Mayor Kirk called the February 19, 2013, Regular City Council Meeting to order at 6:00 p.m. In the absence of Father Edward Weiss, Pastor Patterson of the Presbyterian Church offered the invocation; The Pledge of Allegiance was led by Mayor Kirk. Consider Temporary Street Closings submitted by First Baptist Council Member Watford moved to approve Temporary Street Closing applications submitted by First Baptist Church, Church - City Administrator (Exhibit 1). to temporarily close Southwest 41h Street between 5th and 6th Avenues on March 2 for the Upward Basketball and Cheerleader Awards, and on May 17 through 19 for D-Now Weekend, to re-route traffic as one-way around the ROC, 1. Upward Basketball & Cheerleading Awards Day -March 2, 2013. entering from Southwest 3'd Street, exiting onto Southwest 41h Street during pick up and drop off times and keeping 2. Consider appointments to the Okeechobee Utility Authority Board of As provided by the Interlocal Agreement creating the Okeechobee Utility Authority, the City appoints residents to serve Directors - City Clerk. on the Board of Directors. The terms for a regular and alternate member are sun setting March 1, 2013. To date City Staff has not received any new applications from citizens requesting to be considered for appointment. The current members were contacted and agreed to be reappointed. Council Member Maxwell moved to reappoint Noel Chandler, regular member term being March 1, 2013 to March 1, 2017, and Jeff Fadley alternate member, term being March 1, 2013 to March 1, 2015, as the City's representatives to the Okeechobee Utility Authority Board of Directors; seconded by Council Member O'Connor. The Mayor and Council noted their appreciation to Mr. Chandler and Mr. Fadley for their willingness to serve. VOTE KIRK - YEA MAXWELL- YEA O'CONNOR - YEA WATFORD - YEA WILLIAMS - YEA MOTION CARRIED. C. Consider appointment to the Chamber of Commerce of Administrator Whitehall explained that the Chamberof Commerce of Okeechobee County President, Terry Burroughs, Okeechobee - City Administrator. contacted him and asked whether the City Council would consider appointing a member to serve as liaison to their Board, similar to what they do for Okeechobee Main Street. Council Member Maxwell interjected he would volunteer for the appointment. He was recently appointed to serve on the Workforce Development Board of the Treasure Coast, but was notified they no longer have local governmental representatives for their board. Mayor Kirk noted for the record that Council Member Maxwell volunteered, and is now appointed to serve as the City's Liaison to the Chamber of Commerce of Okeechobee County for a two-year term, ending January 2015. Kirk, Mayor U Lane Gamiotea, dMC, City Clerk As provided in Attorney Cook's employment services contract, each year the Mayor and Council Members complete an evaluation on Attorney Cook's employment performance. Mayor Kirk received the evaluations and calculated an average score of 4.025 out of 5.0. Mayor Kirk thanked Attorney Cook for the service he provides to the City. Attorney Cook thanked the Council for their confidence in him. The evaluations were forwarded to the City Clerk for final processing and retention. The positive review allows for the contract to automatically renew for another year. Administrator Whitehall's employment services contract provides for an annual evaluation of his employment performance by the Mayor and Council. Mayor Kirk received the evaluations and calculated an average score of 4.925 out of 5.0. Mayor Kirk thanked Administrator Whitehall for the service he provides to the City. Administrator Whitehall thanked the Council for their confidence in him. The evaluations were forwarded to the City Clerk for final processing and retention. The positive review allows for the contract to be renewed for another year and eligibility for the Salary Step Increase on his anniversary date June 1, 2013. When Fred Sterling is able to contact her, she hints around that she will come out and pull a few weeds, but nothing substantial is being done, nor does it appear that any improvement is on the horizon. I explained some options to the board: 1. do nothing 2. foreclose on the property 3. file for an inspection warrant 4. file a lawsuit for public nuisance The board elected to suggest the filing of an inspection warrant. This is a procedure authorized by Florida Statutes to obtain a warrant, basically a county court order after notice to Mrs. Mills, which if granted gives the City the right to enter upon private property to abate a nuisance or code violation against the wishes of the landowner. One problem here is that since the violation is overgrowth and cleaning, if we go to the expense to do this, we may be looking at the same violation a couple of months from now when it grows back. The other options are more final in nature, as the foreclosure grants ownership, with a sale to satisfy our lien, and a nuisance lawsuit, which is what we filed in Brantley's case, is a final court judgment that is enforceable via contempt powers of the court. Any of the legal options will incur expense and fees, none of which would probably be recoverable unless the property were sold someday. Some time ago the City also posted general contact information for the City Council on our web site. The City has only rec'd a couple of comments thereon, always asking for some record clarification. Last week we rec'd this request (which I see was in Speak Out): Sent: Sunday, February 10, 2013 7:43 AM To: citycouncil@citvofokeechobee.com Subject: Sunday liqour (sic) ban Dear Sir; There has been a discussion on the Okeechobee Newszap forum about just when and if the Sunday ban on liquor sales occurred. There seems to be much confusion. Could you inform me as to when the ban was originally adopted? Thanks for your attention. Forum member LPM I answered the inquiry based on research the Clerk did back in 2011, the last time we discussed the matter: According to a search of the records, in 1957 the City adopted an ordinance prohibiting the sale of alcohol on Sundays after a joint City/County roundtable on the matter. In 1977, the City Council adopted an ordinance providing for the sale of beer and wine on Sundays. Each of these ordinances did not differentiate the method of sales (i.e. restaurant, package, etc) In conclusion, I've attached a memo that I sent to Atty Cook explaining the City Council's directives from the last meeting. • Chamber representative appointment on Agenda — I rec'd a call from the Chamber asking the City to consider making a representative/liaison appointment in much the same fashion that the City made other appointments to area organizations in January. • Evaluations for the City Administrator and City Atty are on the Agenda. • CDBG Housing rehab project bids scheduled for opening at 2/19/13 - Mattie Ervin, 920 NW 9"' St Mary Massey, 504 NW 17th St Mary Koger, 915 NW 12th St These three projects have successfully been thru the qualification process and `walk thru'. Budget summary: $560k-housing rehab; $105k admin; $35k occupant relocations. Have a Dept of Economic Opportunity, DEO (formerly DCA) monitoring visit scheduled for 2/27/13. • Rep Cary Pigman proposed office in the Chamber Bldg — According to the Chamber, all provisions have been agreed to and Representative Pigman signed the lease commencing February 1, but has not moved in to date. • Jan 9 OUA minutes are enclosed in the packets. Dobbs advised they are still pursuing SFWMD approval. It's my understanding that he wishes to change the use to a fitness facility. City Clerk: • Activity report is attached. Finance: • Activity report is attached. • Property Casualty Insurance info from 2/6/13 PRM Board meeting — Broker's Report: The broker advised that 2011 was the second worst CAT (catastrophic) loss year in history. Property rates rose in 2012 due to the CAT losses and RMS 11.0 modeling. Property rates are not expected to decrease. if no CAT losses are incurred in the first six months of 2013, rate increases are estimated to be 0-7%. The Workers' Compensation market hardened in 2012 causing rate increased across the State. Rising medical costs contributed to the rate increase. NCCI (National Council on Compensation for Insurance) 2013 rates increased an average of 6.8% for the third straight year of rising rates. This trend is expected to continue with increased of 5-15%. A firming Liabili marketplace in 2012 as well as significant Employment Practices and Errors & Omissions claims may push rates upward. The broker reviewed the renewal timeline, advising the process to achieve quotes from carriers in order to provide Members with an estimated budget number by July 1. WRM will deliver proposals to Members during August. Public Works: • SW 21st Storm Sewer County grant funded project — Rec'd copy of 1/22/13 letter from the County to the state certifying completion of the project. The last pay estimate reflects a contract amt of $481,189, within $3,000 of the bid amount of $483,893. • SR 70 (Applebee's) turn lane project — This project is slowly going through the bureaucratic process. Had a meeting Phillips and Matthews (Culpepper/Terpening) on this project (not the 21st project as mentioned in the last report. We are modifying the plans a bit to optimize the grant including a complete overlay of the project area ... which was our original intent anyway. Have a monitoring site visit scheduled for 2/28/13 from DEO. • Roundabout replacing signal at SW 5th Av and S Park St — Spoke to Bill Blazak, Culpepper and Terpening and he's given me a draft of how the roundabout can be installed, albeit centered to the north a bit. They plan to perfect a presentation by giving an artist's rendition in the next few weeks. End....
