This letter is to officially advise you that the Board of Adjustments at its regular meeting on January 17, 2013, approved your request to
allow a Barber shop, Beauty shop within a Commercial Professional Office(CPO)Zoning District(Ref. Sec. 90-223(2)).
In addition, I would like to make sure you are aware that you will need to follow up with the Finance Department in order to add a
Business Tax Receipt(BTR)for the Beauty shop. Kim Barnes can assist you with this, her contact information is, 863-763-3372 ext.

There are two important timelines you need to be aware of regarding Special Exceptions.When they are granted,the owner has a
period of two years to submit for a building permit in order to make the necessary modifications that allow the Special Exception,or it
will become invalid [Sec. 70-348(4)]. The next is,should you not keep the Beauty shop BTR active for more than 180 continuous days,
at the location,then the Special Exception will become invalid [Sec. 70-373(8)(f)]. Once a Special Exception becomes invalid,the
owner has to go through the entire process for approval.

1. Hear from Planning Staff. Chairperson Hoover yielded the floor to Planning Consultant Brisson who explained that the petition was for a beauty
shop in part of an existing building now used for dental offices.According to the petition,the beauty shop initially will
have two service chairs with the intention of adding one more in the future.He elaborated that today's beauty shops
offer more services than hair cuts such as manicures,pedicures,and massages.The station used for whatever the
service offered is counted as a"chair",the parking will be the deciding factor as to how many"chairs/stations"the shop
could have.There are 16 off-street parking spaces available for both businesses.This would easily allow for the dental
office and three service chairs/stations.The current codes require two parking spaces per chair(service/station),and
the dental office is required to have eight spaces.
2. Hear from the property owner or designee/agent. The property owners and applicant were present and did not have anything they wished to address the Board with at
this time.
3. Public comments or questions from those in attendance,or Chairperson Hoover asked whether there were any comments or questions from those in attendance.There was none.

Land Use category envisions a wide variety of commercial uses including a beauty salon.The use is authorized as a

public interest as it will not significantly differ from those associated with the current use of the building.The use is
appropriate for the proposed location as the property is located in an area that is primarily envisioned for commercial

Description of the Situation
The parcel carries a Future Land Use designation of Commercial and is zoned CPO,
Commercial Professional and Office District. It has been a dental office for some time
and the Applicant wishes to occupy about 1,000 square feet in which to operate a
beauty salon. The salon will initially involve two service chairs with the intention to have
up to three service chairs in the future. The balance of the building will continue to be
used for the dental offices. There are now 16 off-street parking spaces located on the
site, one of which is a handicapped space.
Consistency with Land Development Regulations
Section 70-373(b) requires that the Applicant address the following standards for
granting a Special Exception, during his/her presentation to the Board of Adjustment.
The Applicant has submitted, as part of the submission, brief statements and informa-
tion addressing these standards. The Applicant's statements are shown in Times Roman
typeface. Staff comments follow and are shown in bold Arial typeface.
(1) Demonstrate that the proposed location and site are appropriate for the use.
"Site is appropriate for the proposed use because it was designed for a business. Location
is appropriate because other similar barber/beauty shops are in the area."
We agree that the location and site are appropriate for the use. The
property is located in an area that is primarily envisioned for commercial
uses. Personal service uses such as a beauty salon are generally
considered appropriate in proximity to concentrations of office,
professional, and public uses.
(2) Demonstrate how the site and proposed buildings have been designed so they
are compatible with the adjacent uses and the neighborhood, or explain why no
specific design efforts are needed.
"No specific design efforts are needed, because proposed building is already compatible
with adjacent uses, and the neighborhood."
We agree. The building in which the beauty salon will operate has been
designed and used for medical office uses. The operational characteristics
and impacts of a beauty salon will not materially differ from those normally
associated with medical offices. Therefore, no specific design efforts are
necessary.

(3) Demonstrate any landscaping techniques to visually screen the use from
adjacent uses; or explain why no visual screening is necessary.
"No screening is necessary as the proposed use will not be visually unappealing."
We agree. The building in which the beauty salon will operate has been
designed and used for medical office uses. The operational characteristics
and impacts of a beauty salon will not materially differ from those normally
associated with medical offices. Therefore, no additional landscaping or
screening is necessary.
(4) Demonstrate what is proposed to reduce the impacts of any potential hazards,
problems or public nuisance generated by the use or explain how the nature of
the use creates no such potential problems.
"Potential hazards include chemicals related to hair salons and will be disposed via the
existing sewer hook-ups."
While the Applicant has identified that chemicals will be used, these are
common chemicals used in hair salons throughout the City. They will
cause no special hazard to the area. We see no potential hazards that will
be associate with the proposed use in this location.
(5) Demonstrate how the utilities and other service requirements of the use can be
met.
"All utilities and other service requirements are met."
Recognizing that the property has been used as a dental office for some
time and the utility and service requirements for medical offices does not
appreciably differ from those for a beauty salon, it is clear to us that
utilities and other service requirements have been and will continue to be
met.
(6) Demonstrate how the impact of traffic generation will be handled off site and on-
site.
"There is plenty of on site parking (15 parking spots 2 of these are handicap) off site
traffic would be normal."
Aerial photographs of the property indicate that there are 16 formal parking
spaces on the site, one of which appears to be for the handicapped. Based
on the floor plan and square footage figures provided by the owner (see
floor plan and table at the end of the document), the dental offices occupy
about 1,448 square feet of net commercial space. At one space per 180

square feet, the dental offices will require 8 spaces. A beauty salon with
three service chairs requires six parking spaces (two per service chair).
Therefore there is adequate parking to accommodate both the existing use
and the proposed beauty salon.
In addition, there is no reason to expect that traffic impacts will vary
significantly from those that have been associated with the dental business
in the past.
Section 70-373(c) (1) — (8)
When reaching a conclusion on a Special Exception request, the Board of Adjustment
shall consider and show in its record the following findings as set forth in Section 70-
373(c)(1) — (8). The required findings are listed below followed by the Applicant's
statements in Times Roman typeface after which are the Staff comments pertaining to
these findings:
(1) The use is not contrary to the Comprehensive Plan requirements.

We agree. The Commercial Future Land Use Category envisions a wide
variety of commercial uses, and a beauty salon falls within this category of
uses.
(2) The use is specifically authorized as a special exception use in the zoning

We agree. The CPO district allows a beauty shop as a Special Exception
use.
(3) The use will not have an adverse effect on the public interest.

from those associated with the current use of the building.

professional, and public uses. The land use pattern in this area anticipates
professional uses and offices and their supporting uses.
(5) The use will not adversely affect property values or living conditions, nor be a
deterrent to the development of adjacent property.

The location of a beauty salon in the building should have no impact that
would be expected to adversely affect property values or living conditions
in the area. Its characteristics are much like those of the dental use
occupying the balance of the building.

impact of any nuisance or hazard to adjacent uses.

We agree that neither will traffic congestion be increased nor traffic safety

Recommendation
Based upon the foregoing analysis and findings, Staff recommends that Petition

F::4R1 DA; AMENDING APPENDIX A BEING THE COMPREHENSIVE ZONING
ORDINANCE OF THE CITY OF OKEECHOBEE WHICh ESTABLISHES ZONING
REGULATIONS AND PROVIDES FOR-THE ADMINISTRATION, ENFORCEMENT AND
AMENDMENT THEREOF; PROVIDING FOR A CHANGE IN THE CLASSIFICATION OF
SPECIFIED LAND FROM RG-2 TO C.P.O.
WHEREAS, application has been duly made to change the zoning classification as

WHERXIS, all public notices have been duly published according to law, and
WHEREAS, public hearings have been held as required by Appendix A, the Comprehensive
Zoning Ordinance of the City of Okeechobee, and
WHEREAS after consideration of the requirements of the Comprehensive Zoning
Ordinance and the land use plan of the City of Okeechobee as set out in the City
of Okeechobee Comprehensive Plan and further after consideration of the public's
interest it is deemed to be in the best interest of the City of Okeechobee to change
