The City Council of the City of 0keechobee, Florida, convened in a
Recessed Session in the Council Chambers at the City Hall, Okeechobee,
Florida, at 7:00 P.M., Thursday, March 22, 1979.
President Edward W. Douglas presiding.
Councilmen Donald Burk, 0alkand Chapman, Jim Knight and Lytle Rauler-
son were present.
Others present were: L. C. Fortner, Jr., Director of Public Works;
David Conlon, City Attorney; Bonnie S. Thomas, City Clerk and Sylvia
Christian, Deputy Clerk. --~
79-6 KELLEY TRAILER PARK - SEWER
Mrs. Marvin Wherrell appeared before the Council mequesting that the
two (2) years mentioned in paragraph seven (7) be changed to ten (10) ~
years, pertaining to reimbursement.

Following discussion Councilman Burk made a motion to extend time
from two (2) years to eight (8) years, and stipulate that it could be
extended by the Council at that time, seconded by Councilman C~man
and vote carried.
Councilman Burk also moved that when the document is corrected and
executed that President Douglas sign, seconded by Councilman Knight and
vote carried.
79-27 FIRE CHIEF APPLICANTS
The following applicants for Fire Chief were present for fifteen (13)
minute interviews with the Council:
1 - Louis Keith Tomey, 0keechobee, Florida.
2 - Thomas W. McConnell, West Palm Beach, Florida.
3 - Edgar R. Hines, Boynton Beach, Florida. Not present.
4 - Alan V. Lewis, Belleglade, Florida.
A Workshop will be held at a later date to interview remaining applicants.
79-40 S~WER SYSTEM - CAPACITY
Director Fortner discussed with the Council the following items per-
raining to the Sewer System. Memorandums on file in the Clerk's Office:
Sewer Flows in Gallons per day. Twelve (12) month review.
2.Approved allocations of Sewer Plant Capacity.
Requests not allocated.
4. Actual gallons used by Royals, U-Save, New Hospital, Kelley Trailer
Park and Leggetts Trailer Park.
5. Total allocated flows.
6. Total of actual usage for February, 1979.
Director Fortner informed the Council that there is a six (6) month
moratorium hold on any new users from November 28, 1978 to May 28, 1979.
Attorney Conlon suggested that some sort of policy be drawn up. It
was suggested for a sewer form to be brought before the Council and estab-
lish permits.
Discussion insued on setting a limit of gallons used in new buildings.
Councilman Burk suggested not exp~nding outside City Limits, and extend
moratorium through July.
Attorney Conlon presented a rough draft for a Resolution that until
~urther study and review determines otherwise, it is in the best interest
of the public's health and safety that no further addons or tap-ins be per-
mitred to it's sewer systems beyond the corporate limits of the City of
0keechobee. Also, that within the City Limits of the City of 0keechobee,
tap-on consistency of less than one thousand (1,000) gallons per day will
be permitted upon proper written application executed by the Director of
Public Works. Any application for more than one thousand (1,000) gallons
per day use must be presented to the City Council.
Attorney Conlon will review the Hospital Corporation contract and
draw up a Resolution for the Council.
79-30 PARK
President Douglas brought to the Councils attention that at the
meeting of March 8, 1979 the Council approved to move all downtown park
festivities from the first park to the fourth park. The Chamber of
Commerce is requesting it be changed to either the second or third park.
They prefer the second park.
Director Fortner recommended a four inch water line for the park.
Director Fortner agreed to check possibilities as to which park would
be more convenient to run water to and the cost thereof.
79-28 PROPERTY- 1~4 ACRES
Attorney Conlon informed the Council that he has sent off a proposed
a~reement to the Macomb Land Company. The Attorney suggested for the
Council to have the property appraised.
Councilman Raulers~n informed the Council that he had read in the
Okeechobee News published the 8th and 15th of February where Haynes E.
Williams~ Registered Real Estate Broker, had it advertised for Two
thousand seven hundred ninety five dollars ($2,795.00) per acre.
Councilman Raulerson is to contact two (2) appraisers and report his
findings at the meeting of March 27, 1979.
79-26 PLANNTN~BOA~D
Attorney Conlon informed the Council that the Zonin~ Ordinance pro-
vides that a City Employee can be the Planning Board Secretary. He sug-
gests that the Council make the City Clerk the Secretary and all the Clerks
as her assistants.
Councilman Knight made a motion to appoint the City Clerk as Planning
Board Secretary and for her to appoint the Clerk of her choicer seconded
by Councilman Burk and vote carried..
Clerk Thomas stated that Shirley Till was the one most capable and what
pay would the Council approve.
Councilman Burk moved to pay the appointed person Twenty fi~e dollars
($25.OO) per month, and anything over that she will be paid overtime~ sec-
onded by Councilman Chapman and vote carried.
79-~1 WHERRELL BUILDING
Councilman Raulerson informed the Council that someone requested a
license to set up a furniture store in the old Wherrell Building and was
refused because the Building is in litigation. As of December 1977 the
case has been dismissed. A license cannot be refused to open a business

in the building unless it has been condemned unsafe and unhealthy. The

Mr. Spray to go back for a reinspection and reestablish the condemnations.
The Attorney should be consulted for his legal opinion on auy
question that might cause conflict.
Following a lengthy discussion Councilman Knight moved to authorize
the City Clerk to issue license on Wherrell Building after she receives
notification from Attorney Conley that the case has been dismissed, sec-
onded by Councilman Raulerson and vote carried.
Councilman Burk opposed.
