Now. AN ORDINANCE OF THE CITY OF OKEECHOBEE,FLORIDA;AMENDING
THE OFFICIAL ZONING MAP OF OKEECHOBEE, BY REZONING
CERTAIN TRACTS OF LAND MORE PARTICULARLY DESCRIBED
HEREIN,FROM HOLDING TO RESIDENTIAL SINGLE FAMILY-ONE(RSF-
1); FROM HOLDING TO INDUSTRIAL(IND); FROM HOLDING TO PUBLIC
FACILITIES (PUB); FROM HOLDING TO HEAVY COMMERCIAL (CHV);
AND FROM HOLDING TO RESIDENTIAL MULTIPLE FAMILY (RMF);
AMENDING THE ZONING MAP ACCORDINGLY; PROVIDING FOR
CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Okeechobee, Florida has adopted Ordinance
No. 402 in which a revised Official Zoning Map was adopted for said City; and
WHEREAS, the City of Okeechobee, pursuant to the Land Development Regulations of
the City of Okeechobee and Florida Statutes has initiated certain tracts of land to
be rezoned from Holding (H) to: Residential Single Family-One (RSF-1) Zoning
District, Industrial (IND) Zoning District; Public Facilities (PUB) Zoning District;
Heavy Commercial (CHV) Zoning District; Residential Multiple Family (RMF); and
that this request be removed from the boundaries of the above mentioned zones to
allow for the processing of the rezonings; and
WHEREAS, said proposed rezonings were submitted by Planning Staff report and
reviewed by the City's Planning Board at duly advertised Workshops held on May
17, 2012 and June 21, 2012 and at a Public Hearing held on September 20, 2012.
Said Board determined such rezonings to be consistent with the Comprehensive
Plan and is appropriate with the zoning uses within the City; and
WHEREAS, the City Council has agreed with the recommendation of the Planning Board
and hereby finds such rezonings consistent with the City's Comprehensive Plan and
deems it in the best interest of the inhabitants of said City to amend aforesaid
revised Zoning Map as hereinafter set forth.
NOW THEREFORE, be it ordained before the City Council of the City of Okeechobee,
Florida; presented at a duly advertised public meeting; and passed by majority vote
of the City Council; and properly executed by the Mayor or designee, as Chief
Presiding Officer for the City; that:

On September 5, you were mailed a letter explaining that the City was considering a rezoning on
your property. At the October 16 Public Hearing the City Council voted down this proposal. The
matter is going back to the Planning Board.
The Council instructed Planning Staff to obtain a recommendation from the Planning Board to:
(1) Establish a Holding Zoning District with regulations and restrictions;
(2) Amend the Comprehensive Plan Future Land Use Element to allow Holding Zoning
Districts within specific land use categories;
(3) Offer what Zoning Districts should be amended to allow light agriculture as a Permitted
Use, as well as, define light agriculture;
(4) Have each property owner advise whether they want to keep the current Holding Zoning
or change to the new proposed Zoning.

Several years ago,the City of Okeechobee adopted new zoning laws entitled Land Development Regulations
or LDR's. During this time the Zoning District Holding was deleted. The City has not taken any action to
change these zoning designations unless it was initiated by the property owner, as most of these properties
are undeveloped large parcels.
The City also adopted,as mandated by the State as part of the Growth Management Act, a Future Land Use
map. This map identifies what each property within the City Limits will be classified by using the existing use
or surrounding uses, if vacant.
It has now become necessary to address the Holding zoned properties in order to make both maps consistent.
The City is officially notifying you that your property described below, is being rezoned from Holding to
Residential Single Family-One. This change may affect your property assessment. I encourage you to call

A. Motion to award contractors for FY 2011 CDBG-HR Program,Bid As well,each contractor must satisfactorily complete one job through the CDBG-HR before receiving any additional

effective to the program and not necessarily to the apparent low bidder.The Cebrena Thomas project will need to be
awarded at a later date as the recommended contractor will have to finish a previously awarded project.Finally,the
bid for the Maria Gomez project will need to be rejected as the applicant no longer meets the requirements for the
grant.Mr.Harry Schack and his wife were in attendance,and wished to thank the Council for their endeavors on being
awarded the housing grant,which is allowing them an opportunity to fix their home.
Council Member Watford moved to award Bid No.RFP 05-00-09-12 for the Fiscal Year 2011 Community Development
Block Grant-Housing Rehabilitation Program[No.11 DB-C5-07-57-02-H-081,as presented in Exhibit Three(and listed

b) Public discussion and comments. Planner Brisson appeared before the Council,outlining each parcel that is being considered for rezoning. These
rezonings stem from the Comprehensive Plan Evaluation and Appraisal Report(EAR),adopted by the City Council
last year.This report denoted the number of inconsistent zonings when compared to the Future Land Use Map and
that within the coming year the City would address these issues.The first areas Planning Staff is recommending the
City address are the properties currently zoned"Holding."As of October 6,1998 there were no longer regulations for
this zoning district.The Planning Board is unanimously recommending approval.All the property owners were mailed
a certified letter explaining the proposed changes and that any questions regarding their taxable value or agriculture
exemption status needed to be addressed with the Property Appraiser's Office.The properties had a sign posted on
them and all surrounding owners within 300 feet were notified as well.
The zoning for the following described properties, are being considered to be changed from Holding to Residential
Single Family-One,based on and as recommended by the Planning Staff Report findings. The FLU is already Single

Mayor Kirk asked whether there were any questions or comments from the public.There was a lengthy discussion
between the Council, Planning and City Staff,several property owners in attendance and about whether the City
should allow the Holding zonings to continue so not to jeopardize anyone's agriculture exemption status.
There was quite the discussion and confusion on properties that have an agriculture use verses an agriculture
exemption.The City Council has always allowed agriculture uses,regardless of the zoning,as that is the heritage and
main revenue source of Okeechobee,Many 4-H and FFA students live within the City.These students raise various
types of show livestock and as long as the neighbors are not impacted by health hazards or other nuisances by the
animals,they are allowed.When an owner can meet the statutory requirements,regulated by the Property Appraiser,
they can obtain an agriculture exemption on their property assessments.Most of the large parcels considered within
this ordinance have an agriculture exemption and agriculture use.

withdrawn from the floor as the Council considered it better to start the entire matter over with additional instruction.

izr Discussion regarding additional instructions due to proposed Council Member Watford moved to send the proposed rezonings back to the Land Planning Agency(Planning
Ordinance No.1093 being voted down. Board),that they consider a recommendation to create a Holding zoning category to include light agriculture
uses,that they give the effected property owners an opportunity to either remain at Holding or choose the
appropriate zoning;seconded by Council Member O'Connor.
In response to Council Member Maxwell's question of whether this course of action would necessitate the City to
create a Holding FLU classification,Planner Brisson responded,to keep the Holding zoning district,we would need
to add the wording in the Comprehensive Plan.The Council was clear that they are not wanting to create a Holding
FLU classification,nor a means to change the FLU map to Holding.What they want addressed are issues such as
the Holding zoning allowing light agriculture uses and that this zoning is allowed within certain FLU categories.The
Planning Board will need to ensure they review all the FLU categories so not to exclude any that are already in use,
as there may be other FLU categories that will require Holding zoning and/or light agriculture uses addressed.
In addition,the Planning Board should consider amending the Zoning District categories and create regulations for
a Holding zoning, using the previously adopted "orange book" as a guide. They should also look at adding light
agriculture uses in other Permitted Principal Uses for other Zoning Districts as the City allows this use.Council Member
Maxwell also asked whether addressing the issues in this manner still meet the purpose of the EAR? Mr. Brisson
replied,essentially yes,as the purpose of the EAR,was to make the Comprehensive Plan and Zoning complimentary.
Council Member Watford asked Attorney Cook whether he needed to abstain from voting since he is a Trustee of one
of the subject properties.Attorney Cook replied he did not think so as it is not a personal gain.

A.1. Future Land Use designation and Zoning district conflicts that are Williams was present on behalf of the property owner to request a Mixed PUD Zoning rather than the RSF-1.The
