-.ORDINANCE DENIED AT FIRST READINGF ORDINANCE NO. 1093 AN ORDINANCE OF THE CITY OF OKEECHOBEE,FLORIDA;AMENDING THE OFFICIAL ZONING MAP OF OKEECHOBEE, BY REZONING CERTAIN TRACTS OF LAND MORE PARTICULARLY DESCRIBED HEREIN,FROM HOLDING TO RESIDENTIAL SINGLE FAMILY-ONE(RSF- 1); FROM HOLDING TO INDUSTRIAL(IND); FROM HOLDING TO PUBLIC FACILITIES (PUB); FROM HOLDING TO HEAVY COMMERCIAL (CHV); AND FROM HOLDING TO RESIDENTIAL MULTIPLE FAMILY (RMF); AMENDING THE ZONING MAP ACCORDINGLY; PROVIDING FOR CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Okeechobee, Florida has adopted Ordinance No. 402 in which a revised Official Zoning Map was adopted for said City; and WHEREAS, the City of Okeechobee, pursuant to the Land Development Regulations of the City of Okeechobee and Florida Statutes has initiated certain tracts of land to be rezoned from Holding (H) to: Residential Single Family-One (RSF-1) Zoning District, Industrial (IND) Zoning District; Public Facilities (PUB) Zoning District; Heavy Commercial (CHV) Zoning District; Residential Multiple Family (RMF); and that this request be removed from the boundaries of the above mentioned zones to allow for the processing of the rezonings; and WHEREAS, said proposed rezonings were submitted by Planning Staff report and reviewed by the City's Planning Board at duly advertised Workshops held on May 17, 2012 and June 21, 2012 and at a Public Hearing held on September 20, 2012. Said Board determined such rezonings to be consistent with the Comprehensive Plan and is appropriate with the zoning uses within the City; and WHEREAS, the City Council has agreed with the recommendation of the Planning Board and hereby finds such rezonings consistent with the City's Comprehensive Plan and deems it in the best interest of the inhabitants of said City to amend aforesaid revised Zoning Map as hereinafter set forth. NOW THEREFORE, be it ordained before the City Council of the City of Okeechobee, Florida; presented at a duly advertised public meeting; and passed by majority vote of the City Council; and properly executed by the Mayor or designee, as Chief Presiding Officer for the City; that: SECTION 1. There was quite the discussion and confusion on properties that have an agriculture use verses an agriculture exemption.The City Council has always allowed agriculture uses,regardless of the zoning,as that is the heritage and main revenue source of Okeechobee.Many 4-H and FFA students live within the City.These students raise various types of show livestock and as long as the neighbors are not impacted by health hazards or other nuisances by the animals,they are allowed.When an owner can meet the statutory requirements,regulated by the Property Appraiser, they can obtain an agriculture exemption on their property assessments.Most of the large parcels considered within this ordinance have an agriculture exemption and agriculture use. Memorandum To: Betty Clement From: Bill Brisson Date: October 27, 2009 Subject: Need for rezoning, etc. re: division of McNair property Per our recent telephone discussions, and a telephone conversation with Steve Dobbs, we offer the following comments regarding the McNair property located at the southwest corner of SW 7th Avenue and the municipal limits of the City of Okeechobee. The Situation: According to the Okeechobee County Property Appraiser's website, the property encompasses 12.21 acres. It carries a designation of Single-Family on the Future Land Use Map (FLUM) and is zoned H, Holding. This zoning district is a hold-over from the previous Zoning Code and is no longer referenced in the current LDC. However, lacking more definitive direction, it is our understanding that"H"zoning has been treated as an active zoning district under the regulations previously in force. These regulations limit residential use to single-family uses on parcels of no less than two acres and having a frontage of at least 200 feet. Development Proposal: According to Steve Dobbs, the owner of the property is interested in dividing the property into six two-acre "flag lots" meeting the minimum 75-foot frontage requirement of the RSF1 zoning district, and selling them individually without having to formally subdivide the property under the City's subdivision requirements. The Questions: 1. The first question is: Is it necessary to rezone the property? Answer: We believe rezoning is necessary for two reasons: A. The "H"district is not officially a current zoning district and all lands in the City should be designated under the current zoning structure of the LDC. B. Most importantly, from a practical standpoint, if the owner wishes to divide the property into lots with just 75 feet of frontage,the property must be rezoned to RSF1. The old"H" district did not/does not allow lots with less than 200 feet of frontage. The second question is: May the property be divided into six two-acre lots, each with 75 feet of frontage on an existing public roadway, without formally platting the property and creating a subdivision that must meet all of the City's subdivision regulations? Answer: Our reading of Chapter 86, Subdivisions, indicates that it is possible, provided the proposed division of land does not meet the definition of a subdivision as set forth in Section 86-4. If the proposed division of land meets any standard in the definition that qualifies as a subdivision, the City's requirements must be met. If not, then the land may be divided without meeting the platting and subdivision requirements of Chapter 86. In order to determine whether or not the City's requirements apply to a given proposal to divide the land and sell individual lots, we believe it is necessary for the owner to submit plans showing the property as it will be divided, including a survey of the property. This submission should be in accordance with Sec. 86-42, which is the preapplication procedure for a preliminary plat. The purpose of the submission is to determine whether or not the proposed division of land qualifies as a subdivision. In addition to the information normally shown on a survey,the following information should be shown: A. The property boundaries of each parcel into which the property will be divided; B. A legal description of each new parcel; C. The acreage of each new parcel; and, D. Road frontage from which each new parcel will gain access. In addition, we suggest that the City require a binding commitment from the owner to prohibit, by deed restriction, any future reduction in the size of any of the parcels created by the division of the property. This will preclude future division of the land which would have, if undertaken during the original division of the land, required conformance to the platting and subdivision requirements of the City. These plans and data should be reviewed by the Technical Review Committee which should then make a written and recorded determination as to whether or not the proposed division of land would need to meet the requirements,processes, and standards of Chapter 86.
