
WHEREAS, Donald Bullard has appeared before the Council and acknow-
ledged that if granted the temporary right to install a chain link fence
upon said easement, he agrees that this in no way is an abandonement or
release of the City of any of it's real property interests in said alley-
way.
NOW THEREFORE, the City Council grants temporary permission to
Donald Bullard to install and connect his chain link fence across said
easement and alleyway.

Councilman Raulerson moved to accept the two Resolutions as read
granting permission to install the chain link fence, seconded by Councilman
Chapman and vote carried.
President Douglas presented the Resolution regarding the Fire Hydrants.
Resolution read as follows:
BE IT RESOLVED BY the Council of the City of Okeechobee, Florida,
that;
WHEREAS, the City of Okeechobee operates a water system within and
without the limits of the City of Okeechobee, and;
WHEREgS, the system contains numerous fire hydrants, both within and
without the corporate limits of the City of Okeechobee and;
WHEREAS, the City is required to collect and pay a yearly rental/use
fee of $120.00 per fire hydrant regardless of where located, and;
WHEREAS, the City is willing and has always paid the charge for all
hydrants located within the City limits, and;
WHEREAS, the City does not desire to incur the rental/use expenses
of fire hydrants beyond it's corporate limits, and;
WHEREAS, it is in the best interest of the public safety that new
extenti0ns of the City's water lines include new fire hydrants,
NOW THEREFORE, be it resolved that until such time as a satisfactory
assurance of payment for the usage charge of all fire hydrants lying out-
side the limits of the City of Okeechobee can be made, it is deemed in the
best interest of the public safety that no further extentions of the City's
water lines shall be made.
DONE this 10th day of July, 1979.
Councilman Chapman moved to approve the Resolution on Fire Hydrants as
read, seconded by Councilman Raulerson and vote carried.
79-36 2. STREET LIGHTS
In regard to street lights that are out, Councilman Chapman sug-
gested earlier that the policemen on patrol report the lights to the
dispatcher who in turn will notify the Clerk's office. Councilman Chapman
spoke with Chief Mobley prior to this meeting and the Chief agreed with
this.
President Douglas instructed Councilman Chapman to have Chief Mobley
send a memorandum to his men to begin reporting the street lights that are
out.
B. LYTLE RAULERSON
Councilman Raulerson voiced a complaint regarding semi trucks parking
on Highway 70. It is a traffic hazard. He notified the police department
but no one was dispatched to move the semi trucks.
Councilman Chapman stated he would discuss the matter with Chief
Mobley.
C. OAKLAND CHAPMAN
Councilman Chapman reported that dead animals are not being picked up
promptly. The policemen are not responding to the calls.
Councilman Chapman stated there is a lack of communication in the
police department. President Douglas stated he would look into this matter.
