Item 1 (NW 9th AVE RR crossing maintenance of the roadway/tracks)
The initial email was sent to Kay and I regarding the outstanding invoice of $62,042.33 for repairs to
railroad crossings (location is not provided) — see email thread below.
This issue was on the Nov. 27, 2018 agenda and withdrawn.
It was also on the Mar. 7, 2017 agenda with a copy of the 1992 agreement the city entered into for
repairs at NW 9th AVE. In 2015 CSX billed the city $38,000.00 for repairs to this crossing. The
ACTION at this meeting was to terminate the 1992 agreement & refuse to pay the invoiced amount as
CSX did not follow the instructions per the 1992 agreement nor did they use the proper materials per
the agreement when they fixed the crossing in 2015. 1 have several emails from 2017 to 2018
requesting a copy of the notice the city sent to CSX to notify them of the termination, & do not have
any document to date except for a letter from Cook to CSX dated A13r. 27, 2015 where he told them of
his plan to recommend the issue go on the agenda for the city council to rescind the 1992 agreement
and present the request for the $38,000.00 to see what the council would decide. Was an email or
correspondence provided to CSX after this issue was withdrawn from the Nov. 27, 2018 agenda?
Marcos/David, should any of this be provided to the new attorney? If not, whomever replies from the
City, kindly provide a copy to my office for the file/record.
Item 2 (NW 9th AVE RR signs & markings)
Nov. 29, 2000 letter from FDOT Rail Administrator explaining they are recommending CSX update
the existing signs with new flashing lights & gates at NW 9th AVE, with the city constructing a concrete
curb, the city would be required to assume 50% of the annual maintenance cost of the devices,
$1,549.00/yr. On Jan. 16, 2001 the council authorized FDOT Rail Administrator to prepare the
necessary contract for further consideration, does anyone have a copy of this contract? The file has a
letter dated Oct. 9 2003 from FDOT Rail Administrator to D. Robertson explaining that the city agrees
to provide curb & gutter & install proper advance railroad signs and pavement markings once CSX
completes all the signage work. FDOT was responsible for all costs for the RR signal devices as
constructed by CSX; and that the city shall have no future maintenance responsibility for signal
devices, only maintenance for the signs & markings. Then there is a letter from D. Robertson Nov. 12,
2003 to CSX agreeing to these terms.
Item 3 (mowing, trash & weed removal at Site #1 N Parrott AVEI'Hwy 441 @train station; Site #2
Up -Town Track [NW 7th AVE from NW 7th ST to North Park ST]; Site #3 NW 9th AVE crossing
[200 -ft out from edge of crossing])
Mar 2, 1995 the city entered into a contract to mow & clean the RR IR -O -W at these sites for $4600.00
per year. Mar 1, 2002 was increased to $5,200.00/yr. Last correspondence was on Jul 20, 2004, the
city was notified that that current contract would be cancelled Dec. 31, 2004 and a new agreement
will have to be negotiated for 2005 and beyond. Does anyone have a current contract?
If anyone needs copies of these records let us know.

I am responding to your letter about the City's cost of$1975,associated with NW 9th Street maintenance
agreement.
As indicated in your letter,the City wishes to explore alternate alternatives associated with the cost and
consider the following in our discussion:
• As late as 2004, CSX paid the City$5200 to mow and maintain the same property. CSX
cancelled that agreement as of December 31, 2004 with the concept that a new agreement would
be negotiated for 2005. No Agreement was ever renegotiated.
• As part of street maintenance,the City wishes to have the tracks removed on NW rd Street(from
Hwy 70 to north of NW 2nd Street. This will help with road condition and cleanup. If the tracks
cannot be removed,the road surface still needs to be addressed. In addition thereto,there needs to
be track blocks installed to stop any car from running off the tracks.
• NW 6th Street intersection with RR crossing needs to be addressed as the surface is bumpy. .
• WE plan on removing the tracks at SW Park Street,as it is my understanding that CSX has
abandoned same.
• There is much debris on both sides of the track,particularly north and south of NW 6th Street that
needs to be removed, so that mowing can be accomplished and the area is no longer an attractive
nuisance.
• The track area north of Hwy 70 also needs to be cleaned up. It's my understanding that DOT used
the property in connection with the recent resurfacing project.
Please plan to discuss these related issues when we can review the matter, at your convenience.

Dear Mr. Robertson:
This is to follow up on our meeting of October 2, 2003, regarding the proposed signal upgrade at N.W.
9* Avenue.
Based upon our discussion at this meeting,the City of Okeechobee has agreed to provide curb and gutter
and installation of proper advance railroad signs and pavement markings, once CSXT has completed all
signal work. The Department will be responsible for all cost for the railroad signal modifications, as
constructed by CSXT. The City shall have no future maintenance responsibilities for the signal devices,
only maintenance for the signs and markings.
Following the meeting we reviewed the crossing with Mr. Robertson and Mr. Bermudez to make sure
that we all understand the work that is needed and to discuss other details at the project site. I am
providing the enclosed drawing detailing the proposed curb and gutter construction. and also a copy of
FDOT Standards for signing and markings, for your review and comment.
Your cooperation in providing your written concurrence for this project by November 10. 2003 is
appreciated. We look forward to working with the City to complete these needed railroad crossing
safety improvements and appreciate your participation. Should you have questions or need further
assistance, please let me know.

B. Discuss NW 9th Avenue railroad crossing signal upgrade - City Administrator Veach advised the Council that the City had received a letter from the Department of Transportation
Administrator (Exhibit 2). explaining that the railroad crossing located at Northwest 9111 Avenue falls in line with a grant available to upgrade the
crossing signal. The City would be responsible for the street upgrades that would have to be done, and share with the
future maintenance of the crossing signal. Staff needs Council direction whether they wish to proceed with the project.
The Council had some reservations regarding this issue. However, until DOT is given the authority to draw up the
necessary agreement, Staff does not have any specific's regarding the project.
Council Member Oliver moved to authorized DOT to prepare the necessary contract and forward it to the City
for further consideration: seconded by Council Member Williams.
Mayor Pro-Tem Watford asked Administrator Veach to handle this.

This is to advise you that we have completed our annual signal safety diagnostic team field
reviews for the 2001/2002 Signal Safety Program, involving the subject crossings. We have
determined the following recommendations, as indicated on the attached reports, should be
considered.
1. Crossing No. 628055B, N.W. 9th Avenue
CSX Transportation to upgrade existing signals with new flashing lights and gates. In an
effort to provide better visibility of the devices, by installing them closer to the roadway,
we are requesting that the City construct concrete curb as shown on the enclosed
diagnostic sketch.
NOTE: The City will be required to assume 50% of the annual maintenance cost of the
devices. In accordance with the attached schedule of maintenance costs, the City's cost
will be $ 1,549.00 annually.
2. Crossing No.: 621522M, S.E. 40th Avenue
City of Okeechobee should upgrade railroad advance signing and pavement markings in
accordance with FDOT Standard Index 17882.
The subject program is federally funded with limited funds allocated to and administered by the
State to reimburse the railroad companies for signal improvements. Due to statewide demand,
and in an effort to upgrade as many crossings as possible, we request that the local agencies
install and maintain any necessary roadway improvements.
