CALL TO ORDER—Chairperson. The meeting was called to order at 10:00 a.m. by Chairperson Whitehall. There was no quorum present, meeting was reconvened until 2:00 p.m. II. STAFF ATTENDANCE—Secretary. MINUTES—Secretary. A. Chief Davis moved to dispense with the reading and approve the May 17, 2012 Technical Review Committee regular meeting minutes; seconded by Building Official Newell. Motion carried unanimously. IV. NEW BUSINESS—Chairperson. A. Florida Public Utilities. 12-003-TRC. Material received from Dan Scribben, Engineering Manager, Florida Public Utilities (FPU), in regard to a Franchise Agreement between the City of Okeechobee and FPU to provide a natural gas system for the area-Chairperson. Technical Review Committee—November 15,2012-Page 2 of 3 A. Florida Public Utilities. 12-003-TRC continued. Chairperson Whitehall explained that the purpose of this discussion was regarding FPU installation of their distribution system as provided for in the recently passed Franchise Agreement with the City of Okeechobee, specifically, Section 12,Construction Work. SECTION 12. CONSTRUCTION WORK: Prior to construction and installation of the gas distribution system, COMPANY shall apply to the CITY for a site plan review through the Technical Review Committee as provided for in City Code Section 70-102. As part of the site plan application the COMPANY shall provide, among other items, preliminary plans describing the extent of the project and the methodology that the COMPANY plans to use for installation, including a timeline for completion of same. The CITY reserves the right to permit to be laid electric conduits, water and gas pipes and lines, cables, sewers, and all appurtenances associated therewith, including but not limited to, curbs and gutters, and to do and permit to be done any work that may be deemed necessary or proper by the CITY or other governmental body having jurisdiction in, across, along, or under any of the public streets, alleys, waterways, easements and other public places of the CITY. Whenever, by reason of establishing a grade or by reason of changes in the grade of any street, or by reason of the widening, grading, paving, or otherwise improving present or future public streets, alleys, waterways, easements and other public places of the CITY, or in the location or manner of construction of any water pipes, electric conduits, sewers, or other structure, it shall be deemed necessary by the CITY or other governmental body to alter, change, adapt, or conform any portion of the Distribution System of the Company hereto, such alterations, or changes, shall be made by the COMPANY as ordered in writing by the CITY or other governing body, without claim for reimbursement. The COMPANY shall, to the best extent possible, conform to and comply with the efforts of the CiTY to maximize the use of the CITY property and to minimize the impact of construction projects by merging projects. If the CiTY shall require the COMPANY to adapt or conform any portion of its Distribution System or in any way to alter, relocate or change its property to enable any other Person or corporation to use said public streets, alleys, waterways, easements and other public places of the CITY, as part of its permitting or approval process, the CITY shall require the Person desiring or occasioning such alteration, relocation or change to reimburse the COMPANY for any loss, cost or expense caused by or arising out of such change, alteration or relocation of any portion of the COMPANY'S facilities. The COMPANY further agrees that it will not intentionally interfere with, change, or injure any water pipes, drains, or sewers of said CITY unless it has received specific permission from the CITY or its duly authorized representative. He explained that there had been some discussion between staff as to a process to determine how to proceed with the plans. FPU would need to submit for a building permit and all contractors and subcontractors would need to be identified along with all the proper licensing received. Barry Kennedy, Director of Gas Operations for FPU explained to the Board that only the first phase of the project which was identified as that portion from Cemetery Road located in the County of Okeechobee to NW 9th Street, had been bid out. The contractors for the rest of the project would be decided after being bid out at a later date. Questions from the Board were asked that centered around the staging area, gate station, whether there would be a customer service office located in Okeechobee or just maintenance for emergencies. Discussed the types of construction equipment that would be utilized and that there would be a construction trailer for supplies like wire, not for personnel. Door hangers would be placed upon each resident's door notifying them of when work would affect them. Their timeline is to start as soon as all permitting and authorizations are received. Phase 1 should start in either December or January and the remainder of the project is scheduled as soon as contractors are chosen. FPU was advised of a FDOT project that involves the intersection of Parrott Avenue and Park Street (Hwy 441 and SR 70). They are aware of this and will be staying behind and going around the intersection. Technical Review Committee—November 15,2012-Page 3 of 3 Comments from the departments: Environmental Health; No issues were received. OUA; Mr. Hayford noted that he had not seen any plans yet and after looking at them quickly noted that a few of the water mains may be located in different locations. All utilities should be signed off after being reviewed. He also expressed interest in any safety training that may be available for his department. Building Official; Mr. Newell asked for civil as-builts when each phase was completed and also conceptual plans when they were available for the other phases of the project. He requested a copy of the site plan for the staging area with traffic flow and security areas notated if located within the City limits. He inquired about the fiber optic trunk line located in the area of the Hospital and how notification would be delivered. Locates will be done for each utility affected along with obtaining all the proper permits and authorizations. Public Works; Mr. Allen inquired about safety training for his department and expressed concern with work being done around the intersection of Parrott Avenue and Park Street(Hwy 441 &SR 70)due to the FDOT project. Police Department; Chief Davis inquired about traffic control and whether assistance from his department would be needed. Mr. Matt Henderson, Project Manager for FPU indicated that they would have flagmen out on the roads working with the traffic and may at times, when they are loading/unloading, need assistance from the City Police Department. Chief Davis also inquired about security at the staging area and Mr. Henderson said they would have security that would handle this. Fire Department; Chief Smith inquired about safety training and whether his department would be able to receive training to know what to expect. Fire, Police and Public Works would all be invited to attend any training that was provided to their employees. He inquired about the pressure amounts for the high density lines and whether FPU would be available for emergency response. FPU will have 24/7 coverage for emergencies. ***More detail was requested for the remainder of the project and it will be determined by staff should future TRC Meetings be necessary. Chief Smith moved to approve 12-003-TRC to grant FPU the authority to proceed with Phase 1 (Cemetery Road to NW 9th Street), of the natural gas system for the area; seconded by Building Official Newell. Motion carried unanimously. V. ADJOURNMENT—Chairperson. Hours of operation will be restricted to 'fz hour before sunrise through 'A hour past sunset; 3. All locate markers are to be removed from the right-of-way at the end of this project. 4. Any and all disturbed areas inside the FDOT right-of-way shall be returned to Department standards: this is not limited to grading and sodding. Seed and mulch are no longer acceptable methods; 5. The approved plans do not indicate the disturbance of any sidewalks. If sidewalks are needed to be cut and removed they will be accessible for pedestrian traffic at the end of each day's work and returned to FDOT specifications as soon as possible. 6. ingress/egress from all access points will remain open. The closing of any driveway or side road will require written permission, submitted to this office, from the property owner stating time and date. 7. Be aware that there are traffic signals, streetlights and school zone signals in place. Ensure the utility owner has located and your contractor has visually indentified the location and depth (pothole) of these and all underground utilities. 8. There will be a minimal separation of 3' between the proposed gas line and all drainage and storm water conveyances. 9. Special attention should be given to the school hours and additional motorized and pedestrian traffic that will occur at the beginning and end of the school day. Ap plans and Installations shall conform to the requirements of the FDOTs UAM in effect as of the date this permit is approved by FDOT,and shall be made a part of this permit. Pursuant to Section 337.403(1),Florida Statues,any utility placed upon,under,over,or along any public road or publicly owned rail corridor that is found by FDOT to be unreasonably interfering in any way with the convenient,safe,or continuous use,or maintenance,improvement,extension,or expansion,of such public road or publicly owned rail corridor shall,upon thirty(30)days written notice to the utility or its agent by FDOT,be removed or relocated by such utility at its own expense except as provided in paragraphs(a)and(b),and except for reimbursement rights set forth in previously executed subordination and Railroad Utility Agreements, and shall apply to all successors and assigns for the permitted facility. 9. It is agreed that in the event the relocation of said utilities are scheduled to be done simultaneously with the FROM construction work,the Permittee wili coordinate with the FDOT before proceeding and shall cooperate with the FDOT's contractor to arrange the sequence of work so as not to delay the work of the FOOTs'cxntractor,defend any legal claims of the FDOT's contractor due to delays caused by the Permittee's failure to comply with the approved schedule,and shall comply with all provisions of the law and the FOOTS current UAM.The Permittee shall not be responsible for delay beyond its control. 10. to the case of non-compliance with the FDOTs requirements in effect as of the date this permit is approved,this permit is void and the facility will have to be brought into compliance or removed from the RMt at no cost to the FOOT,except for reimbursement rights set forth in previously executed subordination and Railroad Utility Agreements. It is understood and agreed that the rights and privileges herein set out are granted only to the extent of the State's right,title and interest in the land to be entered upon and used by the Pemhlttee,.and the Permittee will,at all times,and to the extent permitted by law,assume all risk of and indemnify,defend, and save harmless the State of Florida and the FOOT from and against any and all loss,damage,cost or expense arising in any manner on account of the exercise or attempted exercises by said Permittee of the aforesaid rights and privileges. 12. During construction,all safety regulations of the FOOT shall be observed and the Permittee must take measures,including placing and the display of safety devices that may be necessary in order to safely conduct the public through the project area in accordance with the Federal MUTCD,as amended for highways,the requirements of the Standard.Application Package for railways,including flagging services and Railroad Protective insurance or acceptable alternative,when applicable,and the FDOT's Design Standards,Indexes 600-870,and Standard Specifications for Road and Bridge Construction,;Section 102,as amended by the UAM. Whenever the Permittee removes its facilities,it shall be at the Pemiittee's sole cost and expense. In the event contaminated soil is encountered by the Utility or anyone within the permitted construction limits,the Utility shall immediately cease work and notify the FDOT. The FOOT shall coordinate with the appropriate agencies and notify the Permittee of any suspension or revocation of the permit until contamination assessment and remediation,as appropriate under Rule Chapters 62-770 and 62-730 Florida Administrative Code,has progressed to a state that all environmental regulatory agencies having jurisdiction have approved the site of the contamination for resumption of work.
