CHAIRPERSON PRO-TEM BRASS OPENED THE PUBLIC HEARING AT 6:03 P.M. A. Application No. 13-001-SSA submitted by Okeechobee Asphalt and Application No. 13-001-SSA, submitted by Okeechobee Asphalt and Ready Mixed Concrete, Inc., is requesting to Ready Mixed Concrete,Inc.,is requesting to change the Future Land change the Future Land Use(FLU)classification from Single Family to Industrial on Lots 1 through 5 and 7 through 12 Use classification from Single Family to Industrial on Lots 1 through of Block 44, City of Okeechobee, together with a 0.413 acre unplatted parcel, located in the 700 and 800 blocks of 5 and 7 through 12 of Black 44,City of Okeechobee,together with a Northwest 9th Street. 0.413 acre unplatted parcel,located in the 700 and 800 blocks of NW 91h Street(Exhibit 1). 1. Hear from Planning Staff. Chairperson Pro-Tern Brass yielded the floor to Planning Consultant Brisson who reviewed the application highlights and pointed out there had been a mapping error with the FLU and Zoning maps, and some copies may be incorrect. These parcels have been discussed as conflicts between the FLU and Zoning maps at a workshop held last year.The consensus of the Board at that time was to change the FLU and Zoning to Industrial for Lots 7 through 12 of Block 44, and the 0.413 acre parcel due to the contiguous proximity to the railroad and that the depth of the lots made them unsuitable for residential use. For Lots lthrough 5 of Block 44, the consensus was to change the FLU to Multi-Family due to the long time resident and owner of Lot 6 having the right to expect that the other lots would be used for residential purposes. Planner Brisson explained that the Board should base their decision on the Planning Staff report,the application,their discussion,and what is presented during the Public Hearing,in addition to the fact that a Petition for a rezoning of these parcels is to follow. Board Member Ritter questioned the recommendation for Industrial on Lots 7 through 12 as these were located adjacent to the residential ones and suggested there should not be an encroachment to the residential area. Board Member Baughman questioned the fit of residential in this area,where there are so many Industrial uses and in trying to keep the consistency within our Land Use and Zoning. Since there are Industrial uses all around this area, in order to keep it consistent, it should be Industrial, adding there is a major intersection at Northwest 9th Street and 9th Avenue, with heavy truck traffic. Board Member Baughman then turned to the area that has been identified as the Commercial Corridor as an example and how this affects the residential area surrounding those property owners. Board Member Brass interjected the biggest difference between these Commercial and Industrial areas is a geographic need.Should a resident already be contending with Industrial properties, compounded by the railroad, with the perception that the industrial expansion has been held back until recently, they may feel like they have been sold down the road cause Industrial Zoning is much more invasive than the Commercial Zoning. Hear from the property owner or designee/agent on Mr. Robert Gent,General Manager for Okeechobee Asphalt and Ready Mixed Concrete addressed the Board by first Application No. 13-001-SSA. thanking Mr. Brisson and stating that even though he didn't agree with his recommendation, he did agree that should there be an empty lot present in a residential neighborhood, one would expect a home to be built upon it. However, Northwest 9th Street is around 90 percent Industrial activity,and the railroad borders to the South.He stated he thought his company had always been a "good neighbor" and they have tried to clean up the business. When he originally purchased Lots 1 through 5,there were three abandoned homes on it that were demolished.The lots are not really big enough to build anything other than a small single family home.Okeechobee Asphalt is trying to be more competitive and he is hoping to increase his personnel by next year.At the moment,his intent is to use this property for materials and supply storage. Member McCreary inquired as to whether the resident of Lot-6 would be inundated with dust and dirt. Mr.Gent replied that he is sensitive to the fact that there is a home adjacent to this property,so he plans to construct a small wall and landscaping to buffer the impact as well as beautification. 3. Public comments or questions from those in attendance, or Chairperson Pro-Tem Brass asked whether there were any comments or questions from those in attendance. Chairperson Pro-Tem Brass asked whether Board Members had ex-parte communications to disclose for the record. There was none. 5.a) Consideration of a motion to recommend the City Council Planning Staffs findings are as follows:The primary goal of the FLU Element is to continue to maintain a high quality approve or deny application. living environment through a well-planned mix of compatible land uses and to preserve its distinctive natural and historic resources,and to provide public services to its residents at a minimum cost.Even though the applicant purchased the property and has been using it for storage of materials,Planning Staff does not find the application to be consistent with the Goals, Objectives and Policies of the Comprehensive Plan. In regards to consistency of other aspects of the Comprehensive Plan, Planning Staff agrees there should be no appreciable effects on the projected population of the City, adjacent unincorporated areas, traffic levels,or public facilities and services. Hear from Planning Staff regarding Petition No. 13-001-R. Planning Consultant Brisson explained to the Board that in association with the previous application the applicant is requesting to rezone the property as well. As previously explained, the City maps were recently updated and the unplatted parcel was erroneously marked as RSF-1. It, along with Lots 7 through 12, are already Industrial. Since the recommendation is to change the FLU, then the rezoning should reflect the same. 2. Hear from the property owner or designee/agent. The applicant was present and did not have anything further to add. 3. Public comments or questions from those in attendance,or Chairperson Pro-Tern Brass asked whether there were any comments or questions from those in attendance.There was submitted to the Board Secretary. none. 4. Hear from Planning Staff. Planner Brisson referenced his memorandum dated April 10 regarding proposed changes to accommodate the inclusion of limited agriculture in all Future Land Use categories provided the lands are zoned Holding.This matter was previously heard before this Board in February,though was not advertised as a public hearing,which is a state requirement,The Planning Board has already made a recommendation that the City Council re-create/adopt a Holding Zoning Category. Owners will be allowed to have Limited Agriculture uses as long as properties are zoned Holding.He further explained that the definition of Limited Agriculture is a non-commercial business that allows grazing, boarding or raising of livestock.The main concern is regarding lands zoned as RSF-1. Board Members Ritter and McCreary were concerned with the property owners who have something other than Holding Zoning and children who are raising animals for 4H and FFA. Board Member McCreary had grave concerns that the recommended changes,as presented in the Planner's memorandum,would cause problems with being allowed to keep 4H and FFA animals on their property.He did not want to tamper with what was already allowed as this then could cause misinterpretations. There was none. 4.a) Consideration of a motion to recommend the City Council Board Member Baughman made a motion to create the category Holding. This motion died for a lack of a second. approve or deny Text Amendment. Board Member McCreary made a motion regarding the Comprehensive Plan Future Land Use Element Text Amendment to accommodate the inclusion of limited agriculture uses in all Future Land Use categories, provided the property is zoned Holding, to withhold any decisions tonight and to plan a session with the City Council and the public in Public Hearing format to further appropriately resolve the matter; seconded by Board Member Ritter. b) Board discussion. Chairperson Pro-Tem Brass asked whether there was any further discussion.Board Member Baughman was concerned that nothing would come from having this session with the City Council and the public,as the public did not show up the last time and it was advertised as a Public Hearing.Board Member Ritter pointed out that the majority of the Board was not present at the City Council meeting when this topic was up for discussion and he really wanted to sit down and be eye to eye with the Council, as they had struggled with this issue as well. c) Vote on motion VOTE HOOVER-ABSENT BURROUGHS-ABSENT BAUGHMAN-YEA BRASS-YEA KELLER-YEA MCCOY-ABSENT RITTER-YEA CREASMAN-YEA MCCREARY-YEA MOTION CARRIED. Hear from Planning Staff. Planner Brisson explained the Commercial Corridor has been identified as that area generally within two blocks of North Park Street(SR70)and Parrott Avenue (US Hwy 441). The Transitional Commercial Overlay area is identified as the second block out from the major arterial roadway. These are less intensive uses as this area is adjacent to residential areas and less intrusive. Any Zoning designation or use that exists now will continue and is only affected should a property owner wish to rezone. This would give owners better knowledge of what they will be able to do. Future Rezoning's would be limited to Residential Multiple Family, Light Commercial,Commercial Professional Office,Central Business District, or Public Use districts. 2. Public comments or questions from those in attendance, or Chairperson Pro-Tern Brass asked whether there were any comments or questions from those in attendance.Mr Jason submitted to the Board Secretary. Tomlison, 212 Southwest 3rd Avenue addressed the Board with concerns that should this area that is being identified as the Transitional Commercial Overlay be established, he would not be able to petition for his property to be rezoned to Heavy Commercial (CHV). He purchased Lots 1 through 3, Block 175, City of Okeechobee, with the intention of rezoning to CHV sometime in the future. Currently the property is zoned Residential Multiple Family,with CHV zoning surrounding it. Mr.Thomas Hoover,2473 Southwest 24th Avenue and business owner of Kahootz Draft House Inc.,was also concerned with not being able to request CHV zoning. He had always thought that his property, Lots 4 through 6, Block 161, City of Okeechobee, was zoned CHV,though it is really Central Business District, and believes he should have the option to petition a rezoning. Additionally, the establishment of the Overlay would limit how owners market their property. Ms. Glenda Fulwider, 908 Southwest 2"d Avenue, added an individual should have the opportunity to ask for a certain zoning even though that might not be granted.They would at least be able to voice their opinion where as they would not all have that opportunity should this overlay be identified. 4 3 2 MAY 16,2013-PLANNING BOARD-PAGE 8 OF 9 AGENDA ACTION - DISCUSSION-VOTE V. She then disclosed that her residence is located within this proposed Transitional Commercial Overlay area and will be abstaining from voting. Board Member Creasman asked Attorney Cook whether he needed to disclose anything as he rents from a property owner in this overlay area. Attorney Cook responded no. 4. a) Consideration of a motion to recommend the City Council Board Member Baughman made a motion to recommend the City Council amend the Comprehensive Plan Future Land approve or deny Text Amendment. Use Element to(1)Accommodate adding Map 1.2 identifying the Commercial Corridor only, (2) Provide additional and varied commercial opportunities in locations in close proximity to the City's major arterials and adjacent to residential areas; and (3)Allow mixed residential and commercial uses on the same parcel; seconded by Board Member Ritter. b) Board discussion. A. 1. a) Consider a recommendation to extend the Impact Fee The City Council along with the Board of County Commissioners and School Board adopted the collection of Impact Moratorium for another year, July 1, 2013 to June 30, 2014 Fees.The City's fees are outlined in Code Book Section 71-13 for Public Works,71-23 for Law Enforcement,and 71-33 (Exhibit 4). for Fire Facilities.Due to recent economic issues,the City Council has suspended the collection of City Impact Fees from July 1,2011,on an annual basis.The School Board suspended the collection of their Impact Fees as well since October 11, 2011. As the Local Planning Agency, the Planning Board has been requested to review the matter and offer a recommendation to the City Council,either to adopt or not adopt the extension of the moratorium to collect City Impact Fees for an additional year,July 1, 2013 to June 30, 2014. b) Board discussion. Board Member Baughman made a motion to recommend the City Council extend the Impact Fee Moratorium for another year,July 1, 2013 to June 30, 2014;seconded by Board Member Creasman. Specifically, the applicant intends to utilize the subject property for material storage.The use is consistent with the surrounding area, and makes appropriate use of the existing rail line on the south side of the property. Public Facilities Impact The Applicant intends to utilize the subject property for storage of materials associated with operation of the existing asphalt/concrete plant,and therefore impacts to public facilities are expected to be minimal. Traffic Analysis Traffic anticipated for industrial property is widely variable in the ITE manual, and based on specific criteria for the development which cannot be known at this time(number of employees, etc.) Industrial use of the subject property is not anticipated to increase traffic flows above what would be expected with development of the subject property as single- family residential lots.A detailed Traffic Impact Analysis is not being provided. 2. Water, Sewer and Recreation/Open Space The existing residential lots, if developed, could conceivably generate 456 gallons per day (114 gallons per day per unit).The proposed use could generate up to 3,525 gallons per day (0.15 gallons per day per square foot). Recreation/Open Space analysis is not applicable. 3. Adequacy of Existing Public Facilities The proposed use is consistent with surrounding development, and it is anticipated that, even in the maximum-development scenario,the proposed Land Use change would not be burdensome to existing public facilities for solid waste and water/sewer. Small Scale Comprehensive Plan Amendment Petition No. 13-001-SSA Summary The Applicant is proposing to amend the Future Land Use Map to allow industrial uses on the subject property. It is our understanding that Lots 7 — 12 have been used for storage of industrial materials. The Application states that the intended use of the properties is for storage of industrial materials, but if the requested change is approved, use of the property will not be limited only to storage. Internal Consistency with the Comprehensive Plan A. Consistency with Goals, Objectives and Policies of the Plan The primary goal of the Future Land Use Element is to continue to maintain a high quality living environment through a well-planned mix of compatible land uses [emphasis added] and to preserve its distinctive natural and historic resources and to provide public services to its residents at a minimum cost. The Applicant is requesting to amend the Future Land Use Map from Single Family to Industrial. As some of you will recall, each of the properties contained within this Application were the subject of discussion during a work session held in May of 2012. At that time the following materials were presented to the Board: LOTS 7 — 12: We recognized that the property is owned by Okeechobee Asphalt and Ready Mixed Concrete. While there was what appeared to be a small single-family house and an RV, it was considered vacant in the Property Appraiser's records. It is our understanding that the property has been used to some extent for the storage of industrial materials associated with Okeechobee Asphalt and Ready Mixed Concrete operations. At that time our recommendation was to change the Future Land Use Category of these lots from Single-family to Industrial. The basis for this recommendation was to recognize its adjacency to the railroad and that the depth of the lots (about 42 feet) make the lots largely unsuitable for residential use. We still believe Industrial is the most appropriate Future Land Use Category for these lots. 4 Serving Florida Local Governments Since 1988 Staff Report Applicant's Name: Okeechobee Asphalt& Ready Mixed Concrete, Inc. Small Scale Comprehensive Plan Amendment Petition No. 13-001-SSA THE ABANDONED FEC R/W PARCEL: Originally this property was thought to have no Future Land Use Designation. However, since that time, it was determined that an error had been made some time ago and research showed that the property carries a Single Family designation. This property is also owned by Okeechobee Asphalt and is immediately adjacent to existing facilities and operations associated with its ready mixed concrete operations. This and the parcels separation by roadways from residential uses and residentially zoned properties served as the basis for our recommendation to change the Future Land Use category to Industrial. We still believe Industrial is the most appropriate Future Land Use Category for this parcel. LOTS 1 — 5: These properties are all vacant and are also designated Single-Family on the Future Land Use Map (FLUM). Immediately to the west is a single-family home. To the north is a vacant commercially designated lot which, as we understand it, is likely to be used as office for Okeechobee Asphalt. The other vacant parcels on the north side of NW 9th Street are owned by the Missionary Baptist Church which has its physical location at the southwest corner of the intersection of NW 9th Street and NW 9th Avenue. While an Industrial designation may be acceptable, the more appropriate Future Land Use designation would be Multi-Family. This designation would be consistent with the aforementioned goal in the Future Land Use Element. Specifically, except for the narrow lots bordering the north side of the railroad, and the one commercial lot, all properties in this neighborhood have been designated for residential use, and all are zoned RMF. Clearly all property owners and residents in the neighborhood have the right to have expected one form or another of residential use on these properties. At that time we stated "We believe a Multi-Family FLU designation is the most appropriate..." We still believe Multi-Family is the most appropriate Future Land Use Category for these properties. B. Changes to the Future Land Use Element relating to allowing limited agriculture in all future land use categories provided the lands are zoned H Following are seven pages (A-1 through A-7), beginning with page 1-2 from the City's Comprehensive Plan as amended through December 6, 2011. These pages now include proposed changes to accommodate the inclusion of limited agriculture in all future land use categories provided the lands are zoned H,per direction given by the City Council on October 16, 2012. In addition, we have proposed changes intended to more clearly meet the requirement, as set forth in Sec. 163.3177(6)(a)1 of the Community Planning Act, that "each future land use category must be defined in terms of uses included... " . For clarity, we have also included a listing of the specific zoning districts that are appropriate in each future land use category. For ease of review, text to be deleted is shown in strikeout and new text is underlined and highlighted. A-1 Serving Florida Local Governments Since 1988 Department of Environmental Protection) or limit development densities and intensities in areas where soil types or topography are not conducive to development. Permitted densities and intensities in environmentally sensitive areas shall be as established under Objective 2 and the Future Land Use Map. Other uses related to and consistent with low density residential development such as boarding houses, bed & breakfasts, adult family care homes, assisted living facilities, community centers, indoor and outdoor recreation and public utilities may be permissible under certain circumstances. 1. Maximum density is four units per acre for residential units on individual lots, and six units per acre for mobile home parks. Where affordable housing is provided in accordance with Housing Policy 1.6, the maximum density for single family development shall be five units per acre. 2. Zoning districts considered appropriate within this future land use category include H,RSF 1,RMH, and PUD-R. b) Multi-family Residential. Permitted uses include all uses listed as permissible in the Single-Family Residential future land use category plus apartments, duplexes, condominiums, single family houses, zero lot line single-family dwellings, public facilities, limited agriculture (but only on lands zoned H), and accessory uses customary to permissible uses. 1. Maximum density shall not exceed 10 units per acre. Where affordable housing is provided in accordance with Housing Policy 1.6, the maximum density for multi-family development shall be 11 units per acre. 2. Zoning districts considered appropriate within this future land use category include H, RSF 2, RMF, and PUD-R. tie A A-2 Serving Florida Local Governments Since 1988 c) Mixed Use Residential. Intended to accommodate and provide flexibility for development of multiple uses within a residential setting. In order for land to be considered for this designation, land requested to be placed in this category shall be a minimum of 30 acres. Development within this category would be allowed to be no more than seven and one-half(7.5) dwelling units per gross acre. 1. The H and PUD-M Zoning Districts are considered appropriate within this future land use category. 2. Land developed within this Residential Mixed Use Category must adhere to the following innovative design and planning principles. a. All new development within the Residential Mixed Use Category shall be required to be zoned PUD-M as--a Planned Development or Planned Unit Development. b. Development within this Residential Mixed Use Category will be required to cluster in order to maximize open space and natural areas. Development within the Residential Mixed Use Category is permitted to be clustered at higher than gross density as long as the gross density is not exceeded for the total acreage within the Residential Mixed Use Category. c. Development within the Residential Mixed Use Category is encouraged to provide a mix of uses, including a mix of residential types, recreational amenities, civic spaces and convenience and commercial uses intended to serve residents and their guests in order to minimize trips outside the Residential Mixed Use Category. d. Development is encouraged to provide creative site designs, and clustering is required to provide for greater common open space and mixed-use development. The planning flexibility provided through the planned development process shall encourage and facilitate creative design techniques. i. Residential Development. These areas shall include single and/or multiple family home site acreage, and shall include, but not be limited to, single-family attached and detached; duplexes and two-family units; and town homes and other multi-family dwelling types. ii. Golf course fairways will account for no more than fifty percent (50%) of the open space of the subject Residential Mixed Use Category. No development (residential/commercial) structures are intended, but only recreation oriented buildings and/or structures. v. The owners will employ management strategies in and around any golf course to address the potential for pesticide/chemical pollution of the groundwater and surface water receiving areas. The management practices will include: (i) The use of slow release fertilizers and/or carefully managed fertilizer applications which are timed to ensure maximum root uptake and minimal surface water runoff or leaching to the groundwater; (ii) The practice of integrated pest management when seeking to control various pests, such as weeds, insects, A-4 Serving Florida Local Governments Since 1988 and nematodes. The application of pesticides will involve only the purposeful and minimal application of pesticides, aimed only at identified targeted species. The regular widespread application of broad spectrum pesticides is not acceptable. The management program will minimize, to the extent possible, the use of pesticides, and will include the use of the United States Department of Agriculture Soil Conservation Services Soil Pesticide Interaction Guide to select pesticides that have a minimum potential for leaching or loss due to runoff depending on the site-specific soil conditions; (iii) The coordination of the application of pesticides with the irrigation practices (the timing and application rates of irrigation water) to reduce runoff and the leaching of any pesticides and nutrients; (iv) The utilization of a golf course manager who is licensed by the State to use restricted pesticides and who will perform the required management functions. The golf course manager will be responsible for ensuring that the golf course fertilizers are selected and applied to minimize fertilizer runoff into the surface water and the leaching of those same fertilizers into the groundwater; and (v) The storage, mixing and loading of fertilizer and pesticides will be designed to prevent/minimize the pollution of the natural environment. vi. The shorelines of any stormwater management lakes must be sinuous in configuration, and must be sloped or bermed. The littoral zones around the ponds must be planted with native wetland herbaceous plants, and trees or shrubs can be included within the herbaceous plants. At least four species must be planted. The minimum required number of plants will be one plant per linear foot of lake shoreline as measured at the control elevation water level. The littoral shelf should provide a feeding area for water dependent avian species. e. As individual zonings to PUD are submitted to the City, A-5 Serving Florida Local Governments Since 1988 4 they shall include as a minimum the following information: i. A showing of the amount of units as a part of the maximum approved for the parent parcel. ii. A Traffic Analysis submitted verifying that adequate capacity currently exists or will exist prior to the issuance of any Certificates of Occupancy. f. Any lands included or amended into the Residential Mixed Use Category must demonstrate the non-existence of urban sprawl by: i. Submitting a fiscal impact study demonstrating a net fiscal benefit to the City. ii. Directing new growth to areas where public facilities exist, are planned within the City or County Five Year Capital Improvements Plan, or are committed to through a Developer Agreement, or otherwise assured to be funded by the appropriate agency. iii. Requiring all development to be connected to central water and sewer. d) Commercial. Permitted uses include the full range of retail, personal and business services, offices, automotive, wholesale, warehousing, related commercial activities, limited agriculture (but only on lands zoned H) and accessory uses customary to permissible uses. Also permitted are public facilities Other uses related to and consistent with commercial development such as houses of worship, public facilities, public utilities, communications facilities, hospitals, group homes, adult family care homes, assisted living facilities, and limited residential use associated with a commercial building, may be permissible under certain circumstances. 1. Commercial development shall not exceed a floor area ration of 3.00 and the maximum impervious surface for development within this category shall not exceed 85% of the site. 2. Zoning districts considered appropriate within this future land use category include H, CPO, CLT, CHV and CBD. 9 A-6 Serving Florida Local Governments Since 1988 e) Industrial. Permitted uses include large-scale manufacturing or processing activities, Also permitted are business offices and schools, wholesaling and warehousing, public facilities, public utilities, limited retail and service uses, and off-site signs, limited agriculture (but only on lands zoned H), and accessory uses customary to permissible uses. Other uses related to and consistent with industrial development such as adult entertainment, salvage yards, fortunetellers, bulk storage of hazardous materials and manufacturing of chemical or leather products may be permissible under certain circumstances. 1. Industrial Development shall not exceed a floor area ratio of 3.00 and the maximum impervious surface for development within this category shall not exceed 85% of the site. 2. Zoning districts considered appropriate within this future land use category include only H and IND. f) Public Facility. Permitted uses include public facilities and uses such as parks, schools, government buildings, fire stations, other recreational and non-recreational public properties, limited agriculture (but only on lands zoned H) and accessory uses customary to permissible uses. 1. The maximum impervious surface for development within this category shall not exceed 85% of the site. 2. Zoning districts considered appropriate within this future land use category includes only H and PUB. Changes to the Future Land Use Element relating to the Commercial Corridor and Transitional Commercial Overlay Policy 2.1: The following land use designations are established for the purpose of managing future growth: d) Commercial. 3. In recognition of the importance of the SR 70 and US 441 as the city's primary commercial corridor roadways, the City has identified the Commercial Corridor as being that area generally within two blocks of each of these roadways as delineated on Map 1.2 in the Future Land Use Map Series. 4. The City is interested in following a considered, limited, and consistent approach to allow expansion of commercial and mixed-use opportunities gradually outward from established commercial corridor roadways to eliminate uncertainty and foster infill and compatibility with existing development. To this end, the City has delineated the Transitional Commercial Overlay Future Land Use Subcategory on Map 1.2 in the Future Land Use Map Series. This category is intended to: a. Provide additional and varied commercial opportunities in locations in close proximity to the City's major arterials and adjacent to residential areas. b. Permit the continuation of a wide variety of existing residential, commercial, industrial and public and semi- public uses as allowed within the RSF1, RMF, CPO, CLT, CHV CBD, IND and PUB zoning districts. c. Limit rezoning of lands within this Future Land Use category only to the RMF, CLT, CPO, CBD or PUB zoning districts, thereby providing a transition from more intense development along the major arterials to lessen intensity closer to residential areas. d. Allow mixed residential and commercial uses on the same parcel. The City's fee's are outlined in Code Book Section 71-13 for Public Works, 71-23 for Law Enforcement and 71-33 for Fire Facilities. Due to economic issues, the City Council has suspended the collection of City Impact Fee's since July 1, 2011, on an annual basis. The School Board suspended the collection of their impact fee's as well since October 11, 2011. The City Council will be considering extending the suspension another year at their M a y 21 s t meeting. As the Local Planning Agency, the Planning Board has been requested to review the matter and offer a recommendation, by motion, to the City Council, either to adopt or not adopt the extension of the moratorium to collect City Impact Fee's for an additional year, July 1, 2013 to June 30, 2014.
