Mayor Kirk read the Sunshine Week proclamation into the record as follows: "Whereas, James Madison, the father
of our federal Constitution, wrote that "consent of the governed" requires that the people be able to "arm
themselves with the powerwhich knowledge gives"; and Whereas, everycitizen in our participatory democracy
has an inherent right to access to government meetings and public records; and Whereas, an open and
accessible government is vital to establishing and maintaining the people's trust and confidence in their
government and in the government's ability to effectively serve its citizens and Whereas, the protection of
everyperson's right of access to public records and government meetings is a high priority of the City Council;

history of Florida's open government laws, now known as the Sunshine Laws as well as giving real life scenario's of
11 processing various types of public records requests, and types of open meetings together with their required notices.

A. Motion to dispense with the reading and approve the Summary of Council Member Watford moved to dispense with the reading and approve the Summary of Council Action for the
Council Action for the February 5, 2013, and February 19, 2013, February 5, 2013, and February 19, 2013 regular meetings; seconded by Council Member O'Connor. There was no

VIi. NEW BUSINESS.
A. Consider a recommendation by the Code Enforcement Board Chief Smith asked Code Officer Fred Sterling to make the presentation, he began by explaining on October 11, 2011,
regarding Case No. 11-072, Barbara Mills, 406 NW 51h Street, Lots the City Code Enforcement Board enacted a Gen of twenty-five dollars ($25.00) per day on Case No. 11-072, for Lots
3-4 of Block 105, City of Okeechobee, to take legal action to obtain 3-4 of Block 105, City of Okeechobee, Plat Book 1, Page 10, Okeechobee County Public Records, the owner is
access to the property and bring it into compliance - City Fire Chief Barbara Mills, the address is 406 Northwest 5th Street. The violation was for Code Section 30-43 Public nuisance and
(Exhibit 1). Section 30-44 General cleaning and beautification. Mrs. Mills has been very adamant that no one is allowed entry to
her property. Officer Sterling then gave a time line leading up to the Code Board action:
-June 24, 2011 courtesy letter sent to owner -July 20, 2011 courtesy letter returned unclaimed
'August 10, 2011 mailed Notice of Violation -August 16, 2011 Notice of Violation posted
•August 31, 2011 Notice of Violation returned -September 21, 2011 mailed Notice to Appear

regarding Case No.11-072, Barbara Mills, 406 NW 5`h Street, Lots
3-4 of Block 105, City of Okeechobee, to take legal action to obtain

-September 30, 2011 Notice to Appear posted -October 10, 2011, property inspected, not in com
The fine was officially imposed on December 8, 2011, and recorded in OR Book 709, Pages 18-19, public records of
Okeechobee County. At the February 11, 2013 Code Board meeting the Case was reviewed, as to date the property
had not been brought into compliance. The fine has accrued for 454 days, which as of today equals eleven thousand,
three hundred fifty dollars ($11,350.00). The Code Enforcement Department has made every attempt to work with the
property owner, including asking other family members to assist with the situation. Mrs. Mills lives with one of her sons,
Robert Mills, who does not want the property to be mowed and cleaned. The other son, Richard Mills and his wife, who
live in South Carolina have made every attempt to have the property cleaned, but have been prevented as well. They
understand the City's situation, are supportive, and sympathetic to the neighbors for having to deal with the nuisance
of the overgrown vegetation which has caused with rodents and snakes to live in the yard.
Attorney Cook advised the Code Board of their options: Do nothing; Foreclose on the property; File for an inspection
warrant; or File a lawsuit for a public nuisance. They voted to recommend the City Council approve the filing for an
inspection warrant then, once the court order is obtained, the Public Works Department should then clean the property.
There was a lengthy discussion between the Council, Attorney Cook, Administrator Whitehall and Officer Sterling
regarding Attorney Cook and Administrator Whitehall's recommendation that in light of the circumstances and length
of time the property has been in violation, that the Council approve filing a foreclosure, as that action may wake
somebody up and accomplish some kind of settlement to make sure this property stays cleaned up.
The circumstances of the case are that the owner will not allow the City access to the property. All notices are returned
unclaimed that are mailed, she is not understanding the seriousness of the situation, and has taken a defiant stand
against the City and family members who have tried to intervene. Should the City only proceed with getting the
property cleaned up immediately, most likely it will be back in violation within several months. Should the fine continue
to accrue, added with the City's periodic cleaning fee, soon it will be more than the value of the property, which would
make it harder for a potential buyer or family member to take it through the delinquent property taxes method. In
addition, the property is located in a high profile area and can hinder the City's ability to enforce Code violations
throughout the City. However, the Council is always cautious when making decisions to foreclose on property and
offered an alternative solution, proceed with the Code Board's recommendation, and move forward with filing for
foreclosure.

Council Member Watford moved that the City takes the necessary legal action to get the court order (inspection

Development Block Grant House Rehabilitation Program [Grant No. 10DB-05-07-57-02-H081, to McHaffey
Administrator (Exhibit 2).
Construction Group for Mary Massey, [504 Northwest 17'n Street project] in the amount of thirty-nine thousand, eight
hundred twenty four dollars ($39,824.00); seconded by Council Member Williams. There was no discussion.

Builders for Mary Koger, [915 Northwest 1 U' Street project] in the amount of forty-two thousand, six hundred sixty-eight
dollars ($42,668.00); seconded by Council Member Williams. There was no discussion.

Distributed at the meeting was a spreadsheet listing the 15 CDBG-HR projects by owners name, address, contractor,
date bids received, amount, award date, status and total of grant funds used to date, which is $481,148.51. The grant
budget allows up to $560,000.00 for construction. Administrator Whitehall advised these should be the final project's
awarded for the grant. The residents have been pleased with the projects and are very grateful.
The item to consider a request from Okeechobee County to approve a reduction in parking to accommodate a new
government office building as recommended by the City Technical Review Committee (Application No. 13-001 -TRC)
was withdrawn from the agenda. Administrator Whitehall notified the Council prior to the meeting by email that the
County Staff requested the withdrawal of the matter in order to give the Board of County Commissioners time to
consider the modifications to the project, as stipulated by the TRC at their February 21, 2013, meeting.
There being no further discussion nor items on the agenda, Mayor Kirk adjourned the meeting at 6:49 p.m. The next
regular scheduled meeting is March 19, 2013, at 6:00 p.m.

VII. NEW BUSINESS.
A. Consider a recommendation by the Code Enforcement Board regarding Case No. 11-072, Barbara Mills, 406 NW 5" Street, Lots 3-4 of Block 105, City of Okeechobee, to take legal action to obtain access
to the property and bring it into compliance - City Fire Chief (Exhibit 1).
Distributed as exhibit one where the minutes from the October 11, 2011 Code Enforcement Board meeting and exhibits which explained the CEB enacted a lien of twenty-five dollars per day on Case No. 11-072,
for Lots 3-4 of Block 105, City of Okeechobee, Plat Book 1, Page 10, Okeechobee County Public Records, the owner is Barbara Mills, the address is 406 Northwest 5th Street. The violation was for Code Section
30-43 Public nuisance and Section 30-44 General cleaning and beautification.
Time line leading up to the Code Board action:
-June 24, 2011 courtesy letter sent to owner.
-July 20, 2011 courtesy letter returned unclaimed.
-August 10, 2011 mailed Notice of Violation.

-October 10, 2011, property inspected and found not in compliance.
The fine has accrued for 454 days, which is eleven thousand, three hundred fifty dollars ($11,350.00) as of today. He spoke with Mrs. Mills daughter-in-law in South Carolina today explaining what was happening.
She said I'm surprised its taken this long. Mrs. Mills is in West Palm Beach right now, and her recommendation was to try and expedite getting this order and getting the property cleaned up while she (Mrs. Mills)
and Robert, the other son, where in West Palm Beach that way there wouldn't be any confrontation. They're 100 percent behind us in getting the property cleaned up. They said they really don't have much
influence on her, that Robert, because she lives with him is the real influence and he's the one that doesn't want anything cut. In the mean time the property keeps getting worse and worse. Now over the last
year we weren't getting as many complaints, now the neighbors are starting to complain about snakes and rodents coming out of the back yard.
Whitehall, so on Dec 2011 is when the CEB commenced with a fine of $25 per day, its $11,350, last time CEB met on this was February 12th and their recommendation to the City Council was to take legal action
to obtain access to clean the property. I subsequently spoke to the City Attorney about the CEB's recommendation. They essentially had a couple of choices which was recommend foreclosure or recommend
the course of action they took. John and I tried to dissect what would be the most permanent cure, with the least amount of legal intervention. John maybe you can take it from there. Va 3
Attorney Cook the action that is proposed is called an inspection warrant under Florida Statutes and is a procedure where you apply to the county judge for a court order to enter the property to correct a violation.
Of course that provides the land owner notice and opportunity to appear and defend and put in their side of story but, as I was discussing with Brian the problem is if we obtain that go in and clean it, then in June
or July its going to be grown up as bad or worse and we have to go through the process all over. Its been a difficult case for the Code board because of the circumstances and they have honestly bent over
backwards to accommodate Mrs. Mills. On the other hand it is what it is and its not going to get any better by ignoring it. The inspection warrant I think will succeed and will get the property cleaned up until next
time. If and I'm not aware of the dynamics that Fred's talking about between the two sons but Brian and I talked about filing a foreclosure and that action may wake somebody up and accomplish some kind of
settlement to make sure this property stays cleaned up.
Watford - that would be a more long term solution though or if they cleaned it up and then 6 months later they just let it grow and you're back before the code board again I guess.
Cook - well if we file the foreclosure say we filed it 1 st of may in court that process can take 12 to 24 months so the case is open during that time and if we abated or held off on actually pushing the foreclosure
while they worked on cleaning it up, if it got back like it was then we simply push the foreclosure ahead and keep going so we would have some leverage in that regard.
Council Member Watford, or we actually could do both couldn't we, say for example we went ahead with the inspection warrant, and we when in and cleaned it up, are we able to then file a line against the property
for the cost? Cook -Yes. Watford -okay then say 6 months later its still in this same shape I assume it goes back the Code Board, comes back to us and if were still having the same problem then we could file
for foreclosure. Cook -Yes. Watford -that would get the property cleaned up much faster than the foreclosure. Cook -probably yeah. Watford - assuming we get permission or the judge grants the order, and we
get it cleaned up. I would assume when they go before the judge and they say we understand now this is serious and we're going to clean it up, assume he could put some conditions like you have x number
of days or weeks to clean it up and if its not, is that kind of a logically.
Cook - yeah he can do that.
O'Connor - the problem like that if we did that went in there, cleaned it up, cause I say on that code board a long time, and I went through this many times, and ya'll was up here then, if it takes them 6 months
to get back to the code board & get it back up here, say we clean it the first month and then there's 5 months that thing is overgrown, and whoever lives next door to it is wondering why we aren't doing something
because its taking so long to get it done. Is the property worth right now, worth $11,350 if this fine keeps going on is it worth it for that? And if we have to go through the foreclosure, there's a cost incurred there
and if we end up with the property and say the property is worth for example $6-7,000 you wont get that part of it out and you sure as heck wont get the part out where we cleaned it up cause they are going to
say we aren't going to do that either. There's a strong possibility they would say that especially if you foreclosed. If you foreclosed on that now at least you got the ball rolling in the right direction if it takes 12-24
months to do that rather than doing it and waiting 5 months and its going to be grown up again and comes back to the code board and they're trying to figure out what in the world to do and it comes back up
here to us and we do this same thing over again, then there's another 5 months that it sits vacant and growed up again.
Watford- my issue is if we do the foreclosure, say it takes 12-18-24 months property's still not cleaned up for 12-18-24 months, if we do the other thing hopefully we can get it cleaned up and then were still 12-24
months but we accomplish getting it cleaned up quicker, does it stay cleaned up is the issue, but at least we accomplish getting it cleaned up. Then if they don't realize how serious this is or maybe once its cleaned
up its easier for them to keep clean once its cleaned up
Kirk - if we move to foreclose on the property, we're not foreclosing on whether its cleaned up or not we're foreclosing on the lien aren't we Cook yes. Kirk, then why could be do both, I think you started in that
direction, go ahead ask court to let us go in and clean it up and then the next move file to foreclose on the lien, what would be wrong this that? Cook -we can do both, just goes to two separate courts. Kirk - I mean
get it cleaned up for the people around. O'Connor -two separate courts? Cook -yes, Kirk- isn't that a better option than hoping they will keep it clean because based on two years experience here they are going
to keep it clean, they are basically calling our bluff.
Williams - they may not show up in county court
Sterling - yes because everything we mail them comes back unclaimed. We did hand deliver the board order, and she signed for it, and we explained exactly what it was and everytime I've spoke to her since
I've tried to emphasis, they are working on the house, and I'd say Mrs. Mills thats not where the fine is. You asked them about the value, back in August of 2011 the property appraisers had the land value at
$56,550 and the building at $41,484 for a value of $98,038.
Watford - yeah the land would be but the office isn't worth anything, the land is valuable with the location I'm assuming, pq
Maxwell - this is an office then? J
Watford - it was Dr. Mills old office, across from Red Larsons office.
Maxwell- looks like a residence thought.
Watford - yes it does, it was a residence to begin when he put his office in there.
Maxwell- does the rule require a warrant inspection even if you're just going to mow and not just entering the premises?
Cook -yes you cant enter the property unless we're invited, which is not going to happen apparently.
Maxwell - I can tell you one thing I've experienced before and I think both Mike and Dowling were alluding to this but I think the value is a critical factor because if we look at just cleaning it up this fine alone is
going to be $9000 per year plus our periodic clean up costs and so very quickly the lien is going to be more than what is worth and its probably not worth $98,000 now.
Watford - no
Maxwell - that's probably values from 2009 then the problem too if the taxes aren't paid which is probably the next thing that will happen if not already and it goes of a tax deed sale, this liens going to survive
it, and you wont have a buyer because they got a $50-60,000 lien so it wont put the taxes back in the county coffers or ours, that's something to think about.
Brian - unless I'm mistaken, once the city abates the nuisance the daily fine would cease.
Maxwell - and that would be just replaced by our period costs
Brian - yes our period costs until such time that the code board tackles it again, whichever, if we had an opportunity to clean it, come back and clean it, yes those costs would incur but the daily fine would stop.
O'Connor - we had that happen in East okeechobee, and there's also an administrative fee on it too isn't there?
Cook - there is but it's not that much money.
Maxwell - so we loose the daily fine, probably be cheaper to clean it, but as long as we're proceeding.
Brian - yes, just wanted to clarify that.
Watford - I think most of us have, I know I've talked with the adjoining property owners many times over the few years and understand their frustration because you would want that next door to your house, very
difficult for me to vote to foreclose on someones property. That has always been a very, very, very difficult decision for me to make and if there's another option, I like that option than taking someones property.
I think we all know the Mills family, we certainly appreciate what Dr. Mills did in this community for those of us who went to him and know his service to the community, its unfortunate however that Mrs. Mills and
one son Robert have take this stance. Like Fred, I spoke with the other son, Richard, know him from years back, and basically he said what Fred said, he was going to have it cleaned up and he would pay to
keep it cleaned up but the mother flatly told him to stay off and not to get involved, so he's frustrated too that he cant intervene in this, and his words were similar to what Fred said the wife said he didn't know
anything for us to do but to continue on so but I just hate to foreclose on someones property and is to me very, very drastic step to take I certainly think we should go ahead and go through the process to clean
it up even if, its grown up now for how many years, more than I can remember, 10-15 years maybe longer, even if we clean it up now its going to still be better than it is today, right now. And then we have options
we can move forward.
Maxwell - has it been vacant that long with no one residing there?
Watford- his office has been closed for 20 years, they never have lived there, that was his office and once he stopped practicign medicine it closed.
Maxwell - well I think too, and agree, think we do a disservice by not acting because this fine continues to accrue, no family member or anyone has the chance to really save it so we're kind of promoting decay.
Watford - but you know what our history is on fines don't you.
Maxwell - if we act now and there's some ability to reduce it then a person could salvage the equity if they were to step in at some point during it so I think waiting could be potentially damaging.
Watford - I'm not saying we should wait, its just foreclosure is a drastic last option.
Maxwell - I think we should do both, ask John because the fine is only $11,000, can you file them both in county court, can you file one suit and ask for the inspection while it proceeds?
Cook - will have to look at the statute again, did one for the county a couple years ago and I'm fairly certain the warrant has to go to the county judge.
Maxwell - but I mean could you do the foreclosure in county court?
Cook - oh because of the value you mean? That would be stretching it and I'm not sure we could, but ...
Maxwell - I would be in favor of just the foreclosure giving the fact there's no reasonable expectation of compliance, the children have exhausted their efforts and that it would probably do mroe good to the owner
in the long run to bring it to a head.
O'Connor - I think what burns me up about the whole thing is the defiance of those people, I remember Dr. Mills and what you said is all very benelvelent but by the same toke the defiance if that starts happening
all over the City, then we got a problem, if we tolerate that. Pq 5
Maxwell - this is a high profile area and it does hinder our ability to enforce against others.
Kirk - if we do both, start the one then start the foreclosure behind it doesn't mean we have to foreclose because they have every right in the world to stop it, we don't want their property but I feel personally their
actions have given us not much of a choice because they aren't will to cooperate at all, wont even let us on the property to clean it up. This is why we have the code enforcement board and a code enforcement
officer. I remember Dr. Mills too, I was in his office many times...
Williams - but we aren't dealing with him.
Kirk - no we're not, and I would recommend we do both, lets get it cleaned up as fast as we can, file the fore closure and maybe she'll realize we mean busienss and maybe she'll stop it, that woudl be my desire
that she stop it because we don't want to be in the real estate business but at the same time we got to support our code people.
Williams - can we withhold filing the foreclosure to see if we get any response after the clean up?
Watford - see if they even appear?
Kirk - yes
Williams - I'm for getting it cleaned up as soon as possible
Kirk - we can clean it up and address it again for the foreclosure part of it if you want to, but I think we shoudl be moving in the direction of doing both because we don't want it to set there and start over growing
again, Fred goes out sending out notices again, if she's mad with whomever or whatever that would just make it worse I think.
Watford - think you'll have a scene if they know what's happening. I don't know what would trigger, don't know what we can do tonight to trigger the foreclosure, can we say if they do not appear at the court hearing
then we start the foreclosure or if...
Kirk if you want just bring the foreclosure back at the next council meeting after this hearing takes place.
Cook - if the a fine stops because it comes into compliance, the accrued fine doesnt go away, so we don't have to wait for Fred to cited them again or have a code hearing again, if we clean it up, and 30-45 days
later it looks like it did before we can put it back on the agenda then.
Kirk - that to me sound like a good alternative.

is $481,148.51. The grant budget allows up to $560,000.00 for construction. Administrator Whitehall advised this should be the final project's awarded for the grant. The residents have been pleased with the
projects and very grateful.
C. Motion to approve a reduction in parking to accommodate a new government office building requested by Okeechobee County - City Administrator (Exhibit 3).
Administrator Whitehall notified the Council prior to the meeting by email that the County Staff requested the withdrawal of the matter in order to give the Board of County Commission time to consider the
modifications to the project, as stipulated by the Technical Review Committee at their February 21, 2013 meeting #13-001-TRC.

A. Okeechobee County. 13-001-TRC. Application was submitted by Ron Cauthan, P.E. for Chastain
Skillman, Inc., on behalf of the property owner, Okeechobee County BOCC, in regards to the
construction of a new 12,000 square foot government office building and drive—thru located at 307 NW
5t^ Avenue, Okeechobee, FL This is Phase One of the Master Site Plan — Senior Planner.
The Master Site Plan included with the application, identified for this property the existing Property
Appraiser and Tax Collectors office building, the proposed 12,000 square foot subject building, a future
12,800 square foot government office building, retention area, and two future parking lots, one with 22
spaces and a drive-thru, the other with 11 spaces, two being handicapped.

IV. NEW BUSINESS CONTINUED.
A. Okeechobee County, 13-001-TRC continued.
The focus of discussion was on the parking requirements, how much could be reduced and what could be
deferred, as basically the applicant was requesting no off-street parking be constructed for the new building,
Planner Brisson explained the proposed government building's 27 parking space requirement was based on
the net square footage (10,911 s.f.), rather than the normal gross square feet area. The applicant is
requesting a 50 percent reduction in parking space requirements (13 spaces) and to defer the construction
of off-street parking areas indefinitely.
A parking study/survey supplied by the applicant indicates 121 on -street parking spaces in the immediate
vicinity, an average of 70 were being occupied. Mr. Donnie Oden, County Facilities Maintenance and
Development Services Director, added that while conducting the study, it was observed the majority of
spaces occupied at the corner of Northwest 6#1 Avenue, were Sheriffs Office employees. County and
Sheriffs Office Staff are working toward resolving this by proposing to move surplus vehicles from the
Sheriff Office on -site parking lot to another area on their property. This would allow Sheriff Office employees
to park in their designated area and open more on -street spaces.
Following a lengthy discussion, the consensus of the TRC was to reject the proposal to indefinitely defer off-
street parking construction, and require the 22-space parking area identified on the Master Site Plan as
"Future Parking," and located on the Northwest corner be constructed by Fiscal Year 2014-2015. In addition,
a Photometric Lighting Plan will need to be submitted prior to constructing the parking. Discussion then
turned to the Landscaping Plan, which needs to be modified to include seven additional trees along
Northwest 4th Street. It was noted that the County Extension Office staff examined the mature oak tree on
the site and it will have to be removed.
Comments from the Departments:
County. Environmental Health Department: No issues were received.
OUA: Mr. Hayford stated the project would be connecting to the water main tied onto Northwest 711 Avenue
extending eastward under the skate park, and further to Northwest 3rd Street; and tying into the existing 2-
inch water main on Northwest Sh Avenue. A fire hydrant will be installed at the corner of Northwest 5th
Avenue and 3rd Street to provide additional fire protection for the south side. In regards to wastewater, the
project will be tying into the gravity line running along Northwest 5th Avenue. OUA Field Crews completed
pressure testing for the site; an issue with slower flow was discovered on Northwest 2"d Street which could
be due to deteriorating values on Parrott Avenue (Highway 441), these will be scheduled for repair after the
winter season.
Building Official: Mr. Newell's main concern was employee parking. The reason for the new building is
because of the state's requirement that the driver's license bureau be housed with the Tax Collectors office.
This will create an increase in traffic for this area and he suggested a designated employee parking lot.
Public Works: Mr. Allen was concerned with parking as well and with how the County would be enforcing the
designated parking areas for the employees. His other concern was maintaining enforcement consistency of
allowing the County to park on unimproved areas, when other businesses have been required to improve
the parking area, or move the vehicles. One suggestion noted was to add signage for employee only
parking area.
Police Department: No issues were received.
Fire Department: Chief Smith noted that all entrances, exits, and alleyways would have to be open for Fire
Department equipment, and marked appropriate for no parking in these areas.

A. Okeechobee County.13-001-TRC continued.
Fire Chief Smith moved to approve Application No. 13-001-TRC to construct a new 12,000 square
foot government office building and drive—thru located at 300 NW 6th Avenue, with the following
contingencies: The TRC finds and recommends to the City Council that there is sufficient surplus
on -street parking in the immediate vicinity of the proposed building to iustify the reduction of the
required parking by 13 spaces. The TRC finds and recommends to the City Council that there is
sufficient surplus parking in the immediate vicinity of the proposed building to justify deferral of the
construction of a 22 space parking lot until 2014/15 Fiscal Year. The Landscape Plan be modified to
include seven additional trees to be located in the 10-foot perimeter buffer along the 170 foot of
frontage of the project along Northwest 4th Street. Submittal of a Photometric Lighting Plan meeting
the requirements of City Code Section 78-71(a)(5) prior to construction of the 22 space parking lot;
seconded by Public Works Director Allen. Motion carried unanimously.

Solid Waste Disposal:
On a number of occasions the County has confirmed a considerable level of excess capacity
available to serve the solid waste disposal needs of other developments in the City. It appears
reasonable that the volume of solid waste associated with a development of this size can also be
accommodated within the capacity of the County's Solid Waste Facility.
Traffic:
While the new office building represents an increase in floor space, the activities undertaken in
the new building are essentially the same as in the existing office building at the northeast corner
of the subject property. Rather than any significant increase in traffic we expect there will be
more of a shift in traffic to NW Wh Avenue because this is where the primary access to the new
PA/TC/DL building is located. We do not expect the change in the traffic pattern to result in
congestion in the vicinity.

CONTINUED DISCUSSION ON REQUIRED PARKING
Chastain -Skill, Inc., the County's Consultant, conducted a utilization study of the 121 on -street
parking spaces located along both sides of the streets bordering block 127, the subject
property. The numbers of vehicles parked along each of the street faces and on the site of the
current Property Appraiser and Tax Collector offices were recorded at 10:00 am and 3:00 pm
each weekday from June Oh through the 22nd. If we accept the conclusions of the study, on
average, 70 of the 121 on -street parking space are occupied at these times leaving a surplus of
51 spaces. This survey was conducted to include consideration of another future office building.
The result of the study, is that the County and its Consultant feel that there is adequate on -
street parking to address the needs associated with the use of the existing building by the
Sheriffs Department employees and the occupancy of the new PA/TC/DL building, current
parking demand and some of the parking need for the future building.
Since the future building has been "taken out of the equation", the revised site plan deals with
the need for parking only at the PA/TC/DL building and uses the parking survey data for on -
street parking areas E, C and F only, which are closest to the PA/TCIDL building. While these
three on -street areas contain 50 parking spaces, we believe the easternmost five spaces on
NW 3"' Street (area C) are not sufficiently convenient to the main entryway to be considered as
parking to serve the PA/TC/DL office building.
The Applicant has stated that the data substantiate that there is already adequate on -street
parking to address current parking demand as well as all of the parking demand associated with
the new PA/TC/DL building. Therefore they are requesting not only the 13 space reduction in
parking due to surplus on -street parking, but also deferral of the remaining 14 off-street parking
spaces needed for the PA/TC/DL building.
We do not entirely agree. The parking survey data indicate that, with just the 45 on -street
parking spaces, about half (43%) of the time there will be adequate on -street parking to serve
existing demand and that associated with the new PA/TC/DL building. If we add two spaces,
parking will be adequate 64% of the time. With three additional spaces there will be adequate
parking 72% of the time. Four additional spaces will result in parking being sufficient 88% of the
time. In order to ensure that there is always adequate parking, seven additional spaces would
be needed.
We have spoken with the Applicant about our initial findings and he has suggested that they are
proceeding to arrange for alternate parking for some employees or customers of the County

Recommendation
Based on the foregoing analysis and comments, we recommend approval of the site
plan with the following stipulations.
The TRC finds and recommends to the City Council that there is sufficient surplus
on -street parking in the immediate vicinity of the proposed building to justify the
reduction of the required parking by 13 spaces.
2. The TRC finds and recommends to the City Council that there is sufficient surplus
on -street parking in the immediate vicinity of the proposed building to justify deferral
of the 14 required off-street parking spaces remaining as a result of the reduction in
parking requirements identified in Stipulation #1; and further, that the Applicant
enter into the written agreement outlined in Sec. 90-483(4)(b).
3. The landscape plan is modified to include seven additional trees to be located in the
10-foot perimeter buffer along the 170 of frontage of the project along NW 4th
Street.
4. The Applicant submits a photometric lighting plan meeting the requirements of Sec.
78-71(a)(5).
