VI. NEW BUSINESS.
A. Disposition of Cases presented by Code Officer Sterling :
Case No.13-013 Building Official, Jeffrey Newell, testified property located at 217 SE 5" Avenue had a large hole which was dug to hold raw
Joaquin & Ana Dominguez. 217 SE 51' Avenue effluent due to a failure with the septic system. The accumulation of effluent then flowed from the hole onto a public right of
Ch 30 Sec 30-36 Dumping, depositing, leaving near street way contaminating pubic property and subjecting the public to conditions having the potential of causing disease or possibly
Ch 30 Sec 30-43 Public nuisance loss of life. Mr. Newell stated after interviewing neighbors and talking to the company who installed the original system he
determined the sewage had been accumulating for a period between one to three years. Mr. John Hayford testified on behalf
of Okeechobee Utility Authority stating their records show on November 26, 2012 they received a report of a sewer back up at
217 SE 511 Avenue. The service technicians determined the pump was not working and a check valve was replaced. On
February 1, 2013 QUA received another call for the same property and it was determined the check valve that was replaced
in November had been damaged and it was replaced a second time on February 5, 2013. In conclusion, Mr. Newell advised
the Board that Echols Plumping had repaired the system on February 5, 2013 and it was now functioning properly. He said,
staff is recommending the property owner be held financially accountable for the violation of dumping raw sewage on his
property and the cost for remedial action consisting of an environmental evaluation and removal of the top three to six inches
of contaminated soil from the city right of way. Code Officer Fred Sterling testified when he inspected the property on January
30, 2013 he considered the property to be a public nuisance. Therefore, notice of violation and notice of hearing was posted
on the property and notices were sent by certified mail to the property owner. At this time property owner, Joaquin Dominguez,
gave his testimony through his interpreter. He stated he had not been living at the residence for approximately two years and
was not aware of the condition of the property until the day the renters were evicted and he was able to gain access to the
property on January 31, 2013. He testified he did not dig the hole or try to fix the septic system himself by using a portable
pump. When he became aware of the problem he called Echols plumbing to make the repairs and then the property owner put
two 50 lb. bags of lye on the contaminated area when Echols finished on February 5, 2012. Chairperson Gamiotea reviewed
the water usage records from OUA in order to establish a time frame for how long the house had been vacant. According to
the water usage there was a period between December 2011 and September 2012 that the water usage was very low indicating
the property was probably vacant during that time. Member Close moved to find Case 13-013, Joaquin & Ana Dominguez of

soil on City right of way with all expenses incurred paid by the property owner; seconded by Member Denisuk.

Code Officer Sterling testified this property has a twenty-five dollar per day fine which began December 8, 2011 and is still in violation for
Case No.11-. 40 general cleaning and public nuisance at this time. Attorney Cook advised the Board at this point they have two options. The first is
Barbara Mills. 406 NW g Street recommends foreclosure. The second is recommendingthe matter o before a cox judge Consider recommending City Council take legal action � 9 county j g requesting a court order allowing the City
access on the property to bring it into compliance. Member Denisuk moved Case 11-072, Barbara Mills of 406 NW 5 Street, be taken to
the City Council recommending they take legal action to get a court order giving the City access to the property in order to bring it into
compliance; seconded by Member Close.

Ch 30 Sec 30-44 General cleaning & beautification on the testimony of Code Officer Sterling, imposing a fine of twenty five dollars per day beginning upon receipt of proper notification;
seconded by Member Conrad. Member Conrad withdrew her second. Motion failed for lack of second. Mr. Pippin moved to find Case
12-110 Teresa Holloman of 304 SE V Street, in violation of Ch 30 Sec 30-43 Public nuisance and Sec 30-44 General cleaning &
beautification, based on the testimony of Code Officer Sterling, declaring the property to be a public nuisance to be cleaned by the City
and brought into compliance and imposing a fine of twenty five dollars per day beginning upon receipt of proper notification; seconded by
Member Conrad.

based on the testimony of Code Officer Sterling, allowing a period of one week beginning February 13" and ending February 20, 2013
to finish cleaning property if not in compliance a fifty dollar per day fine will begin February 21, 2013; seconded by Member Oenisuk.

accumulation of litter or untended vegetation, garbage, weeds, or other dead or
living plants; or places holding stagnant water,, and all other objectionable, unsightly
or unsanitary matter upon any lot, track of land within the city.....threatens or
endangers the public health, safety or welfare, includin0 g such conditions causing or
tending a to cause disease, , or by reason of such a condition, that tends to impair the
economic welfare of adjacent property ......
o The property owner has been pumping raw effluent into a public unpaved right-of-
way
o Staff Comment: for a period of no less than one year to three years. This has been
verified by interviewing neighbors and an interview with the contractor who
installed the original system in 2006. This action of the property owner subjected the
surrounding properties to such conditions that have the potential to cause disease by
the accumulation of raw affluent and. the development of a scum accumulation of
human waste solids that harbor and 0
encourage the growth of pathogenic bacteria
and viruses that have the potential to cause physical harm and potential loss of life
to the residents living in close proximity `-o the accumulated spoil area located in the
public right-of-way. This action also impaired the economic welfare of the adjacent
properties due to odor and the spoil area that was created by the pumping of

affluent into the unpaved city right-of-way.

iE Comments: The act of pumping raw into any adjacent

1 violation of City Ordinances it also violates State
Health taws that regulate septic systems regarding the health and welfare
of the public. The property owner is not only subject to local laws but also
to state and federal laws regarding the disposal of raw affluent. The
property owner is subject to prosecution by state and federal agencies.
o (c) Any nuisance.....existing within the city shall be brought before the
code enforcement board of the city.....upon determination by the board
that a nuisance does in fact exist, the landowner or custodian thereof shall
take whatever corrective measures as directed by the board .....shall include
the authority to authorize clean up or repair of the property to come into
compliance.... And such further remedies as provided by law.
o Staff Comment: Staff 1,s o' the opinion, by the circumstantial evidence
presented to the Code Enforcement Board-, does in fact support that this ad
of pumping affluent onto an adjoining property constitute a "public
nuisance" and an endangerment to public health as defined by Article 11
Section 30-43.
o If agreed by the Code Enforcement Board, staff recommends the following
disciplinary actions:
a 1) Consideration of a 1 J of the unlawful act that endanger
the public heath and economic value of the surrounding properties. Along
with the contamination of a public right-of-way with raw effluent.
o 2) Remedial action should consist of an environmental evaluation. o
determine the corrective action of the contaminated spoil area. Staff is not
supportive of the standard remedial action of placing lye on the
contaminated area. The reason for the request of the environmental
evaluation is due to the extended period of time, 1-3 yrs of exposure, to
the pumping of affluent into the public right-of-way.
