Mr. Sterling said the property owner had called and said it would be mowed. However, the lawn maintenance company is waiting for payment in advance before they will mow the property. Member Huckabee moved to find Case 12-049 Fosler LLC at 1000 Blk NW 5" Avenue in violation of Ch 30 Sec 30-43 Public nuisance and Sec 30-44 General cleaning and beautification, based on the testimony of Code Officer Sterling, imposing a fine of twenty-five dollars per day beginning seven (7) days from receipt of proper notification; seconded by Member Close. VOTE GAMIOTEA - YES HUCKABEE - YES CLOSE - YES DENISUK -ABSENT DOUGLAS - ABSENT PIPPIN - ABSENT SWEDA - ABSENT CONRAD - YES MURPHY - YES MOTION CARRIED. Code Officer Sterling testified all notices and board orders were either hand delivered or received by certified mail. He said this is vacant property and nothing has been done for several months to bring the property into compliance.
