Petition No. 12-005-SE, submitted by Amy Gibson, on behalf of Petition No. 12-005-SE,was submitted by Amy Gibson,on behalf of property owners J. Neal and Linda Wright,for Lots property owners J. (Ref. Sec. 90-223 (2)). 1. Hear from Planning Staff. Chairperson Hoover yielded the floor to Planning Consultant Brisson who explained that the petition was for a beauty shop in part of an existing building now used for dental offices. According to the petition, the beauty shop initially will have two service chairs with the intention of adding one more in the future. He elaborated that today's beauty shops offer more services than hair cuts such as manicures, pedicures, and massages. The station used for whatever the service offered is counted as a"chair",the parking will be the deciding factor as to how many"chairs/stations"the shop could have.There are 16 off-street parking spaces available for both businesses.This would easily allow for the dental office and three service chairs/stations. The current codes require two parking spaces per chair(service/station), and the dental office is required to have eight spaces. 2. Hear from the property owner or designee/agent. The property owners and applicant were present and did not have anything they wished to address the Board with at this time. 3. Public comments or questions from those in attendance, or Chairperson Hoover asked whether there were any comments or questions from those in attendance.There was none. submitted to the Board Secretary. Secretary Burnette distributed copies of four letters she received from surrounding business owners stating they had no objections to the Special Exception being granted. Their names and addresses are: Lisa Morgan of Farm Bureau Insurance Co.,at 401 Northwest 4th Street;Wes Williamson of Williamson Cattle Company,at 300 Northwest 5th Street; Louis E. Larson, Sr., President of Larson Dairy, Inc., at 400 Northwest 5th Street; and Noel Stephen, Undersheriff for the Okeechobee County Sheriffs Office, at 405 Northwest 4th Avenue. 4. Disclosure of Ex-Parte communications by the Board. Chairperson Hoover asked whether Board Members had ex-parte communications to disclose for the record. Member Brass stated she visited the subject property and spoke with the applicant about the salon. 5. a) Consideration of a motion to approve or deny petition. Planning Staff's findings are as follows: The use is not contrary to the Comprehensive Plan as the Commercial Future Land Use category envisions a wide variety of commercial uses including a beauty salon. The use is authorized as a Special Exception in the CPO Zoning District per Section 90-223 (2). The use will not have an adverse effect on the public interest as it will not significantly differ from those associated with the current use of the building. The use is appropriate for the proposed location as the property is located in an area that is primarily envisioned for commercial uses, is reasonably compatible with the adjacent uses of office, professional and public, and is not detrimental to 4 1 0 JANUARY 17,2013-PLANNING BOARD-PAGE 4 OF 5 AGENDA ACTION - DISCUSSION -VOTE VI. PUBLIC HEARING (QUASI-JUDICIAL) CONTINUED. 5. a) Consideration of a motion to approve or deny Petition No. urbanizing land use patterns as this area anticipates professional uses and offices and their supporting uses. The use 12-005-SE. will not adversely affect property values or living conditions, nor be a deterrent to the development of adjacent property being that its'characteristics are much like that of the dental use occupying the remainder of the building. No additional landscaping or screening is necessary to buffer the use from adjacent uses as the building in which the beauty salon will operate has been designed and used for medical office uses. The use will not create a density pattern that will overburden public facilities as density is not an issue with a commercial use and no increase in commercial intensity is envisioned. The use will not create traffic congestion nor will traffic safety be compromised by location of the beauty salon within the building. Drainage will remain essentially the same as previous since there is no physical change to the structure. (4) Demonstrate what is proposed to reduce the impacts of any potential hazards, problems or public nuisance generated by the use or explain how the nature of the use creates no such potential problems. (5) "Potential hazards include chemicals related to hair salons and will be disposed via the existing sewer hook - ups." While the Applicant has identified that chemicals will be used, these are common chemicals used in hair salons throughout the City. They will cause no special hazard to the area. We see no potential hazards that will be associate with the proposed use in this location. Demonstrate how the utilities and other service requirements of the use can be met. "All utilities and other service requirements are met. Recognizing that the property has been used as a dental office for some time and the utility and service requirements for medical offices does not appreciably differ from those for a beauty salon, it is clear to us that utilities and other service requirements have been and will continue to be met. (6) Demonstrate how the impact of traffic generation will be handled off site and on- site. "There is plenty of on site parking (15 parking spots 2 of these are handicap) off site traffic would be normal." Aerial photographs of the property indicate that there are 16 formal parking spaces on the site, one of which appears to be for the handicapped. Based on the floor plan and square footage figures provided by the owner (see floor plan and table at the end of the document), the dental offices occupy about 1,448 square feet of net commercial space. Section 70- 373(c) (1) — (8) When reaching a conclusion on a Special Exception request, the Board of Adjustment shall consider and show in its record the following findings as set forth in Section 70- 373(c)(1) — (8). There are other salons nearby." The location of a beauty salon in the building should have no impact that would be expected to adversely affect property values or living conditions in the area. Its characteristics are much like those of the dental use occupying the balance of the building. (6) The use may be required to be screened from surrounding uses to reduce the impact of any nuisance or hazard to adjacent uses. (7) "It will not require any screening.
