RECESS REGULAR SESSION AND OPEN WORKSHOP-Chairperson. CHAIRPERSON HOOVER RECESSED THE REGULAR SESSION AND OPENED THE WORKSHOP AT 6:03 P.M. A. Discuss Future Land Use designation and Zoning district conflicts Mr. Brisson began by discussing how to resolve conflicts between the Future Land Use(FLU)designations and Zoning that are shown on the Zoning Map as Holding (H) -City Planner. districts that are shown on the Zoning Map as Holding (H). To easily identify specific parcels on both maps, each was assigned a conflict number. 1. Several areas located throughout the City in all quadrants. No. 1, consists of numerous properties in the NW quadrant, each with a FLU designation as Single-Family(SF), and Zoning as Holding (H). The recommendation is to rezone the properties to Residential Single Family-One(RSF-1).All properties are located in the City of Okeechobee subdivision. 1202 NW 13th Street, Legal: Lots 7-12, of Block 7 has a 1500 square foot building that may have been a duplex or triplex at one time.800,804, and 806 NW 12'h Street, Legal: Lots 12, 11, 9-10 respectfully, of Block 10 all have single family homes. 810 NW 12th Street, Legal: Lots 7-8, of Block 10 contains a triplex and two single family homes.803 NW 12th Street, Legal: Lot 2,of Block 23, 1100 and 1110 NW 9th Avenue,Legal:Lots 7,and 5-6 respectfully of Block 23,and 1109 NW 8th Avenue,Legal:Lot 1 of Block 23 are all vacant properties.800,802,804,806 and 808 NW 11th Street, Legal:Lots 12, 11, 10,9,and 8 respectfully of Block 23 all have single family homes. There were no questions, comments or objections noted. No. 2, consists of vacant properties located on NW 7th Court between NW 10th and 11th Avenues, Legal: Lots 1-20,of Block 13,NW Addition,with FLU designations as SF and Zonings as H.The recommendation is to rezone the properties to RSF-1. There were no questions, comments or objections noted. No. 3, consists of vacant properties located on NW 7th Street between NW 9th and 10th Avenues, Legal: Lots 1-26, of Block 68, City of Okeechobee, with FLU designations as SF and Zonings as H. The recommendation is to rezone the properties to RSF-1. There were no questions, comments or objections noted. No. 4, consists of three unplatted properties located between SW 2nd to 9th Streets and East of SW 10"Avenue. One is 9.890 acres and the other is 9.120 acres owned by Frank Altobello's Trust. The third is 13.320 acres owned by Montebello 13 LLC.The properties have FLU designations as SF and Zonings as H.The recommendation is to rezone the vacant properties to RSF-1. There were no questions, comments or objections noted. No.5,consists of a 1.725 acre unplatted parcel at 517 SW 21st Street and has two homes located on it(formally owned by Judge Bryant).The other is a vacant 12.210 acre unplatted parcel,and contiguous to the previous one.The properties have FLU designations as SF and Zonings as H.The recommendation is to rezone the properties to RSF-1.There were no questions, comments or objections noted. No. 6, consists of a 32.8 acres unplatted parcel along the West side of Taylor Creek, with a FLU designation of Residential Mixed Use(RMU)and Zoning of H.The recommendation is to rezone the properties to RSF-1. The consensus of the Board was to follow the Planner's recommendation of the RSF-1 Zoning. No.7,consists of a 2.210 acre parcel located East of 815 South Parrott Avenue, owned by Suntrust Bank which was previously used as the drive thru. It is now used from time to time as parking. The property has a FLU designation as SF and Zoning as H. There were two recommendations for this parcel. To rezone the parcel to RSF-1 which would leave the parking use nonconforming or to change the FLU to Commercial(C)and rezone it to Commercial Professional Office (CPO). Discussion followed as to the best plan of action to take due to the properties' proximity to various commercial and residential uses. In an effort to stay consistent,the Board consensus was to rezone to RSF-1 and the property owner would have an opportunity at the public hearings to request something different. No. 8, consists of a 2 acre unplatted parcel located at 1105 SE 9th Drive.The property is owned by Gary and Glenda Craver and consists of a single family home and accessory uses. The property has a FLU designation as SF and Zoning as H. The recommendation is to rezone the property to RSF-1. There were no questions, comments or objections noted. No.9,consists of two unplatted properties.The one to the West,802 SE 10th Avenue,is 4.710 acres with a single family home and accessory uses. The other to the East, is 9.5 acres, both owned by Wayne and Bonnie Thomas. The properties have a FLU designation as SF and Zoning as H.The recommendation is to rezone the properties to RSF-1. There were no questions, comments or objections noted. No. 10, is a 0.49 acre parcel, located East and contiguous to Lot 1 of Block 116, City of Okeechobee, has a FLU designation as SF and Zoning as H. Property is owned by Ricky and Bonnie Lightsey who also own Lots 1, and 4-6 of Block 116. The recommendation is to rezone the property to RSF-1. There were no questions, comments or objections noted. No. 11, consists of 51.190 acres of unplatted, vacant, lands located East of Taylor Creek to the City limits and South of the CSX Railroad. No. 12 a.,is a parcel which is a part of abandoned Riverside Drive and is contiguous to Lots 1 and 12 of Block 82, City of Okeechobee.The property owner owns this parcel together with Lots 1,2, 11 and 12 of said Block,and is addressed as 649 NE 6th Street. It contains a single family home and accessory uses. Has a FLU designation as SF and Zoning as H.The recommendation is to rezone the property to RSF-1.There were no questions,comments or objections noted. No. 12 b.,is also a portion of abandoned Riverside Drive that is now part of Diamond R Fertilizer located at 710 NE 5th Avenue, Legal: Block 53, City of Okeechobee, and NE 6th Avenue from 7th Street to railroad and part of NE 8`h Street from 4th Avenue to Taylor Creek.The property has a FLU of SF with a portion Zoned H and another Industrial(IND).The recommendation is to change the FLU to Industrial and rezone the Holding portion to IND. The Board discussed the issue of making sure their recommendations were consistent and how this property is different than map identification No. 7. There were several zoning districts that would have been beneficial to that parcel. The Planning Staff recommended RSF-1,which will cause the existing use to be non-conforming. However,the use is not accurately known, as it was their extended drive thru service, then later the teller booths were demolished. It appears to only be used as an overflow parking lot. In this instance,Planning Staff is recommending to change both the FLU and Zoning for several reasons.One,the surrounding and existing industrial uses around and on the property. Second, the proximity to the railroad. While there are some residential homes in the area, RSF-1 would not be a practical recommended zoning district. The consensus of the Board was to uphold the Planner's recommendation. No. 12 c.,is a 0.99 acre parcel located between CSX Railroad and NE 9th Street,West of Taylor Creek and East of Block 51. The property has a FLU of SF and a Zoning of H. The recommendation is to change both the FLU and Zoning to Industrial. The parcel is not suitable for any other zoning due to it's proximity to the railroad and adjacent existing Industrial uses. Board consensus was in agreement with the Planner's recommendation. No. 13 a.,is 23.86 acres located at 1200 NE 12th Drive,and is the Ground Water Treatment Plant for Okeechobee Utility Authority (OUA). The FLU is Industrial and has a Zoning of H. The recommendation is to either rezone to IND to be consistent with the FLU map or change the FLU to Public Facilities (PF) and rezone to Public Facilities (PUB) as suggested by the OUA. Consensus of the Board was to change the FLU to PF and rezone to PUB since the property is owned and operated by a governing agency and has protected well heads. No. 14, are vacant properties for Legal: Lots 8-13 and 20-26 of Block 32 and Lots 1-6 and 20-26 of Block 35,City of Okeechobee.The FLU is SF and the Zoning is H with a recommendation to rezone to RSF-1.There were no questions, comments or objections noted. No. 15,deals with all of Block 1,Lots 1-6 and 21-26 of Block 2,Lots 1-8 and 21-26 of Block 15 and all of Block 16,City of Okeechobee.The vacant properties have a FLU of SF and a Zoning of H with a recommendation to rezone to RSF-1. No.16,deals with Lots 9-10,of Block 15,City of Okeechobee The FLU is C and Zoning is H with a recommendation to Rezone to CHV to keep area consistent with zoning.There were no questions,comments or objections noted. Planning & Management Services, I .C. w., ....... 7 Memorandum To: Planning Board Members From: Bill Brisson Date: May 10, 2012 Subject: Additional Materials for May Planning Board Workshop Meeting Attached is another set of materials we would like to discuss at either the upcoming Planning Board meeting or the following month's meeting. This will not be a public hearing and no official action will be taken. Rather,just as was the case at our last meeting, we wish to discuss these matters with you and take away with us, some consensus as to the direction that needs to be taken. Following are brief summaries and explanations of the materials: A. Materials showing conflicts between the FLUM and the Zoning Map that involve properties that are now shown on the Zoning Map as"H"Holding District. There are it number of areas throughout the City in which such properties are located. These are outlined and shown in crosshatch on the 11"by 17"color map. Each area is numbered for identificiation purposes. The crosshatching indicating the"H"zoning is overlaid on the Future Land Use which is indicated by the color beneath the crosshatching. As you may recall,there is no longer an"H" zoning district in the Land Development Code. Therefore the zoning on each of the parcels with such zoning needs to be changed to one of current zoning districts. In some instances we may also recommend a change to the current Future Land Use Designation. B. The materials covering the"H"zoned areas includes: (1) The aforementioned color 11"by 17"map showing the specific conflict areas. (2) a "Google" aerial of the area identifying each of the conflict areas and the uses in those areas and on surrounding properties. A table summarizing the character of the existing land uses, FLUM and Zoning for each conflict area and our recommendation to either change the Future Land Use designation or to rezone the property. Since Future Land Use designations take precedence over zoning, e initially assume that the Future Land Use designation is correct and will a st always recommend rezoning the property to be consistent with the FL B. If we recommend changing the FLU designation,we will not general y recommend a change to the FLUM that will result in a land use designation that i more restrictive than presently applied. As you recall, at the last meeting we were asked to provide addresses for the properties under consideration for changes to Future Land Use Map or Zoning Map. The two attached pages replace the recommendations page that was previously provided in our memo dated May 10, 2012 covering the properties that are now zoned "H", Holding. These new pages include references to the addresses of the various properties that actually have specific addresses.
