1978-12-05 Regular Meeting2364 FIRST REGULAR MEETING TUESDAY~ DECEMBER ~, 1978 The City Council of the City of 0keechobee, Florida, convened in Regular Session in the Council Chambers at the City Hall, 0keechobee, Florida, at 7:00 P.M., Tuesday, December 5, 1978. President Pro-Tem Edward W. Douglas presiding. Councilmen Lavon Bass, Jim Knight and Lytle Ra~lerson were present. Others present were: L. C. Fortner, Jr., Director of Public Works; Larry Mobley, Police Chief; David Conlon, City Attorney; Sylvia Christian, Acting City Clerk and Lola Parker, Deputy Clerk. The Invocation was offered by Councilman Jim Knight. ORDINANCE NO. 406 - LEVYING OF TAXES - FINAL READING Councilman Raulerson moved to adopt "An Ordinance providing for the levying and collecting of Taxes for the City of 0keechobee, Florida, for the fiscal year beginning October 1, 1978 and ending September 30, 1979, seconded by Councilman Knight and vote carried. ODOR FROM SEWER PLANT Mr. Ken Adams and Howard Murphy appeared before the Council reg~rding the odor from the Sewer Plant. Director Fortner stated the lack of help is part of the reason be- cause maintenance can not be kept up. Councilman Douglas informed Mr. Adams and Mr. Murphy that steps wo~ld be taken to correct this problem. PROPOSED SUBDIVISION PLAT Mr. Charles Allen Robertson appeared before the Council with a proposed Mobile Home Subdivision within the incorporated unplatted area of the City of 0keechobee. The zoning calls for 15 acreas but they have 5. Located behind the Grace Brethren Church. Dr. Bartley will have to be consulted as to whether or not 5 acreas will be adequat. Following a lengthy discussion Councilman Douglas stated he or Attorney Conlon will get in contact with Dr. Bartley to find out what is allowable. LEASH LAW Mr. Steve Nelson appeared before the Council to complain about the do~ problem in 0keechobee Estates. He asked the City to pass a leash Ordinance and enforce the Ordinance. Following a lengthy discussion Attorney Conlon to review Ordinances in other Cities to find best way to handle this problem. Mr. Nelson also stated the brid~e on South East 8th Avenue is to narrow. 2365 Councilman Douglas informed Mr. Nelson he would have to contact someone with the County on this matter. CANVANSING THE CITY 19.78 ELECTION RESULTS President Pro-Tem Edward W. Douglas announced that the Council would sit as a Ganvansing Board to canvass the election returns of the General City Election held December 5, 1978. The following is the count in accordance with the talley sheet as presented by official Election Clerk, Violet B. Briney and upon motion by Councilman Jim Knight seconded by Councilman Lytle Raulerson and unanimously carried, the count was accepted as per talley sheet prepared by the Official Election Board: FOR 10ITY CLERK Zary Ann Lightsey 170 Ida Mas McDuffie 155 Bonnie S. Norton 68 Sam Thomas, Sr. 110 Harold Turner 130 RESOLUTION Upon a motion by Councilman Knight and a second by Councilman Raulerson and vote carried the following Resolution was adopted. WHEREAS, the City Council of the City of 0keechobee, Florida, sitting as a board of canvassers, has canvassed the returns of the General City Election held December 5, 1978, and WHEREAS, Donald L. Burk, Oakland Chapman and Edward W. Douglas received the highest number of votes for Councilmen and Bonnie S. Thomas received the highest number of votes for City Clerk. NOW THEREFORE, BE IT RESOLVED, that Donald L. Burk, Oakland Chapman and Edward W. Douglas be, and they are hereby declared elected for four (4) years as City Councilmen; and that Bonnie S. Thoams be, and she is hereby declared elected City Clerk for four (4) years. BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby in- structed to issue and deliver certificates of election to each of the above persons. PASSED AND ADOPTED in Regular Session this 5th day of December, A.D. 1978. 2366 FIRE DEPARTMENT 1. MONTHLY REPORT The Fire Department Report for the month of November, 1978 was submitted. WATERy SEWER AND STREET DEPARTMENTS 1. MONTHLY REPORT Director Fortner submitted the Water, Sewer ~d Street Departments __~ Report for the month of November~ 1978. 2. SHELL FOR NORTH WEST 3RD STREET BETWEEN ~TH AND 10TH AVENUE Director Fortner informed that shell would have to be hauled to North West3rd Street between 9th and 10th Avenue. Shell from the County costs $3.00 per load. 565 Tons Shell at $3.00 Ton = $1,695.00 Delovered by Rock-A-Way Trucks 565 Tons Shell at $1.75 Ton = $988.75 Delovered by City Trucks 450 Cu. yards = 90 Loads Councilman Raulerson stated to put County Shell on bottom layer and top with good shell and let Rock-A-Way haul good shell for top. Following discussion Councilman Raulerson moved to lay 45 loads of County Shell and 45 loads of shell from Rock-A-Way with them delivering, _-~ seconded by Councilman Knight and vote carried. 3. EMPLOYEE EVALUATION Director Fortner informed that Klm Marshall at the Water Plant is training new men and is making less money tbsn bis trainee. He recom- mends~!to promote Kim Marshall to Lead Operator with salary increase of $750 per year. Following discussion Councilman Knight moved to table any action until the matter can be s~udied, seconded by Councilman Raulerson and vote carried. 4.WATERWORKS IMPROVEMENTS - RESERVOIR ADDITION - CONTRACT NO. ESTIMATE Np,. ~ . Director Fortner submitted request for Pay Estimate No. 5 from LaGrow Irrigation fin the amount of Twenty-four Thousand Six Hundred Sixty-six and 30/100 Dollars ($24,666.30) for Clearwell. Following discussion Councilman Raulerson moved to pay Estimate No. 5 in ~hs amounfl o£ Twenty-four Thousand Six Hundred Sixty-six and 30/100 Dollars ($2~666.30)'~to LaGrow Irrigation, seconded by Council- man Knight and vote carried. 2367 CITY CLERK 1. SCHEDULE OF REGULAR MEETINGS The Regular Meetings of the City Council are to be as follows: January 9th and 25rd, 1979 February 13th and 27th, 1979 March 15th and 27th, 1979 Motion by Counc~ilman Knight and sec~nad by Councilman Raulerson to accept meeting dates. DISBURSEMENTS Vouchers on the following funds were approved: Water & Sewer Operation & Maintenance Fund $54,359.40 Water & Sewer System Revenue Fund $2,024.99 Water & Sewer Revenue Fund $79,063.52 Anti-Recession Fund $91.72 General Fund $27,472.58 ADJOURNMENT There being no furtner business, the Meeting Recessed at 9:00 P.M. until l:00 P.M.
